The purpose of this article is to establish the standards and manner by which driveways and parking spaces shall be constructed and maintained to protect the public health, safety, welfare and aesthetics of the community. This article shall apply to all properties covered by Article
V, Property Maintenance Code, of this chapter.
All driveways and parking spaces shall be maintained in a proper
state of repair free from hazardous conditions. These areas must be
clearly designated by the property owner and shall be constructed
with concrete, crushed stone, macadam, or similar material installed
and graded to prevent pooling of water.
Driveways and parking spaces shall not be situated between the
sidewalk and any part of the structure except as follows:
A. Properties where the owner has been granted authority to maintain
a driveway or parking space between the sidewalk and any part of the
structure by action of the municipal planning board, zoning board
of adjustment or governing body of the City, provided that the driveway
and parking spaces are constructed and maintained in accordance with
these regulations and any conditions of approval.
B. Properties containing driveways or parking spaces located between
the sidewalk and any part of the structure constructed in accordance
with regulations in effect prior to the adoption of this article.
All areas not designated as driveways or parking spaces shall
be covered with grass, appropriate vegetation, or landscaping material
to prevent dust, stagnant water or any other blighting conditions
to exist.
Any person who shall violate any of these regulations shall, upon conviction thereof, be subject to the penalties set forth in Chapter
1, General Provisions, Article
III.
