It shall be unlawful for any person to use a manufactured home or place
a manufactured home on individual lots within zoning classifications without
first securing a permit therefor from the Code Enforcement Officer.
The purpose and intent of this chapter is to:
A. Provide maximum compatibility between manufactured homes
and site-built homes within the general residential environment.
B. Maximize opportunity for affordable housing.
C. Minimize arbitrary interference with citizens' housing
choice.
D. Promote the health, safety, and general welfare of all
the residents of the Village of Scottsville, including those living in a manufactured
home.
As used in this chapter, the following terms shall have the meanings
indicated:
MANUFACTURED HOME (DWELLING)
A factory-built residential dwelling unit designed to be occupied
as a dwelling, complete and ready for occupancy except for minor and incidental
unpacking and assembly operations and placement on a permanent foundation
and connections to utilities. Manufactured housing built after June 15, 1976,
shall meet the National Manufactured Home Construction and Safety Standards
as set forth by the United States Department of Housing and Urban Development
and the New York State Uniform Fire Prevention and Building Code. A travel
trailer shall not be considered as a manufactured dwelling, nor may be it
used as such.
MANUFACTURED HOME INSTALLATION
Manufactured homes shall be installed in conformity with the manufacturer's
installation instructions. When the manufacturer's instructions are not
available, the home shall be installed in conformance with the Residential
Code of New York State. A licensed New York State engineer- or architect-stamped
plan for installation is also acceptable.
RESIDENTIAL DESIGNED MANUFACTURED HOME
A home that meets the definition of a manufactured home, including
the following criteria:
A.
A minimum of width of 24 feet.
B.
Minimum square footage requirement compatible with given residential
zoning district.
C.
The roof has a type of shingle or system commonly used in site-built,
residential construction.
D.
The exterior siding is of a type of material commonly used in residential
construction.
E.
All towing devices, wheels, axles, and hitches are removed.
F.
All are installed on a permanent foundation as approved by the Residential
Code of New York State.
G.
The material used to enclose the crawl space of the home must be brick
or stone with proper air ventilation and allow easy access.
H.
All homes are compatible in assessed value to the average of existing
housing within 500 feet in the same zoning district.
I.
All homes shall be newly manufactured.
A home meeting the criteria of a residential designed manufactured home
shall be permitted in all residential districts, subject to the provisions
and requirements of such districts, and shall be regulated uniformly with
site-built homes in those districts.
In the event that no district requirements call for the location of
the homes, the manufactured home shall be placed on the lot in manner that
is compatible with a reasonably similar location to the site-built housing
in adjacent or nearby locations.
Any person, firm or corporation who or which shall violate the provisions of this chapter shall be punishable, upon conviction, as provided in Chapter
1, Article
III of the Village of Scottsville Code.
