A Municipal Court is hereby established, effective upon final
passage and publication of this article, pursuant to N.J.S.A. 2B:12-1
et seq., which Court shall be known as the "Municipal Court of the
Township of Chester," and the Judge of said Court shall be known as
the "Judge of the Municipal Court."
The Municipal Court shall have, possess and exercise all the
functions, powers, duties and jurisdiction of a municipal court as
prescribed by N.J.S.A. 2B:12-1 et seq. as amended, or as may hereafter
be prescribed by law.
The Municipal Court shall have a seal which shall bear the impress
of the name of the Court.
The costs and fees against defendants, when collected, shall
become municipal funds and shall be turned over to the custodian of
the funds of the municipality. The fines and penalties imposed in
said Municipal Court shall be disposed of as prescribed by law.
The Municipal Court shall be held in the Municipal Building,
and the Judge of the Municipal Court shall sit during such hours and
at such times as the business of the Court may require, subject to
the rules applicable to municipal courts.
There is hereby created the position of Municipal Court Administrator.
The Administrator shall be appointed by the Township Council and shall
serve at the pleasure of the Township Council, except that an officeholder
who qualifies under Title 2B of the New Jersey statutes for tenure
shall enjoy a tenured status. The Administrator shall be paid compensation
as provided by the Township Council within the range set forth in
the Salary Ordinance, as it shall be amended from time to time.
There is hereby created the office of Municipal Deputy Court
Administrator, whose occupant shall perform the duties assigned by
the Judge of the Chester Township Municipal Court and shall, in the
absence of the Court Administrator, perform all of the duties of the
Court Administrator. The Deputy Court Administrator shall be appointed
by the Township Council and shall serve at the pleasure of the Township
Council. The Deputy Court Administrator shall be paid compensation
as provided by the Township Council within the range set forth in
the Salary Ordinance, as it shall be amended from time to time.
