Specific terms. Certain words, phrases and terms in
this chapter are defined for the purpose thereof as follows:

ACCESSORY APARTMENT
A self-confined residential accommodation, including a separate
kitchen, bathroom and sleeping quarters, which is located within a
single-family dwelling.

ACCESSORY USE OR STRUCTURE
A subordinate use or structure which is customarily incidental
to the principal use or structure on the same lot.
ADJOINING PROPERTY
Parcels of land which share a common property line or existing
road right-of-way.
AGRICULTURAL LABOR HOUSING
Residential dwellings, for the use of employees of an agricultural
or horticultural purpose or use, which because of their character
or location are not practical for and cannot be transformed into permanent
housekeeping units for nonagricultural employees.

AGRICULTURAL OR HORTICULTURAL PURPOSE OR USE
Any production of plants or animals useful to man, including
but not limited to: forages or sod crops, dairy animals or dairy products;
poultry or poultry products; livestock, including beef, cattle, sheep,
horses, ponies, mules or goats and including the breeding and grazing
of any or all of such animals as provided for in this chapter; bees
and apiary products; fruits of all kinds, including grapes, nuts,
and berries; vegetables, nursery, floral, ornamental and greenhouse
products.

ALTERATION
A change or rearrangement in a structure or the structural
parts of an existing facility or an enlargement, whether by extension
of a site or by increasing in size or height, or by moving from one
location or position to another.
APPLICANT
A developer submitting an application for development.
APPLICATION FOR DEVELOPMENT
The application form and all accompanying documents required
by ordinance for approval of a subdivision plat, site plan, planned
development, conditional use, zoning variance or direction of the
issuance of a permit pursuant to N.J.S.A. 40:55D-34 or 40:55D-36.
BASEMENT
A story partly below ground level having more than 1/2 of
its floor-to-ceiling height above the grade of the adjoining ground.
Basement area may be included as part of the minimum required floor
area for residence.
BOARD OF ADJUSTMENT
The Zoning Board of Adjustment of the Township of Chester established pursuant to Part
1, Land Use Procedures, of this chapter and N.J.S.A. 40:55D-69.
BUILDING
A combination of materials to form a construction adapted
to permanent, temporary or continuous occupancy or use and having
a roof.
BUILDING AREA
That horizontal ground area directly under a building, excluding
cornices, eaves, gutters or chimneys projecting not more than 18 inches,
steps, one-story open porches, bay windows not extending through more
than one story and not projecting more than five feet, balconies and
terraces.
BUILDING COVERAGE
The area of the projection of all roof areas on a horizontal
plane.
BUILDING ENVELOPE
The central portion of any lot lying between required yards
and/or setback lines.

BUILDING HEIGHT
The vertical dimension measured from the average elevation
of the finished lot grade computed by averaging the grade at the four
corners of a principal structure or the four most extreme points on
the north, south, east and west sides of a principal structure, or
at four points 90° apart for a circular structure, to the highest
point of the structure.
BUILDING, PRINCIPAL
A structure in or on which is conducted the principal use
of the site on which it is situated.
BUSINESS
Any principal use permitted within the B and LB Zones.
BUSINESS UNIT
Any interior area utilized for business operations, and which
is owned or leased by a tenant.
CELLAR
A story partly above ground level having less than 1/2 of
its floor-to-ceiling height above the grade of the adjoining ground.
Cellar area shall not be included as part of the minimum required
floor area for residence.
CIRCULATION
Systems, structures and physical improvements for the movement
of people, goods, water, air, sewage or power by such means as streets,
highways, railways, waterways, towers, airways, pipes and conduits
and the handling of people and goods by such means as terminals, stations,
warehouses and other storage buildings or transshipment points.
CLUB
An organization, corporation or association operating solely
for benevolent, charitable, fraternal, social, religious, recreational,
athletic or similar purposes not for private gain.
COMMERCIAL VEHICLE
Any type of vehicle used for commercial purposes and registered
as a commercial vehicle with the New Jersey Motor Vehicle Commission,
including but not limited to vehicles used to transport persons or
property for compensation or used in the furtherance of and/or performance
of a specific job or work function. This definition shall include
any vehicle bearing advertisements or printed commercially related
matter thereon. This term shall not include vehicles used for private
or personal transportation.

COMMON OPEN SPACE
An open space area within or related to a site designated
as a development and designed and intended for the use or enjoyment
of residents and owners of the development. Common open space may
contain such complementary structures and improvements as are necessary
and appropriate for the use or enjoyment of residents and owners of
the development.
CONDITIONAL USE
A use permitted in a particular zoning district only upon
a showing that such use in a specified location will comply with the
conditions and standards for the location or operation of such use
as contained in the zoning ordinance, and upon the issuance of an
authorization therefor by the Planning Board.
COUNTY MASTER PLAN
A composite of the Master Plan for the physical development
of Morris County, with the accompanying maps, plats, charts and descriptive
and explanatory matter adopted by the County Planning Board pursuant
to N.J.S.A. 40:27-2 and 40:27-4.
DAY SCHOOL
A school designed to provide daytime instruction for two
or more children above the age of six years and having no boarding
students.
DEVELOPER
The legal or beneficial owner or owners of a lot or of any
land proposed to be included in a proposed development, including
the holder of an option or contract to purchase or any other person
having an enforceable proprietary interest in such land.
DEVELOPMENT
The division of a parcel of land into two or more parcels,
the construction, reconstruction, conversion, structural alteration,
relocation or enlargement of any building or other structure or of
any mine, excavation or landfill and any use or change in the use
of any building or other structure or land or extension of use of
land for which permission may be required pursuant to the Municipal
Land Use Law, N.J.S.A. 40:55D-1 et seq.
DEVELOPMENT REGULATION
A zoning ordinance, subdivision ordinance, site plan ordinance,
Official Map ordinance or other municipal regulation of the use and
development of land or amendment thereto, adopted and filed pursuant
to the Municipal Land Use Law, N.J.S.A. 40:55D-1 et seq.
DRAINAGE
The removal of surface water or groundwater from land by
drains, grading or other means and including control of runoff to
minimize erosion and sedimentation during and after construction or
development and means necessary for water supply preservation or prevention
or alleviation of flooding.
DWELLING UNIT
One or more rooms providing living facilities for one family,
including equipment for cooking and sanitary facilities.
EDUCATIONAL USE
Public, parochial and private elementary and secondary schools
duly licensed by the State of New Jersey, attendance at which is a
sufficient compliance with the compulsory education requirements of
the state. Educational uses shall also include institutions of higher
education duly licensed by the State Department of Higher Education.
ELECTRIC VEHICLE
Any vehicle that is licensed and registered for operation
on public and private highways, roads, and streets; and operates either
partially or exclusively using an electric motor powered by an externally
charged on-board battery.

ELECTRIC VEHICLE SUPPLY/SERVICE EQUIPMENT or EVSE
The equipment, including the cables, cords, conductors, connectors,
couplers, enclosures, attachment plugs, power outlets, power electronics,
transformer, switchgear, switches and controls, network interfaces,
point of sale equipment, and associated apparatus designed and used
for the purpose of transferring energy from the electric supply system
to a plug-in electric vehicle. "EVSE" may deliver either alternating
current or, consistent with fast charging equipment standards, direct
current electricity. "EVSE" is synonymous with "electric vehicle charging
station."

ENVIRONMENTAL IMPACT STATEMENT
A written report, prepared in accordance with the requirements
of this chapter, which identifies the environmental, social and economic
conditions which may be changed, and the extent to which they may
be changed, by a proposed development.
EROSION
The detachment and movement of soil or rock fragments by
water, wind, ice or gravity.
FAMILY
One or more persons occupying dwelling accommodations as
a single nonprofit housekeeping unit residing together and utilizing
all rooms and cooking facilities in common on a domestic and permanent
basis.

FARMSTAND
A structure having a ground floor area not to exceed 700
square feet and having no more than three permanent exterior walls,
which is utilized to sell products from farms devoted to agricultural
and/or horticultural uses.

FENCE, CLOSED
A fence constructed in such a way that more than 50% of its
surface area obstructs a view through the fence, from a position perpendicular
to the fence. Examples include, but are not limited to, solid picket,
board, board and batten, louver panel, staggered board, panel, and
one-by-four wood screens.

FENCE, OPEN
A fence constructed in such a way that no more than 25% of
its surface area obstructs a view through the fence, from a position
perpendicular to the fence. Examples include, but are not limited
to, slip rail, contemporary rail, wire mesh, mesh fabric, and rail
and wire mesh.

FENCE, SEMI-OPEN
A fence constructed in such a way that between 25% and 50%
of its surface area obstructs a view through the fence, from a position
perpendicular to the fence. Examples include, but are not limited
to, one-by-two wooden screens and contemporary picket fences.

FINAL APPROVAL
The official action of the Planning Board taken on a preliminary
approved major subdivision or site plan after all conditions, engineering
plans and other requirements have been completed or fulfilled and
the required improvements have been installed or guaranties properly
posted for their completion or approval conditioned upon the posting
of such guaranties.
FLOOR AREA
The sum of the gross horizontal areas of the several stories
of a building. Floor areas shall not include cellar space, floor space
where the average floor-to-ceiling height is less than seven feet,
and porches, breezeways and garages.
FRONTAGE
The width of a lot measured at the street line.
GARAGE
A building or roofed structure primarily intended for storage
of one or more vehicles maintained for the resident occupant of the
premises and in which no service is rendered to the public or business
conducted.
HELIPORT
An area of defined dimensions designated for the landing
and takeoff of helicopters and used solely for that purpose.
HISTORIC SITE
Any building, structure, area or property that is significant
in the history, architecture, archaeology or culture of this state,
its communities or the nation and has been so designated by law.
HOME BUSINESS PERMIT
A permit issued upon application and payment of fee to the
Zoning Officer for the conduct of a home occupation or professional
business office in the R-1, R-2, R-3, R-5 or R-10 Zone.

HOSPITAL
A building used for the diagnosis, treatment or other care
of human ailments.
HOUSEHOLD
Synonymous with "family."

IMPROVED LOT COVERAGE
That portion of a lot which is improved or is proposed to
be improved with principal and accessory buildings or structures or
driveways, parking lots, pedestrian walkways, signs or any man-made
improvements of the ground surface. See "building coverage."
INTERESTED PARTY
Any person, whether residing within or without the Township,
whose right to use, acquire or enjoy property is or may be affected
by any action taken under this chapter, or whose rights to use, acquire
or enjoy property under this chapter or under any law of this state
or of the United States have been denied, violated or infringed by
an action or a failure to act under this chapter.
JUNKYARD
Any area or structure used for the storage, sale, processing
or abandonment of junk, such as scrap metal, glass or paper or for
the dismantling, demolition or abandonment of any inoperable mechanical
equipment, machinery or vehicles or parts thereof.
KENNEL
An establishment where more than six dogs, each over six
months old, are kept or harbored.
LAND
Includes improvements and fixtures on, above or below the
surface.
LOT
A designated parcel, tract or area of land established by
a plat or otherwise as permitted by law and to be used, developed
or built upon as a unit.
LOT AREA
An area of land which is determined by the limits of the
lot lines bounding that area, excluding any portion contained in a
street right-of-way.
LOT, CORNER
A lot abutting upon two or more streets at their intersection
or upon two parts of the same street, such streets or parts of the
same street forming an interior angle of less than 135°. The point
of intersection of the street side lines is the corner.
LOT COVERAGE
That percentage of a lot covered by the total building area
of all buildings situated on the lot.
LOT COVERAGE, IMPROVED
That portion of a lot which is improved or is proposed to
be improved with principal and accessory buildings, structures such
as driveways, parking lots, pedestrian walkways, signs and other man-made
improvements on the ground surface.
LOT, FLAG
An individual lot with less than a required lot width as
permitted for one-family residential use in the R-10, R-5, R-3 or
R-2 Zones, which lot and its subdivision are subject to the approval
by the Planning Board based on compatibility with the present and
future development of adjacent lands in which lot shall be subject
to the following requirements:

(1)
The entire lot, including the portion having
less than the required width, must be in the same ownership.
(2)
The lot must have sufficient frontage on the street to permit the construction of a proper driveway connection with the street, and in any event must have at least 45 feet of such frontage. No part of the staff on any flag shall be less than 45 feet wide. Each flag lot will have its own staff within which a driveway can be constructed conforming to the requirements of Article
47, §
113-315 et seq. of this chapter.
(3)
All flag lots shall have an area exclusive of
the flag staff area of at least two times the minimum lot area for
the zone in which such property is located.
LOT LINE, REAR
The lot line opposite, most nearly parallel to and most distant
from the front lot line or the point at which the two side lot lines
meet, as the case may be.
LOT WIDTH
The distance between lot lines measured parallel to the street
right-of-way line at the most forward allowable building line or setback
line; however, the frontage shall not be less than 1/2 the required
lot width or 100 feet, whichever is greater, except in the case of
flag lots.
MAKE-READY PARKING SPACE
Means the pre-wiring of electrical infrastructure at a parking
space, or set of parking spaces, to facilitate easy and cost-efficient
future installation of electric vehicle supply equipment or electric
vehicle service equipment, including, but not limited to, Level Two
EVSE and direct current fast chargers. Make-ready includes expenses
related to service panels, junction boxes, conduit, wiring, and other
components necessary to make a particular location able to accommodate
electric vehicle supply equipment or electric vehicle service equipment
on a "plug and play" basis. "Make-ready" is synonymous with the term
"charger ready," as used in P.L. 2019, c. 362 (N.J.S.A. 48:25-1 et
seq.).

MANUFACTURING
The treatment or processing of raw products and the production
of articles from raw or prepared materials by giving them new forms
or qualities.
MASTER PLAN
A composite of the mapped and written proposals recommending
the physical development of the Township which shall have been duly
adopted by the Planning Board pursuant to Article 3 of the Municipal
Land Use Law, N.J.S.A. 40:55D-1 et seq.
MOTOR VEHICLE
A self-propelled vehicle or means of transport in or on which
something is carried, conveyed or travels.
MULTIPLEX
A residential building containing up to six single-family
attached dwellings, in which each unit has individual access to the
outside.
MUNICIPAL AGENCY
The Planning Board, the Zoning Board of Adjustment or the
governing body when acting pursuant to this act, and any agency which
is created by or responsible to the Township of Chester and one or
more other municipalities when such agency is acting pursuant to the
Municipal Land Use Law, N.J.S.A. 40:55D-1 et seq.
NONCONFORMING BUILDING
A building which its design or location upon a lot does not
conform to the regulations of this chapter for the zone in which it
is located.
NONCONFORMING LOT
A lot the area, dimension or location of which was lawful
prior to the adoption, revision or amendment of this chapter, but
which fails to conform to the requirements of the zoning district
in which it is located by reason of such adoption, revision or amendment.
NONCONFORMING STRUCTURE
A structure the size, dimension or location of which was
lawful prior to the adoption, revision or amendment of this chapter,
but which fails to conform to the requirements of the zoning district
in which it is located by reasons of such adoption, revision or amendment.
NONCONFORMING USE
A use or activity which was lawful prior to the adoption,
revision or amendment of this chapter, but which fails to conform
to the requirements of the zoning district in which it is located
by reasons of such adoption, revision or amendment.
NURSERY SCHOOL
A school designed to provide daytime care or instruction
for two or more children from two to six years of age, inclusive,
and operated on a regular basis.
NURSING HOME
Any premises meeting the standards of the New Jersey State
Department of Institutions and Agencies for a nursing home.
OFFICE USE
The occupancy or use of a building or structure or any portion
thereof for the transaction of business or the rendering or receiving
of professional services.
OFFICIAL COUNTY MAP
The map, with changes and additions thereto, adopted and
established, from time to time, by resolution of the Board of Chosen
Freeholders of Morris County pursuant to N.J.S.A. 40:27-5.
OFFICIAL MAP
A map adopted by the governing body pursuant to Article 5
of the Municipal Land Use Law, N.J.S.A. 40:55D-1 et seq.
OFF-SITE
Located outside the lot lines of the lot in question, but
within the property of which the lot is a part, which is the subject
of a development application or within a contiguous portion of a street
or right-of-way.
OFF-TRACT
Not located on the property which is the subject of a development
application nor on a contiguous portion of a street or right-of-way.
ON-SITE
Located on the lot in question.
ON-TRACT
Located on the property which is the subject of a development
application or on a contiguous portion of a street or right-of-way.
OPEN SPACE
Any parcel or area of land or water essentially unimproved
and set aside, dedicated, designated or reserved for public or private
use or enjoyment or for the use and enjoyment of owners and occupants
of land adjoining or neighboring such open space; provided that such
areas may be improved with only those buildings, structures, streets
and off-street parking and other improvements that are designed to
be incidental to the natural openness of the land.
OPEN SPACE, COMMON
An open space area with or related to a site designated as
a development and designed and intended for the use or enjoyment of
residents and owners of the development. Common open space may contain
such complementary structures and improvements as are necessary and
appropriate for the use or enjoyment of residents and owners of the
development.
OUTPATIENT SURGICAL FACILITY
A facility providing surgical treatment to patients not requiring
hospitalization. It is not part of a hospital but is organized and
operated to provide medical care to outpatients. Patients shall be
served solely on an outpatient basis, and no patients shall be kept
overnight on the premises.

PARKING AREA, PRIVATE
Any open area of private property used for the temporary
storage of automobiles and other vehicles for the private use of the
owners or occupants of the lot on which the area is located.
PARKING AREA, PUBLIC
Any open area, deck or structure, other than a street or
other public way, used for the parking of automobiles and other vehicles
and available to the public, whether for a fee, free or as an accommodation
for clients or customers.
PARKING SPACE
An accommodation for the off-street parking of one operable,
registered motor vehicle.
PERFORMANCE GUARANTY
Any security which may be accepted by a municipality, including
cash, provided that a municipality shall not require more than 10%
of the total performance guaranty in cash.
PERSONAL SERVICE ESTABLISHMENT
A building or part thereof in which or from which a service
is rendered directly to the retail consumer, including, but not limited
to, dry cleaners, barber and beauty shops, nail salons, shoe repair
shops, photographic studios, on-premises repair of small household
appliances, and instructional classes for physical fitness, dance,
martial art, music, ceramics and similar activities.

PLANNED DEVELOPMENT
Planned unit development, planned unit residential development,
residential cluster, planned commercial development or planned industrial
development.
PLANNING BOARD
The Planning Board established by the governing body pursuant
to the Municipal Land Use Law, N.J.S.A. 40:55D-23.
PLAT
A map or maps of a subdivision or site plan.
PRIVATE EVSE
EVSE that has restricted access to specific users (e.g.,
single- and two-family homes, executive parking fleet parking with
no access to the general public).

PUBLIC DRAINAGEWAY
The land reserved or dedicated for the installation of stormwater
sewers or drainage ditches or required along a natural stream or watercourse
for preserving the channel and providing for the flow of water to
safeguard the public against flood damage, sedimentation and erosion.
PUBLIC OPEN SPACE
An open space area conveyed or otherwise dedicated to the
municipality, a municipality agency, the regional or local Board of
Education, a state or county agency or any other public body for recreational
or conservational uses.
PUBLIC VIEW
Visible from a public thoroughfare, public lands or buildings,
public pathways, trails or bicycle paths and navigable waterways.

PUBLICLY ACCESSIBLE EVSE
EVSE that is publicly available (e.g., park and ride, public
parking lots and garages, on-street parking, shopping center parking,
nonreserved parking in multifamily parking lots, etc.).

QUORUM
The majority of the full authorized membership of a municipal
agency.
RECREATION AREA, COMMON
One or more parcels of land or water designed and intended
for the common use or enjoyment of the residents of a residential
subdivision, cluster subdivision, apartment or townhouse complex.
RECREATIONAL VEHICLE (RV)
A vehicular-type portable structure without permanent foundation
that can be towed, hauled, or driven, and not for use as a permanent
dwelling but rather as a temporary living accommodation for recreational,
camping, and travel use, including, but not limited to, travel trailers,
truck campers, camping trailers, self-propelled motor homes, boats,
and boat trailers.

RESIDENTIAL CLUSTER
An area to be developed as a single entity according to a
plan containing residential housing units which have a common or public
open space area as an appurtenance.
RESIDENTIAL DENSITY
The number of dwelling units per gross acre of residential
land area, including streets, easements and open space portions of
a development.
RETAIL SALES
The sale of items on the premises directly to the consumer
and not for resale.
ROAD, PUBLIC
A road which has been accepted and is maintained by the Township
or any federal, state or county road.
SEDIMENTATION
The deposit of soil that has been transported from its site
of origin by water, ice, wind, gravity or other natural means as a
product of erosion.
SIGN
Any device, structure or object for visual communication
that is used for the purpose of bringing the subject thereof to the
attention of others.
SIGN, ADVERTISING
Any sign which is owned or operated by any person, firm or
corporation engaged in the business of outdoor advertising for direct
profit gained from the rental of such signs or any sign advertising
a commodity not sold or produced on the premises.
SIGN AREA
The area defined by the frame or edge of a sign. Where there
is no frame or sign, the area shall be defined by a projected, enclosed,
four-sided (straight sides) geometric shape which closely outlines
the sign. In the case of a freestanding or monument sign, the sign
area shall not include the area of the supporting post or posts unless
they are an integral part of the design.

SIGN, DIRECTIONAL
A sign which directs traffic, indicates parking, prohibits
hunting, fishing or trespassing, designates public conveniences or
displays other directions, warnings, instructions or prohibitions
generally in the public interest.
SIGN, DIRECTORY
A sign limited to the names and locations of multiple occupants
of a premises.
SIGN, FREESTANDING
A nonmovable structure made up of one or more signs, the
structure of which is not affixed to a building, but is standing apart
therefrom.
SIGN, HOME OCCUPATION
A sign publicizing a profession, trade, occupation or similar
business conducted from the residence where the sign is situated.
SIGN IDENTIFICATION
Any sign used to advertise the business conducted on the
premises where the sign is located.
SIGN, INSTITUTIONAL
A sign calling attention to a school, place of worship, hospital
or similar public or semipublic institution.
SIGN, NAMEPLATE
A sign indicating the name or name and address of the occupant
of the premises.

SIGN, SALE OR RENTAL
A sign announcing the availability for sale or rental of
the premises upon which the sign is located.
SIGN, TEMPORARY
A sign promoting an event, a service, a cause, a preference
or an opinion.
SIGN, WALL
A sign affixed or painted on the wall of any building.
SIGN, WINDOW
A sign affixed to or painted on a window, or which is intended
to be viewed through a window.
STANDARDS OF PERFORMANCE
Standards adopted by ordinance pursuant to N.J.S.A. 40:55D-65d
regulating noise levels, glare, earthborne or sonic vibrations, heat,
electronic or atomic radiation, noxious odors, toxic matters, explosive
and inflammable matters, smoke and airborne particles, water discharge,
screening of unsightly objects or conditions and such other similar
matters as may be reasonably required by the Township or required
by applicable federal or state laws or Township ordinances.
STORY
That portion of a building between a floor and ceiling, excluding
cellars. A half story is that portion of a building under a gable,
hip or gambrel roof, the wall plates of which on at least two opposite
exterior walls are not more than two feet above the floor of such
half story.
STREET
Any street, avenue, boulevard, road, parkway, viaduct, drive
or other way which is:
(1)
An existing state, county or municipal roadway;
(2)
Shown upon a plat heretofore approved pursuant
to law;
(3)
Approved by official action as provided in Part

the office of the County Recording Officer prior to the appointment
of a Planning Board and the grant to such Board of the power to review
plats; and includes the land between the street lines, whether improved
or unimproved, and may comprise pavement, shoulders, gutters, curbs,
sidewalks, parking areas and other areas within the street lines.
STREET LINE
The line determining the limit of the street right-of-way
rights of the public, either existing or contemplated. The street
line is a line parallel to, and distant 25 feet from, the center line
of the traveled way where there is no dedicated right-of-way.
STRUCTURE
A combination of materials to form a construction for occupancy,
use or ornamentation, whether installed on, above or below the surface
of a parcel of land.
SUBDIVISION
See definition of "Subdivision" in Part 4, Subdivision of
Land.
TEMPORARY STORAGE CONTAINER
An open or enclosed container that is used for the storage
of refuse, construction equipment or materials, furniture or personal
property that is not permanently attached to the ground and can move
or be transported from place to place.

TOWNHOUSE
A single-family attached dwelling with each unit having two
common or party walls meeting firewall construction standards separating
it from adjacent units on both sides, or one party wall in the case
of a dwelling at the end of a group of attached dwellings. Each dwelling
unit has individual access to the outside, and no dwelling unit is
on top of another.
URGENT CARE CENTER
A use wherein urgent medical care medicine is performed solely
within the confines of a building, which use is principally engaged
in providing immediate walk-in, extended-hour access to acute illness
or injury care by a licensed physician that is beyond customary medical
office hours or availability of a typical primary care medical practice.
Patients shall be served solely on an outpatient basis and no patients
shall be kept overnight on the premises nor treated outside the confines
of a building. Urgent care medicine is as defined by the American
Academy of Urgent Care Medicine.

USE
The specific purpose for which land or a structure is designed,
arranged or intended or for which it is or may be occupied, utilized
or maintained.
VARIANCE
Permission to depart from the literal requirements of a zoning
ordinance pursuant to N.J.S.A. 40:55D-60 and 40:55D-70 of the Municipal
Land Use Law.
VEHICLES, PRIVATE
Private passenger vehicles, private recreational vehicles,
vehicles having no more than two axles and four wheels, and pickup
trucks.
VETERINARY HOSPITAL
A place where animals are given medical or surgical treatment.
Use as a kennel shall be limited to short-term boarding and shall
be incidental to such hospital use.
WIRELESS TELECOMMUNICATIONS TOWER
A vertical structure designed to support wireless telecommunications
antennas, which may be of monopole or self-supported or lattice construction.

YARD
An open space that lies between the principal building or
buildings and the nearest lot line.

YARD, MINIMUM FRONT
An open space extending across the full width of the lot
measured from and parallel to the street right-of-way line, unoccupied
and unobstructed from the ground upward. On corner lots, the minimum
front yard shall be measured from both streets.
YARD, MINIMUM REAR
An open space extending across the full width of the lot
measured from and parallel to the rear lot line, unoccupied and unobstructed
from the ground upward.
YARD, MINIMUM SIDE
An open space measured from and parallel to the side line
of the lot extending from the minimum front yard to the minimum rear
yard, unoccupied and unobstructed from the ground upward.
ZERO LOT LINE HOUSE
A single-family detached dwelling on a separate lot which
is located at the edge of a lot, usually the side, so that the outside
edge of one exterior wall coincides with the property line on that
side.
ZONING PERMIT
A document signed by the Zoning Officer which is required
by ordinance as a condition precedent to the commencement of a use
or the erection, construction, reconstruction, alteration, conversion
or installation of a structure or building and which acknowledges
that such use, structure or building complies with the provisions
of the municipal zoning ordinance or variance therefrom duly authorized
by a municipal agency pursuant to Sections 47 or 57 of the Municipal
Land Use Law, N.J.S.A. 40:55D-60 or 70.
