Editor's Note: This article was adopted and approved 8-17-1961 as part of Ord. No. C-1, which ordinance adopted the prior codification of the Borough of Lititz.
Permission is granted and vested in the Lititz, Manheim and Ephrata Gas Company, its successors and assigns, duly incorporated under the laws of the Commonwealth of Pennsylvania, to lay pipes or conduits under any or all of the public streets, squares, highways or alleys for the purpose of supplying gas to such persons, partnerships and corporations residing therein as may desire same, at a compensation not to exceed $1.50 per thousand cubic feet.
During the process of excavation, said Lititz, Manheim and Ephrata Gas Company, its successors, lessees and assigns shall use all proper precautions at night and during the day to prevent accidents. Said company shall at all times indemnify and save harmless the Borough of and from all and every claim for damages to person and property which may arise from the excavation and laying of its pipes and the subsequent maintenance and operation of same, and before any work is done on the excavation of any streets of the Borough, said Lititz, Manheim and Ephrata Gas Company shall make and execute to the Borough a bond in the penal sum of $5,000 conditioned as above, which bond shall be approved by the Borough Council; that said bond be further conditioned that said gas company keep in good repair the streets, alleys and squares occupied for a period of one year from the time same may have been disturbed by said company, its successors, lessees, assigns or employees.
Said Lititz, Manheim and Ephrata Gas Company shall lay its pipes at such depth as may be designated by the Borough, under the direction and supervision of its Street Committee, consistent with the necessities of the company, and in the excavation of the streets shall replace all excavated materials in the order in which they were removed from the trench; that is to say, in such manner as to leave the hand materials or macadam on top and, in the case of a paved street, to replace same in a manner satisfactory to the Borough, and they shall also ram the ground hard and tight so that the surface of the street shall present a level and unbroken contour, the same as it presented before any excavations were made.
Said Lititz, Manheim and Ephrata Gas Company its successors, lessees and assigns shall at any and all times hereafter furnish and erect as many suitable posts and five-foot-burners with Welsbach mantels as may be required by said Borough Council, to be placed as designated by the borough authorities for the purpose of lighting the borough streets at a cost not to exceed $32 per annum per lamp and maintain same, said lights to be kept burning from sunset to sunrise.
