§ 44-1 Title.

This chapter shall be known and cited as the "Department of Refuse Disposal Law of the Town of Naples."

§ 44-2 Purpose.

The purpose of this chapter is to provide for the creation of a department within the Town of Naples responsible for the operation, management and control of all municipal refuse disposal areas within said town, to provide for the creation of the head of said department and to define the responsibilities of said department head.

§ 44-3 Definitions.

As used in this chapter, the following terms shall have the meanings indicated:
TOWN
That part of the Town of Naples, Ontario County, New York, situate outside the boundaries of any incorporated village situate within the boundaries of the Town of Naples, Ontario County, New York.

§ 44-4 Department of Refuse Disposal.

Upon the effective date of this chapter, there shall be created as a department of the Town of Naples, County of Ontario, the Department of Refuse Disposal, which said Department shall be responsible for the operation, management and control of all municipal refuse disposal for areas within the Town of Naples.

§ 44-5 Refuse Disposal Supervisor.

The head of the Department of Refuse Disposal shall be designated "Refuse Disposal Supervisor," who shall be appointed by the Town Board of the Town of Naples to serve a term concurrent with the contract existing between said town and the Village of Naples concerning the use and operation of refuse disposal areas within the town, and shall be in the unclassified service of the civil service.

§ 44-6 Supervisor responsible to Committee and Board; compensation.

The Refuse Disposal Supervisor shall be directly responsible first to the Refuse Disposal Committee of the Town Board of the Town of Naples and secondly to the Town Board itself. The salary to be paid the Refuse Disposal Supervisor shall be set by the Town Board at the time of appointment for said position.

§ 44-7 Supervisor's powers and duties.

The Refuse Disposal Supervisor shall have the following powers and duties:
A. 
Be in charge of all refuse disposal sites used by the Town of Naples.
B. 
Supervise dumping during the hours said refuse disposal sites are open.
C. 
Cover the refuse after each day's operation, pursuant to the standards and regulations of the New York State Department of Environmental Conservation or any other lawful agency or subdivision of the State of New York having jurisdiction thereof.
D. 
Stake out, map and oversee the digging of new trenches according to present layout plans.
E. 
Assist in obtaining from interested persons bids for digging trenches and report said findings to the Town Board for approval.
F. 
Remove scrap metal piles and tires from refuse disposal areas, and dispose of same.
G. 
Provide dumping areas for brush and wood at said refuse disposal sites.
H. 
Attend all Town Board meetings pertaining to refuse disposal matters when requested to do so.
I. 
Notify the Superintendent of Highways of the Town of Naples concerning the need for building and repairing roads on refuse disposal sites.
J. 
Maintain and operate the bulldozer and other equipment necessary to carry out the operations at the refuse disposal sites.
K. 
Obtain the approval of the Town Board prior to subletting any portion of the above duties and responsibilities, including any assistance needed for vacation or sickness periods.
L. 
Perform such other and further duties as the Town Board from time to time may deem necessary for the proper operation and maintenance of refuse disposal sites.
