This chapter shall be known and nay be cited as "Township of Adams Abandoned and Junked Automobile Ordinance."
The following words and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except in those instances where the context clearly indicates a different meaning:
CALENDAR DAY
A period of 24 hours measured from 12:00 midnight to 12:00 midnight of any calendar day.
JUNKED AUTOMOBILE
Any automobile outside of a fully enclosed building not in full and complete working order and without current registration plates, or any automobile stored for resale as junk metal, or any automobile outside of a fully enclosed building stored for selling parts therefrom.
PERSON
Every natural person, association or corporation. Whenever used in any section prescribing or imposing a fine, or penalty of imprisonment in default thereof, the term as applied to associations shall mean any member thereof, and as applied to corporations shall mean the president or secretary thereof.
It shall be unlawful for any person to store, after the effective date of this chapter, any abandoned or junked automobile on private or public property within the geographical boundaries of the Township of Adams, Butler County, Pennsylvania, for any portion of a calendar day. The storage of any automobile as hereinabove prohibited in this section for more than one calendar day shall constitute a separate and distinct unlawful act for any portion of each calendar day.
Any person upon summary conviction before a District Justice of violating any of the provisions of § 178-3 of this chapter shall, for the first offense, be sentenced to pay a fine of not less than $10 nor more than $50, and for each and every subsequent offense shall be sentenced to pay a fine of not less than $25 nor more than $300, and in default thereof for a first or subsequent offense shall undergo imprisonment for not less than five days nor more than 30 days.
All prosecutions shall be brought in the name of "Adams Township" before any District Justice and shall be commenced by information and warrant and shall be directed to and be served by a Constable. Warrants shall be returnable forthwith, and upon such return like proceedings shall be had, as in the case of summary conviction.
It is further provided that it shall be unlawful for any person presently operating an abandoned or junked automobile business to burn the aforesaid junked automobiles or any part thereof on any day except the last three days of the week, namely, Thursday, Friday and Saturday, between the hours of 9:00 a.m. and 6:00 p.m., and it is further provided that the aforesaid abandoned and junked automobiles cannot be burned, and it shall be unlawful to burn the same in a pile greater than 15 feet in height. It is further provided that it shall be unlawful for the aforesaid burning to be done less than 50 feet from the boundary lines of the property. It is further provided that the same penalties as set forth in § 178-4 of this chapter shall be applicable to the burning of junked automobiles.
