This Charter and all amendments hereto shall constitute the form of government for the City of Lackawanna and shall be known and cited as the "Lackawanna City Charter."
The inhabitants of the City of Lackawanna, in the County of Erie, State of New York, within the corporate limits hereinafter described or as may be hereafter established, shall continue to be a body politic and corporate with perpetual succession, under the name of the City of Lackawanna.
For the purposes of the Charter, except as the context may otherwise require:
CHARTER
The Lackawanna City Charter.
CITY
The City of Lackawanna.
COUNCIL
The local legislative body of the City constituted and elected pursuant to Chapter 3 of this Charter.
DEPARTMENT
An organizational unit of the City government established or designated by or pursuant to this Charter as a department, and any agency or instrumentality of the City government not allocated or assigned within such an organizational unit.
LAW
A state statute, charter, local law, ordinance, or resolution.
LOCAL LAW
A law adopted pursuant to the Municipal Home Rule Law or to other authorization of a state statute or this Charter by the Council, or proposed by a Charter Commission or by petition, and ratified by a popular vote, as provided in Article 4 of the Municipal Home Rule Law or as provided in a state statute, this Charter or local law; but shall not mean or include an ordinance, resolution or other similar act of the Council or of any other board or body of this City.
ORDINANCE
A legislative act of the Council which is permanent in nature, unless specifically self-limiting, general in its application and may or may not contain penal provisions for its violation and must be in written form. It shall be enacted in accordance with the provisions hereinafter provided.
RESOLUTION
A legislative act of the Council which is limited in its application or of a temporary nature, or both, and shall include, as used in this Charter, all orders, rules, motions, and all other legislative acts except local laws and ordinances. Unless specifically provided, it need not be in writing.
For the purposes of this Charter, except as the context may otherwise require:
A. 
The present tense includes the past and future tenses and the future, the present.
B. 
The masculine gender includes the feminine and neuter.
C. 
The singular number includes the plural, and the plural the singular.
D. 
"Shall" is mandatory and "may" is permissive.
The corporate boundaries of the City of Lackawanna shall be as follows:
Beginning at the point of intersection of the south boundary line of the City of Buffalo with the east boundary line of Lake Erie, at low water mark, thence east along the south boundary line of the City of Buffalo to the west line of South Park Botanical Gardens; thence southeast to the north line of Ridge Road; thence east to the west line of Memorial Field; thence north to the south line of South Park Botanical Gardens; thence east along the south line of South Park Botanical Gardens and Nason Parkway to the center line of South Park Avenue; thence north, to the southwest right-of-way of the Baltimore and Ohio Railroad; thence northwest to the south City line of the City of Buffalo; thence east to a point one thousand feet east of the center line of Abbott Road; thence southeast along a line parallel with said center line of Abbott Road to the southern line of Ridge Road; thence east to the western right-of-way of the Lehigh Valley Railroad; thence south to the center line of Fernald Avenue; thence west to a point one thousand feet east of the center line of Abbott Road; thence southeast along a line parallel with said center line of Abbott Road to the north boundary line of the Town of Orchard Park; thence west along said boundary line and its continuation as the north boundary of the Town of Hamburg to the east line of Lake Erie, at low water mark; thence north along the east line of Lake Erie, at low water mark, to the point of beginning.

The City shall be divided into four wards, the boundaries of which shall be as follows:
Ward I: Commencing at a point in the south line of the City of Lackawanna at its intersection with the Norfolk and Western Railway; thence westerly along the south line of the City of Lackawanna to the southwest corner of the City of Lackawanna; thence northerly along the west line of the City of Lackawanna to the north line of the City of Lackawanna at its boundary with the City of Buffalo; thence easterly and southeasterly along the northerly boundary line of the City of Lackawanna to Ridge Road; thence southeasterly along said road to the center line of Center Street; thence southerly to the center line of Kirby Avenue; thence westerly to the center line of Warsaw Street; thence southeasterly to its intersection with the north branch of Smokes Creek; thence northwesterly along said creek to the Norfolk and Western Railway; thence southeasterly along said railway to the south line of the City of Lackawanna being the point of beginning.
Ward II: Commencing at a point in the south line of the City of Lackawanna at its intersection with the center line of South Park Avenue; thence northerly to the center line of Newman Street; thence westerly to the center line of Colton Avenue; thence northerly to the center line of Ridge Road; thence easterly to the center line of South Park Avenue; thence northerly along the center line of South Park Avenue to its intersection with the boundary line of the City of Lackawanna and the City of Buffalo; thence westerly, southerly, westerly and southerly along said boundary line to Ridge Road; thence southeasterly along said road to the center line of Center Street; thence southerly to the center line of Kirby Avenue; thence westerly to the center line of Warsaw Street; thence southeasterly to its intersection with the north branch of Smokes Creek; thence northwesterly along said creek to the Norfolk and Western Railway; thence southeasterly along said railway to the south line of the City of Lackawanna; thence easterly along said south line of the City of Lackawanna to the center line of South Park Avenue, being the point of beginning.
Ward III: Commencing at a point in the east line of the City of Lackawanna at its intersection with the center line of Wiesner Road; thence westerly to the center line of Abbott Road; thence northerly to the center line of West Elmview Avenue; thence meandering westerly along said center line of West Elmview Avenue to the center line of South Shore Boulevard; thence northerly to its intersection with the north branch of Smokes Creek; thence westerly along said creek to the center line of South Park Avenue; thence southerly to the center line of Newman Street; thence westerly to the center line of Colton Avenue; thence northerly to the center line of Ridge Road; thence easterly to the center line of South Park Avenue; thence northerly along the center line of South Park Avenue to its intersection with the boundary line of the City of Lackawanna and City of Buffalo; thence northerly, northwesterly and westerly along the boundary line of the City of Lackawanna and the City of Buffalo to a northeast corner of the City of Lackawanna; thence southeasterly, easterly, southerly, westerly and southeasterly along the east line of the City of Lackawanna to its intersection with the center line of Wiesner Road being the point of beginning.
Ward IV: Commencing at a point in the east line of the City of Lackawanna at its intersection with the center line of Wiesner Road; thence westerly to the center line of Abbott Road; thence northerly to the center line of West Elmview Avenue; thence meandering westerly along said center line of West Elmview Avenue to the center line of South Shore Boulevard; thence northerly at its intersection with the north branch of Smokes Creek; thence westerly along said creek to the center line of South Park Avenue; thence southerly to the south line of the City of Lackawanna; thence easterly along the south line of the City of Lackawanna to the southeast corner of the City of Lackawanna at its boundary with the towns of Orchard Park and West Seneca; thence northwesterly along the east line of the City of Lackawanna to the center line of Wiesner Road being the point of beginning.
