There shall be a Department of Public Safety,
the head of which shall be the Director of Public Safety. Prior to
his or her appointment the Director shall be qualified by training
and experience as a Chief of Police, a Fire Chief, or the equivalent
thereof.
Within the Department of Public Safety there
shall be a Division of Police, the head of which shall be the Chief
of Police. The Division shall be organized according to such table
of organization as shall be prescribed by the Chief of Police with
the approval of the Mayor. The Division under the direction and supervision
of the Director shall:
A. Preserve the public peace, prevent crime, detect and
arrest offenders against the penal laws and ordinances effective within
the City;
B. Administer and enforce laws and ordinances to regulate,
direct, control and restrict the movement of vehicular and pedestrian
traffic, and the use of the streets by vehicles and persons generally;
C. Remove all nuisances in the public streets, parks
and other public places, inspect and observe all places of public
amusement or assemblage and all places of business requiring any state
or municipal license or permit and report thereon to the appropriate
department;
D. Operate a training program to maintain and improve
the efficiency of the members of the Division.
The Division of Police shall consist of such
officers and employees as have been heretofore or may hereafter be
authorized.
Under the supervision of the Director of Public
Safety, the Chief of Police shall promulgate, and from time to time
revise and enforce, a manual of police discipline, practices and procedures
for the better administration of the work of the Division, and for
the discipline and efficiency of the Division of Police.
Within the Department of Public Safety there
shall be a Division of Fire, the head of which shall be the Fire Chief.
The Division shall be organized according to such table of organization
as shall be prescribed by the Fire Chief with the approval of the
Mayor. The Division under the direction and supervision of the Director
of Public Safety shall:
A. Have exclusive jurisdiction over the control, fighting
and extinguishing of any conflagration which occurs within the City
limits;
B. Provide fire fighting services and facilities for
the protection of life and property within the City, and in accordance
with such mutual aid agreements as may be enforced;
C. Operate, repair and maintain a fire alarm signal system;
D. Investigate the cause, circumstances and origin of
fires and report to the District Attorney every case of suspicion
of arson;
E. Maintain and administer a fire prevention and fire
safety inspection service for the City.
The Fire Division shall consist of such officers
and employees as have been heretofore authorized or may hereafter
be authorized.
Under the supervision of the Director of Public
Safety the Fire Chief shall make, administer and enforce rules and
regulations for the control, disposition and discipline of the Division
and its officers and employees, for their training and efficiency,
and for the use and care of equipment and apparatus.
Within the Department of Public Safety there
shall be a Bureau of Communications, the head of which shall be the
Supervisor. The Bureau shall:
A. Operate, maintain and repair the police and fire signal
and communications system, subject to approval of the respective division
heads;
B. Have such other functions, powers and duties as may
be allocated and assigned to it by the Director of Public Safety.
Within the Department of Public Safety, there
shall be a Bureau of Weights and Measures, the head of which shall
be the Director of Weights and Measures, which shall have such functions,
powers and duties as may be prescribed by law.
Within the Department of Public Safety, there
shall be a Dog Control Officer, who shall have such functions, powers
and duties as may be prescribed by law.
The Office of Disaster Preparedness as heretofore
established, constituted and empowered pursuant to law is continued
within the Department of Public Safety.
