Duty to provide clear path.
Every owner or occupant of any building or lot of land fronting or abutting any sidewalk along any street or alley is hereby required to remove or cause to be removed all snow, ice, hail and sleet thereon fallen or formed to provide a clear path for a width of 36 inches, within 24 hours after the same shall have ceased to fall or form.
In the event snow and/or ice on a sidewalk has become so hard that it cannot be removed without likelihood of damage to the sidewalk, the person(s) charged with its removal shall place enough sand, salt or other abrasive on the sidewalk to make travel reasonably safe; and as soon thereafter as weather permits, clear a path in said sidewalk of 36 inches in width.
It shall be unlawful for any person to throw, shovel, cast or otherwise move, place, pile, deposit or dump snow or ice removed from sidewalks, driveways or other areas into the streets, alleys, or public highway or for any person, when the cartway of the street, alley or highway shall be cleared or partially cleared, to throw or place any snow or any other accumulation in the cleared cartway or passageway area.
If a fire hydrant is on or along any property, no person shall deposit or cause to be deposited any snow or ice next to or on the fire hydrant. Any accumulated snow or ice must be removed from around the fire hydrant for a distance of 12 inches and be visible from the street.
Any person, firm or corporation owning or occupying a lot or lots who shall neglect to remove such snow, hail, sleet or ice from the pavements adjoining his or her lot or lots as set forth in § 92-1 hereof within the time limitations therein set forth shall, upon conviction thereof, be subject to a fine of not more than $1,000 at the discretion of the court. Each day that a violation continues shall constitute a separate offense.
In addition, in the case of neglect or refusal of any owner or occupant or tenant to comply with the requirements set forth in § 92-1, such snow or ice may be removed by any officer or employee of the Borough designated for the purpose, and the cost of such removal, with an additional penalty of 10%, shall be collected from the defaulting owner, occupant or tenant in a manner that debts incurred for curbing and paving by the Borough are now recoverable, including the right to prepare and file a municipal lien.
