As used in this chapter, the following terms
shall have the meanings indicated, unless a different meaning appears
clearly from the context:
GARBAGE
All animal and vegetable waste resulting from the handling,
preparation, cooking or consumption of foods, refuse, all solid wastes,
except human body waste, including garbage, ashes, and rubbish.
PARK HOURS
All parks should be opened daily to the public beginning
at sunrise and ending at sunset, unless special permission is granted
by the Borough Council and except for the pavilion rentals at Memorial
Park and except for special events organized by the Borough of Jim
Thorpe.
PARK or PARKS
Unless specifically limited, shall be deemed to include all
parks, playgrounds, recreation areas, structures and facilities and
also entrances and approaches thereto, and all other land or property
of structures under the jurisdiction of Jim Thorpe Borough and now
or hereinafter owned or acquired by Jim Thorpe Borough for park or
recreational purposes, specifically including, but not limited to,
Memorial Park grounds, specifically excluding the interior of the
Memorial Hall. Memorial Hall is rented and/or leased to persons and
specific lease terms apply to such rentals.
PERSON
Any natural person, corporation, organization of persons,
company, association or partnership.
RUBBISH
Glass, metal, paper, plant, both wood or nonputrescible solid
waste.
No person in attendance at a park shall:
A. Injure, deface, remove, cut or damage any of the trees,
plants, shrubs, turf, buildings, structures, signs or fixtures, or
any other property of the Borough located within the park.
B. Litter any area of the park with garbage, paper, bottles,
cans or other waste materials, nor dispose of the same in any way
except in receptacles designated for such purpose.
C. Kindle or maintain any fire in the park except in
fireplaces where areas are specially designated for that purpose or
located by authority of the Borough Council.
D. Remove any bench, seat, table or other apparatus without
permission of Borough Council.
E. Being on or make the use of a skateboard.
F. Enter the premises other than during permitted park
hours.
G. Bring on to the premises any garbage, refuse, or rubbish.
H. Dispose of any garbage, refuse or rubbish on the premises
other than such garbage refuse or rubbish which had been created during
the course of the stay on the premises. Garbage which has been created
while on the premises shall be disposed of in proper receptacles.
If no receptacles are available, such rubbish shall be removed from
the premises and disposed of according to law.
I. Parking any vehicle, including cars, trucks, boats,
trailers, etc. in any area other than a designated parking area within
the park.
J. No person owning, possessing, keeping or in charge
of any dog, horse or other animal shall cause, suffer or allow such
dog, horse or other animal to soil, defecate or commit any nuisance
on or within any of the park areas.
K. No dog, whether licensed or unlicensed, muzzled or
not muzzled, shall be allowed to run at large in any of the park areas.
Any such dog that is brought to the park area must be under the immediate
custody and control of the owner or custodian of the dog by a chain
or leash not exceeding eight feet in length affixed to the collar
or harness of the dog. Any person in possession of a dog at a park
must clean up and remove any dog waste from such animal.
L. Engage in fighting or threatening or in violent or
tumultuous behavior; make unreasonable noise; create a hazardous or
physically offensive condition by any act, which serves no legitimate
purpose of the actor.

The use of the pavilions, block building and gazebo shall be
coordinated through such persons designated by Borough Council. Reservations
can be made by persons for the pavilion, block building and gazebo
by contacting that designated person.
Recreational facilities which become hazardous
for public use due to weather, water, fire or unforeseeable conditions
may be closed only at the discretion of the Borough Council.
The police officers of Jim Thorpe Borough are
charged with enforcement of the provisions of this chapter.
Any person, firm or corporation who violates
any provision of this chapter shall, upon conviction thereof, be sentenced
to pay a fine of not less than $100 nor more than $600 and in default
of payment to imprisonment for a term not to exceed 30 days.
