As used in this chapter:
EXCAVATOR
A licensed plumber, contractor or subcontractor who must
engage in excavation on private property in order to make a sewer
connection or perform plumbing work in the Township.
PERSON
And include person, persons, partnership, firm, association
or corporation.

No person shall excavate on private property for the purpose
of making a sewer connection or performing plumbing work without having
first ascertained in the applicable manner prescribed herein whether
any pipe distributing or transmitting manufactured, mixed or natural
gas is located within the area to be excavated.

Except as provided in subsection BH:8-2.3 hereof, the person
responsible for the excavation shall serve a written notice of intention
on the person engaged in the distribution or transmission of manufactured,
mixed or natural gas in the area at least three full working days
(excluding Saturdays, Sundays and holidays) prior to commencement
of any excavation. The written notice of intention shall be served
personally or by registered or certified mail, return receipt requested,
on the person so engaged in the transmission of or distribution of
the aforesaid gases and shall contain the name of the person responsible
and the date, place, and type of excavation to be conducted.

In the event of an emergency involving danger to life, health
or property, it shall be lawful to excavate if such notice, in writing
or otherwise, is given as soon as reasonably possible.

Any such excavation shall be performed in such manner as to
avoid damage to any pipe distributing or transmitting manufactured,
mixed or natural gas. In the event that damage does occur, the person
distributing or transmitting manufactured, mixed or natural gas in
the area shall be notified immediately.

No person shall be issued a sewer connection permit for a sewer
connection or a plumbing permit for plumbing work requiring excavation
without first having submitted written proof or prior notice of intent
to excavate as required herein. Such written proof shall be filed
with the Plumbing Subcode Official and attached to the filed sewer
connection permit or plumbing permit subsequently issued.

Any person who fails to give notice as required by this section
shall be in violation thereof and shall, upon conviction, be subject
to the penalty established in Section BH: 1-3 of this Code.

No excavator shall commence excavation on private property for
the purpose of making a sewer connection or performing plumbing work
requiring excavation without first having submitted to the Plumbing
Subcode Official evidence of insurance of the type described herein.

The insurance required under this section shall be a mine-type
multiple-liability insurance with minimum limits of $100,000 per person
and $300,000 per accident for personal injury and $300,000 for property
damage, and shall include an endorsement insuring against damage resulting
from excavation, collapse or underground damage.

herein. The written proof required herein shall include the following
information: name of the insurance company, the policy number, limits
of coverage, endorsements required herein, and the name, address and
phone number of the agent or insurance representative who obtained
the policy for the excavator insured. Such written proof shall be
filed with the Plumbing Subcode Official and attached to the filed
sewer connection permit or plumbing permit subsequently issued.
