Pursuant to Section II of the Uniform Fire Safety Act (P.L. 1983, c. 383[1]) the New Jersey Uniform Fire Code shall be locally enforced in the Borough of Woodcliff Lake.

The local enforcing agency shall be the Bureau of Fire Prevention.

The local enforcement agency shall enforce the Uniform Fire Safety Act and the codes and regulations adopted under it as well as the codes contained within the most recent edition of the International Property Maintenance Code in all buildings against owners and tenants therein (including tenancies created by the rental of the areas, rooms or space within the buildings, structures and premises) within the established boundaries of the Borough of Woodcliff Lake and shall faithfully comply with the requirements of the Uniform Fire Safety Act, the Uniform Fire Code and the most recent edition of the International Property Maintenance Code.
The local enforcing agency established by § 178-10 of this article shall carry out the periodic inspections of life hazard uses required by the Uniform Fire Code on behalf of the Commissioner of Community Affairs.

The local enforcing agency established by § 178-10 of this article will be under the direct supervision and control of the Fire Official reporting to the Mayor and Council.
A. 
The local enforcing agency shall be under the direct supervision of the Fire Official who shall be appointed by the Mayor with confirmation of the Council.

B. 
The Fire Official shall serve for a term of one year. Any vacancy shall be filled for the unexpired term.
C. 
Such inspectors and other employees as may be necessary in the local enforcing agency shall be appointed by the Mayor with confirmation of the Council.

D. 
Inspectors and other employees of the enforcing agency shall be subject to removal by the Mayor and Council for inefficiency or misconduct. Each inspector or employee to be so removed shall be afforded an opportunity to be heard by the appointing authority or a designated hearing officer.
Pursuant to Sections 15 and 17 of the Uniform Fire Safety Act,[1] any person aggrieved by any order of the local enforcement agency shall have the right to appeal to the Construction Board of Appeals of the County of Bergen.

The application fees for a permit shall be as set forth in Chapter 163, Fees.

B. 
Registration fees.
(1) 
The registration of all buildings, tenants and occupancies, other than owner-occupied one- and two-family residences, shall be made annually and upon change of use/tenant or owner or occupancy with fees as set forth in Chapter 163, Fees.[2]

(2) 
Any building, tenant or occupancy that is registered with the State of New Jersey as a life hazard use (LHU) may subtract from the total square footage that portion of the use that is occupied by the LHU in calculating the fee.
C. 
The aforementioned fees will be paid on or before March 31 on each year.[3]

D. 
Reinspection fees. There shall be no charge for the first reinspection after a violation notice or other warning is given where the reinspection is limited to a verification that the previously cited violation has been abated. For any additional reinspection because the violation has not been abated thereafter, a fee, as set forth in Chapter 163, Fees, shall be charged in addition to penalties, if any.[4]

E. 
New tenants/change in use. In the event that a new registration is required as a result of a new owner occupancy, tenancy or use to the premises, a reduction in the required fee shall be given in the amount of 50% of such fee in the event the new ownership, occupancy, tenancy or use of the premises occurs after June 30 of each year.
F. 
Multitenant buildings. On multitenant buildings, the owner must register common areas and tenants their leased space.
G. 
Volunteer firefighter credit. Active or exempt members of the Woodcliff Lake Volunteer Fire Department shall receive a credit of $60 against the above fees.
H. 
Sprinklered buildings. If an existing commercial building becomes 100% sprinklered, a ten-percent reduction will be applied to the above fees going forth.
I. 
Owners to report tenants' square footage. Building owners must annually by March 1, provide a list of tenants' names, addresses and phone numbers along with the amount of square footage leased.[5]

A. 
Enforcement of this article shall be pursuant to the New Jersey Uniform Fire Code and in particular N.J.A.C. 5:70-2.10, and violations shall be subject to the penalties set forth in N.J.A.C. 5:70-2.11 and the dedicated penalties set forth in N.J.A.C. 5:70-2.12A.

B. 
Pursuant to Sections 15 and 17 of the Uniform Fire Safety Act, any person aggrieved by any order of the local enforcement agency shall have the right to appeal to the Construction Board of Appeals of the County of Bergen.
C. 
For violation of any portion of this article which is not subject to enforcement under the Uniform Fire Code, any person or corporation or business entity violating any provisions or terms of this article shall, upon conviction, be subject to a fine of not more than $500 or imprisonment in the county jail for not more than 90 days, or both, in the discretion of the court.
