There shall be the position of Business Administrator, appointed by the Mayor with the advice and consent of the Common Council. At the time of his/her appointment, the Administrator need not be a resident of the City, but during his/her tenure of office the Administrator may reside outside of the City only with the approval of the Common Council.

A. 
The Business Administrator shall serve for the term of office of the Mayor and until the appointment of a successor.
B. 
The Mayor, in his/her discretion, may remove the Business Administrator after notice and an opportunity to be heard. Prior to removal, the Mayor shall first file written notice of his/her intention with the Common Council, and such removal shall become effective on the 20th day after the filing of such notice, unless the Common Council, prior thereto, shall have adopted a resolution by a two-thirds vote of the whole number of Council disapproving the removal.
C. 
The Common Council may remove the Business Administrator for cause by at least a two-thirds vote of the whole number of Council, upon notice and the opportunity to be heard in public or executive session. The Business Administrator shall be entitled to three-months' written notice of removal. In the event that it is determined by the Mayor that the removal shall be immediate, then the Administrator shall be paid the remaining unpaid balance of his/her earned salary plus the Business Administrator's salary for a maximum of the next three calendar months following the effect date of the removal, unless the removal is for good cause as such term is defined in N.J.S.A. 40:69A-43(c).
Under the direction and supervision of the Mayor, the Business Administrator shall:
A. 
Supervise the administration of all departments, divisions, offices and agencies of the City government, including approval of all appointments, removals and disciplinary actions by department directors, except the Municipal Clerk and staff;
B. 
Prescribe and enforce rules for efficient management and operation of the City government;
C. 
Direct the preparation and administration of the annual operating and capital budgets and maintain a continuing review and analysis of budget operation work programs and costs;
D. 
Administer a centralized purchasing system and receive approval from the Common Council for any purchase exceeding $25,000;[1]

E. 
Be responsible for the development and administration of sound personnel system;
F. 
Assign and transfer employees temporarily from one department to another, as efficient administration may require;
G. 
Attend all meetings of the Common Council and present a weekly report on the operations of the City;
H. 
Establish procedures and policies for the coordination, compiling, editing and prompt dissemination and release of public information;
I. 
Perform such other duties as the Common Council may prescribe;
J. 
Serve as the Director of the Department of Administration. The Business Administrator may also serve as head of any other department or division with or without additional compensation.
