The Town Board of the Town of Schaghticoke is hereby authorized to compensate the Town Attorney a fixed amount for the performance of the certain specified services performed as Town Attorney and also for additional services performed in excess thereof, with such additional compensation to be computed at an hourly rate which shall be determined from time to time by the Town Board.
The additional legal services to be performed by the Town Attorney shall be properly documented specifying the amount of time spent, and payment to the Town Attorney for the additional services is to be made pursuant to the payroll method.
This Article is intended to supersede § 27 of the Town Law regarding salaries.

The Town Attorney of the Town of Schaghticoke and any Deputy Town Attorney at the time of his/her appointment and at any time throughout his/her term of office need not be an elector of the Town of Schaghticoke as long as he/she is a resident of or maintains an office for the practice of law in any one of the following counties located in the State of New York: Rensselaer, Saratoga, Washington, Albany, Columbia or Schenectady.

The Town Board, in addition to any other powers that it has with respect to the employment of attorneys, shall have the authority to appoint one or more Deputy Town Attorneys, as it shall from time to time deem necessary or appropriate.
