The purpose of this article is to establish a procedure for selection of a Tribal Judge pursuant to Article V of the Menominee Constitution and Bylaws.
As used in this article, the following terms
shall have the meanings indicated:
The person elected as the presiding officer of the Tribal
Legislature.

The person appointed to the office of Tribal Judge by a majority of no fewer than six votes of the Tribal Legislature for a term of years set forth in Article V, Section 2(c) and (d) of the Menominee Constitution and Bylaws.
The governing body of the Menominee Tribe elected/appointed
pursuant to the Menominee Constitution and Bylaws.

To hold the office of Tribal Judge, a person shall meet the eligibility requirements of Article V, Section 4(a) of the Menominee Constitution and Bylaws.
A.
Sixty days prior to the end of any Tribal Judge's
term, the Chairperson shall cause to have posted for a thirty-day
period notification that the position of Tribal Judge is open for
application by tribal members.
B.
In the event of a vacancy on the Tribal Court prior
to the end of any Judge's term, the posting period shall be at the
discretion of the Tribal Legislature.
C.
Applications for the position shall be in writing
and shall be accompanied by proof of education requirements.
D.
The Chairperson's office shall schedule applicants
for appropriate written examinations as required by the Constitution.
E.
The Tribal Legislature shall schedule the date and
time for interviews of all applicants.
F.
The Tribal Legislature shall place the highest priority
on appointment of a Tribal Judge, and in no event shall selection
take more than one regular or special meeting.
G.
The Tribal Chairperson shall swear in the Tribal Judge
appointed under this article as soon as practicable.
H.
The Tribal Legislature shall, by motion, name the
appointed Tribal Judge and shall expressly state the term of office
for such appointment.
