Tag sales and sales of similar nature within the Town of Great Barrington will be allowed by permit from the Board of Selectmen twice a year, two days each, within the calendar year, at any location.

A. 
Definitions. As used in this section, the following terms shall have the meanings indicated:
FLEA MARKET
A place, whether indoors or outdoors, where one or more merchants buy, sell or barter merchandise on property for a consideration paid to the owner or operator of the property for temporary or seasonal use.
OWNER/OPERATOR
The individual, corporation or business entity in control of the flea market property.
VENDOR
An individual or merchant displaying wares for sale within a flea market.
B. 
Owners/operators of flea markets shall hold an annual license issued by the Selectmen and shall be required to comply with all applicable sections of the Great Barrington Code, especially but not limited to all sign bylaws. The fee for such license shall be set by the Selectmen.
C. 
The Board of Selectmen may refuse to issue a license to an owner/operator or may revoke such license if it finds by majority vote, after a public hearing, that the owner/operator or any vendor has failed to comply with any provision of this chapter or any other section of the Great Barrington Code. Any public hearing held under this chapter shall be advertised in a newspaper of general circulation in Great Barrington once each in two successive weeks, the first publication to be not less than 14 days before the date of the hearing, and notice thereof shall be given to the owner/operator not less than 14 days before the date of the hearing.
