This article shall be known as the "Quinton Township Recycling and Waste Ordinance."
For the purpose of this article, the following words and phrases shall have the meanings respectively ascribed to them by this section and in N.J.S.A. 13:1E-99.12 and in the Salem County Recycling Plan.
ALUMINUM
All products made of aluminum, including aluminum cans, foil, wrappers, containers for prepared dinners or other foods, screen frames and lawn chairs.
BULK MATERIALS AND WHITE GOODS
All items which are not generated on a daily or weekly basis from domestic residential activity and which cannot or do not fit a regular trash container or recycling container because of size, dimension, or proportions such as, but not limited to: large, heavy or unwieldy solid waste materials which, if listed as designated recyclable materials, cannot be commingled and are not subject to single-stream recycling as defined herein.

A. 
Bulk materials include, but are not limited to, items such as textiles, furniture, rugs, mattresses, box springs, bed frames, televisions, clothes washers/dryers and dishwashers, hot water tank, doors, furnace, air conditioner, bath vanity, toilet, sink, bath tub, mirror, couch/recliner, tables, chairs, windows, carpet, wooden cabinets, wooden doors, glass doors, patio doors, microwave, barbeque grills, railings, bicycles, lawn chairs, wooden playground equipment, and machinery.
B. 
White goods include, but are not limited to, refrigerators/freezers, washers/dryers, metal doors, microwaves, metal cabinets, air conditioners, bicycles, exercise equipment, lawn mowers, metal furniture, barbeque grills, and metal playground equipment.
DEBRIS
Stones, dirt, demolition material, broken concrete and other like material, brush, branches, small trees and bushes.
GARBAGE
Putrescible animal, fish, fowl, fruit or vegetable waste incident to and resulting from the use, preparation, cooking and consumption of food.
GLASS
All products made from silica or sand, soda ash and limestone, the product being transparent or translucent and being used for packaging or bottling or various matter and all other material commonly known as "glass"; excluding, however, blue and flat glass and glass commonly known as "window glass."
METAL
All products made of metal, exclusive of aluminum, including washers, dryers, refrigerators, stoves, hot water heaters, tire rims, springs, bicycles, bimetal cans (tin cans) or scrap metal.
TRASH
Ashes, plastic material, ceramics, blue and flat glass, nonputrescible solid waste, building materials, contaminated paper and other similar materials.
There is hereby established a program for the mandatory separation of recyclable material within the Township of Quinton.
A. 
Primary recyclables. The occupant or owner of any residential, commercial or institutional building or use within the Township of Quinton, unless exempted, shall place for disposal, removal or collection the following named primary recyclable materials in strict conformity with the following regulations:
(1) 
Glass shall be contained in reusable metal or plastic occupant- or owner-supplied containers, separated into one container for clear glass and one for brown glass and one for green glass, with lids, metal rings and plastic covers removed.
(2) 
Aluminum shall be contained in a reusable metal or plastic occupant- or owner-supplied container.
(3) 
Newspapers shall be tied into bundles not to exceed 50 pounds and shall be kept dry.
(4) 
High-grade office paper shall be tied into bundles not to exceed 50 pounds and shall be kept dry.
(5) 
Corrugated and other cardboard and brown paper bags shall be stacked and secured from wind, tied into bundles and kept dry.
(6) 
Magazines shall be tied into bundles not to exceed 50 pounds and shall be kept dry.
(7) 
Certain HDPE and PET plastic containers, as designated by the Township Recycling Coordinator, shall be placed for collection in the manner described by him.
B. 
Secondary recyclables. The occupant or owner of any residential, commercial or institutional building or use within the Township of Quinton, unless exempted, shall place for disposal, removal or collection in the manner specified such other materials as may be identified by the Recycling Coordinator when a convenient and economically feasible market exists and this article is amended accordingly.
A. 
It is prohibited to place leaves and grass clippings for collection or disposal as solid waste. All persons occupying residential premises within the Township shall mulch or compost the leaves and grass clippings generated at those premises, or take them to the Convenience Center located on Burden Hill Road.
B. 
Residential leaf generators are prohibited from causing or permitting nonorganic materials, paper, plastic, metal, wood, or other materials from becoming mixed in with leaves.
C. 
Residential leaf generators are prohibited from mixing in leaves with municipal solid waste for disposal of solid waste.
D. 
Haulers are prohibited from collecting solid waste in which leaves have been mixed.
E. 
Notice of these leaf requirements shall be given to residential leaf generators by a method prescribed by N.J.S.A. 13:1E-99.16.
The Recycling Coordinator or such other person as designated by the Township Committee shall be charged with the responsibility for enforcing this article, including the issuance of warnings for violations and signing complaints against violators in the appropriate court. No complaint shall be filed in any court against a waste hauler or recyclable collector in violation of this article unless the person charged with the enforcement of this article shall first have given written warning, 10 days in advance, to the person charged that such action would or might be forthcoming. Such notice may be served by personal delivery or by ordinary or certified mail to the addressee's last known address.
Persons occupying commercial or institutional premises may be exempted by the Township from the source-separation requirements of some or all of the provisions of this article, but only under the conditions set forth herein:
A. 
Eligibility for exemption. In order for a person occupying commercial or institutional premises to be granted exemption from one or more of the source-separation requirements of the Municipal Recycling Plan, two conditions must exist:
(1) 
The person must have otherwise provided for the recyclable materials designated in the plan from which the exemption is sought; and
(2) 
The person shall be required to annually provide verifiable written documentation (reports) to the municipality of the total number of tons recycled prior to the request for exemption, and thereafter for each year in which any such exemption is operable.
B. 
Term of exemption. No such exemption, if granted, shall endure for a period in excess of 12 months without review and extension based upon continued compliance within Subsection A above. Any exemption shall terminate automatically and without notice whenever the exempted person fails to comply with Subsection A(1).
The collection, removal and disposal of waste paper products, glass, aluminum, trash, debris and large objects from noninstitutional residential buildings within the Township shall be supervised by the official designated by the Township Committee, who shall have the power to establish the time, method and routes of service and the color coding of receptacles. Special times for large item pickup shall be established. Excluded from trash accepted for collection shall be:
A. 
Any and all waste material generated outside of Quinton Township.
B. 
Any material not accepted by the Salem County Landfill without special arrangements, special packaging, special handling or special fees.
C. 
Any trash resulting from building demolition.
D. 
Contractor renovations materials.
E. 
Tires.
F. 
Motor vehicles, tractors, farm machinery and trucks, or parts of any of those items.
G. 
Toxic and hazardous waste.
H. 
Tree stumps.
I. 
Brush and trees or parts of brush and trees in excess of four inches in diameter.
J. 
Animal carcasses.
K. 
Nonhousehold chemical or petroleum products.
L. 
Herbicide, pesticide and chemical containers, unless they are empty and triple-rinsed.
M. 
Leaves and grass trimmings.

A. 
Garbage, trash, and debris. Garbage, trash and debris from noninstitutional residential buildings shall be placed in no more than five containers for solid waste and unlimited for recycling in metal or heavy-duty plastic containers and boxes secured by a lid with a total weight not to exceed 50 pounds. No plastic bags are accepted for recycling. Items that cannot be stored in the above containers shall be limited to three items per collection day.
B. 
Brush. Branches from noninstitutional residential property shall be placed at the curbside, and the Township shall be notified as directed by the Recycling Coordinator. In addition, the following rules shall apply to all brush placed at curbside:
(1) 
Tree limbs must be six inches in diameter or smaller. Tree stumps, trunks and limbs in excess of six inches in diameter will not be collected.
(2) 
The maximum amount of brush that can be placed at the curb is two individual piles of branches with each pile not exceeding four feet high by four feet wide by six feet long. Disposal of brush in excess of this volume shall be the responsibility of the resident.
(3) 
Do not place branches in the roadway.
(4) 
Do not stack brush piles beside shrubbery, posts, hydrants, electrical or cable boxes, mailboxes, and/or any other objects.
(5) 
Brush must be accessible for machinery and people collecting the branches/brush; if not, it cannot be removed.
(6) 
Landscapers and tree surgeons hired by the resident are responsible for the removal of branches/brush.
(7) 
The brush removal service provided by the Township is restricted to residential pruning only.
(8) 
The service is provided for residents of the Township. Brush will not be collected from any commercial businesses.
(9) 
If possible, do not stack branches/brush on a sidewalk.
(10) 
Brush mixed with stumps, roots, leaves, grass, dimensional lumber, firewood or oversized material is not acceptable, and will be refused.
(11) 
Only tree branches and limbs are acceptable.
(12) 
Brush must not be stacked at the curb any earlier than one week prior to your scheduled week of collection.
(13) 
Brush must not be stacked for collection within 10 feet of a stormwater inlet/basin.
(14) 
Small twigs must be bagged.
(15) 
All wire, nails and metal shall be completely removed from the pile.
(16) 
Disposal of material in excess of the maximum brush pile size shall be the responsibility of the homeowner within five calendar days of the Township having performed collection for that lot.
(17) 
Limbs and brush must be placed in an orderly manner.
(18) 
Branches will only be picked up for the one-acre lot that surrounds the house.
C. 
Bulk materials and white goods. There is hereby created a fee for the collection and disposal of bulk items within Quinton Township, to be known as the "sticker fee." The owners and occupants of all residential properties and units in the Township who are qualified users and accept the service of collection and disposal of bulk items shall pay for such service to the Township. The Township Clerk and authorized businesses that shall be designated by resolution annually shall sell during normal business hours stickers which shall be affixed to the aforementioned bulk trash and white goods. Stickers shall be placed upon the bag, container or item being disposed in a conspicuous place thereon. If no sticker is applied, the waste will not be collected. Stickers may be purchased only from the authorized officer(s) of the Township or businesses who will issue them to qualified users of this service. Stickers are $5.

D. 
Violations/penalties. Violations for this section shall be filed by the zoning officer in the Municipal Court. Upon a finding of guilt, the offender shall be subject to the following penalties:
(1) 
A fine of not less than $100 and not more than $500 shall be imposed together with court costs for any violations of this section.
(2) 
In the event an individual or entity is prosecuted under this section for a subsequent violation, the fine may be increased to a maximum of $1,000.
(3) 
Each twenty-four-hour period following the initial time to remove the trash from curbside shall constitute a separate violation.
(4) 
Any person who attempts to duplicate or counterfeit a sticker, reuse a cancelled sticker, provide a sticker to an unqualified user, or transfer a sticker to any person whom such sticker was not issued shall be in violation of this section and be subject to prosecution in the Municipal Court. There shall be a rebuttable presumption that the owner of the property was the one who affixed the counterfeit sticker. It is expressly understood that in the event a counterfeit sticker is placed on bulk trash and/or white goods on property owned by a corporation, the principals thereof shall be responsible, or if on property which is rented, the owner thereof shall be responsible.
All receptacles required herein shall be supplied by the occupant or owner of the premises and placed prior to collection between the curb and sidewalk where they shall be readily accessible to the collector. The occupant or owner shall keep all receptacles clean and in condition for safe handling. Receptacles or other items to be disposed of shall be placed outside after 6:00 p.m. of the day immediately preceding the day of collection. After collection, any empty containers shall be removed from the curbside promptly but no later than 7:00 p.m. of the day of collection.
From the time of placement at the curb of any one of the categories described herein for the collection by the Township of Quinton or its agent in accordance with the terms hereof, items shall be and become the property of the Township of Quinton or its authorized agent. It shall be a violation of this article for any person unauthorized by the Township of Quinton to collect or pick up or cause to be collected or picked up any such items during the twenty-four-hour period commencing at 6:00 p.m. on any day preceding a day designated for collection. Any and each such collection in violation hereof from one or more residences during said twenty-four-hour period shall constitute a separate and distinct violation, punishable as hereinafter provided.
Any person, firm or corporation violating any of the provisions of this article shall, upon conviction thereof, be punishable by one or more of the following: by a fine not exceeding $1,000; or by imprisonment not exceeding 90 days; or by a period of community service not exceeding 90 days.
