The Township Council hereby finds and determines
that the specifically delineated project area, as shown on the map
attached to the Township Planning Board's Browns Mills Town Center
Redevelopment Plan, February, 1995, Second Draft, is an area in need of redevelopment in accordance with
the criteria set forth in N.J.S.A. 40A:12A-5 and concludes that the
Township Planning Board has met its obligation to follow the criteria
set forth at N.J.S.A. 40A:12A-5 prior to making said recommendation.
The Township Council, as the governing body
of the Township of Pemberton, shall have and be entitled to and is
hereby vested with all powers and authority available to it in furtherance
of the goals and purposes of said redevelopment plan. The Township
Council is specifically empowered with and authorized to undertake
all such actions, proceedings and undertakings as set forth at N.J.S.A.
40A:12A-1 et seq., including by way of example and not by way of limitation,
those powers set forth at N.J.S.A. 40A:12A-8, 40A:12A-9, 40A:12A-10,
40A:12A-13, 40A:12A-22, 40A:12A-27, 40A:12A-37, 40A:12A-38, 40A:12A-39
et seq.
Pursuant to the authority vested in the governing
body by N.J.S.A. 40A:12A-2, there is hereby established and created
within the Township of Pemberton a Browns Mills Town Center Redevelopment
Advisory Council to assist and advise the governing body in various
development matters. Said Council shall be an ad hoc council, whose
members shall serve at the pleasure of the governing body and which
shall have no power or authority other than to provide advice and
input to the governing body regarding redevelopment matters. Said
Advisory Council shall consist of nine individuals, to be appointed
by the Township Council, in consultation with the Mayor, the composition
of which shall reflect community representations. Appointments to
said Council shall be for periods not to exceed three years each and
may be for lesser terms at the discretion of the governing body.
Pursuant to the requirements of N.J.S.A. 40A:12A-43,
the township shall submit an annual report to the Commissioner of
the Department of Community Affairs of the State of New Jersey indicating
the name, location and size of all projects undertaken in the redevelopment
area. In addition, the annual report shall contain such information
as the Commissioner shall deem necessary in order to fulfill the reporting
requirements of N.J.S.A. 52:27D-3.3.
The Township Council hereby repeals the following
ordinances which were adopted and implemented in furtherance of the
township's efforts to be designated an Urban Enterprise Zone under
the provisions of the New Jersey Urban Enterprise Zones Act, N.J.S.A.
52:27H-60 et seq.: Ordinance No. 18-1994 and Ordinance No. 17-1994.
The following resolutions are also hereby repealed and rescinded:
Resolution Nos. 208-1994, 209-1994 and 210-1994.
