Pursuant to § 10 of the Municipal Home Rule Law, § 2-250
of the Village Law of the State of New York, and §§ 1640
and 1643 of the Vehicle and Traffic Law of the State of New York,
the Village of West Hampton Dunes, County of Suffolk, and State of
New York, hereby enacts as Local Law No. 3 of 1995 this chapter entitled
"Local Law No. 3 of 1995 of the Incorporated Village of West Hampton
Dunes, the Vehicle, Traffic and Parking Law of the Village of West
Hampton Dunes."
This chapter establishes a local law for the purpose of regulation
of vehicles, traffic and parking in the Village of West Hampton Dunes,
and to provide for and for the following purposes:
A. For the Village of West Hampton dunes to establish standards to guide
and regulate the orderly and safe control, passage, and parking of
vehicles in the Village.
B. To promote, in the public interest, the proper utilization of the
roads within the Village for the proper flow and parking of motor
vehicles.
C. To provide for the safety and emergency preparedness of the residents
of the Village and visitors to the Village.
D. To conserve the state and preservation of the surfaces and adjoining
areas and access points in the Village.
E. For the general safety and well-being of the residents of the visitors
to the Village.

The following parking regulations shall be in effect in the
Village of West Hampton Dunes:
A. Prohibited on all Village streets and public rights-of-way. It shall
and hereby is prohibited to park a motor vehicle of any kind on a
Village Street or public right-of-way in the Village of West Hampton
Dunes.
B. Regulated parking. No person shall park any motor vehicle or other
vehicle on those portions of the Village roads in the Village of West
Hampton Dunes in any other manner than as designated on the surface
by appropriate markings where said markings are evident.
C. Parking prohibited in designated areas. The parking of vehicles in
any of the areas designated as no parking areas by the Village of
West Hampton Dunes or as posted shall be prohibited.
D. Restricted parking. The parking of vehicles is hereby prohibited
in any of the areas so designated by the Board of Trustees of the
Village of West Hampton Dunes.
E. Standing prohibited in designated locations. The standing of vehicles
is prohibited in the locations as may be further adopted or posted
by the Board of Trustees of the Village of West Hampton Dunes.
F. Stopping prohibited in designated locations. The stopping of vehicles
is hereby prohibited in the locations as may be adopted by the Board
of Trustees of the Village of West Hampton Dunes.
G. Stopping prohibited in designated handicapped areas. In any public
or private parking lot or on any road, no vehicle shall be parked
in any space, area, or parking stall which has been designated and
identified for use as a handicapped parking space, except for those
persons holding a valid handicapped parking permit issued in accordance
with § 1203-a of the Vehicle and Traffic Law.
H. Time limited parking shall be as designated by resolution of the
Board of Trustees.
I. Sale and storage of vehicles on roads. It is hereby declared to be
unlawful to park or display vehicles for the purpose of storage or
sale on or within 100 feet of the lines of any intersection in the
Village of West Hampton Dunes, in the front yard of any property,
or on any property not owned by the owner of the motor vehicle that
is for sale.
J. Obstruction of roadway or crosswalk. It shall be prohibited to park
a motor vehicle in such a manner so as to obstruct a road or a crosswalk
in the Village of West Hampton Dunes.
K. Parking with expired inspection or expired registration, improper
plates. It is prohibited to operate or park a vehicle in the Village
of West Hampton Dunes with an expired inspection certificate or registration
or with improper plates.
L. U-turns. No person shall make a U-turn on any of the streets or parts
of streets in the Village of West Hampton Dunes.
M. Stop intersections. The intersections described or designated by
the Board of Trustees of the Village of West Hampton Dunes shall be
stop intersections.
N. Trucks over certain weights excluded. Trucks in excess of the weights
indicated are hereby excluded from the streets or parts of streets
as may be adopted or designated by the Board of Trustees except for
the pickup and delivery of materials on such streets.
O. Vehicle weight limit. It shall be unlawful for any person to operate
any commercial vehicle or other tractor, trailer or tractor-trailer
combination, having a gross weight in excess of that herein respectively
prescribed, upon any of the streets or portions thereof described
below except for the purpose of making local deliveries on that street.
P. Parking by special permit only. Parking shall be prohibited without
a special permit in any area so designated by the Board of Trustees.
The shall be no parking without a special permit or for any reason
other than official business of the Village in the parking lot of
the West Hampton Dunes Police Constabulary Office located at 914 Dune
Road, West Hampton Dunes.

A. When any vehicle is parked or abandoned on any highway or public
parking lot within the Village of West Hampton Dunes during a snowstorm,
flood, fire or other public emergency which affects that portion of
the public highway or parking lot upon which said vehicle is parked
or abandoned, said vehicle may be removed by or under the direction
of the Mayor or Board of Trustees or their designee.
B. When any vehicle is found unattended on any highway or public parking
lot within the Village of West Hampton Dunes, where said vehicle constitutes
an obstruction to traffic, said vehicle may be removed by or under
the direction of the Mayor or Board of Trustees or their designee.

After removal of any vehicle as provided in this chapter, the
Mayor or Board of Trustees, Village Police Constabulary, or their
designee may store or cause such vehicle to be stored in a suitable
place at the expense of the owner. Such owner or person in charge
of the vehicle may redeem the same upon payment to the person with
whom stored of the amount of all expenses actually and necessarily
incurred in effecting such removal and storage, such storage charges
not to exceed an amount as set from time to time by the Board of Trustees.

It shall be the duty of the Mayor or Board of Trustees or their
designee to ascertain to the extent possible the owner of the vehicle
or the person having the same in charge and to notify him of the removal
and disposition of such vehicle and of the amount which will be required
to redeem same. Said Mayor or Board of Trustees or their designee
shall also, without delay, report to the Village Clerk the removal
and disposition of any vehicle removed as provided in this chapter.

The Village speed limit on all roads and in all parts of the
Village of West Hampton Dunes shall hereinafter be 25 miles per hour.

B. The fine for every other violation of this chapter shall be not more
than $250 or imprisonment for not more than 15 days, or by both such
fine and imprisonment; for a second such conviction within 18 months
thereafter, such person shall be punished by a fine of not more than
$500 or by imprisonment for not more than 45 days, or by both such
fine and imprisonment; upon a third or subsequent conviction within
18 months after the first conviction, such person shall be punished
by a fine of not more than $300 or by imprisonment for not more than
90 days, or by both such fine and imprisonment.
C. Each and every day that a violation exists shall constitute a separate
violation subject to a separate and additional fine or penalty.
This chapter is not intended to and shall not affect or preclude
the enforcement or application of any existing law of the Town of
Southampton which is in effect in the Village of West Hampton Dunes
pursuant to § 2-250 of the Village Law of the State of New
York.
