All applicants for employment in a nonprofessional capacity with the Borough of West Mifflin must be a resident of the Borough of West Mifflin. Any applicant for employment in a nonprofessional capacity who is not a resident of the Borough of West Mifflin must become a resident within one year after being hired as an employee of the Borough of West Mifflin; provided, however, any successful applicant to a position as a police officer of the Borough of West Mifflin who, after being tested and recommended by the Civil Service Commission, is hired as a police officer for the Borough of West Mifflin must become a resident of the Borough of West Mifflin within a period of one year after being hired as a police officer for the Borough of West Mifflin. This additional period of time is applicable solely to police officers and does not affect any other nonprofessional employee who must be a resident of the Borough of West Mifflin within one year after the date of being hired as an employee of the Borough of West Mifflin.
All employees of the Borough of West Mifflin in a nonprofessional capacity must maintain their residency in the Borough of West Mifflin as a condition subsequent to their employment; provided, however, any nonprofessional employee who is currently employed by the Borough of West Mifflin and is not now a resident of the Borough of West Mifflin shall be exempt from the residency requirements of this article. If said nonprofessional employee who, at the effective date of this article, is a nonresident of the Borough of West Mifflin moves and establishes residency in the Borough of West Mifflin, then the residency requirements for employment by the Borough of West Mifflin of employees in a nonprofessional capacity shall be applicable to said employee.
If any job in the Borough of West Mifflin requires a unique skill of which, in the opinion of Council, the qualified applicant is a nonresident of the Borough of West Mifflin, then Council of the Borough of West Mifflin may waive the residency requirements as a condition precedent and a condition subsequent to employment. For said waiver to be applicable, the waiver must be contained in the official minutes of the Borough of West Mifflin adopted by motion by a majority vote of the Council of the Borough of West Mifflin.
Any nonprofessional employee of the Borough of West Mifflin who fails to establish residency in the Borough of West Mifflin as required in § 40-1 or who fails to maintain a residency in the Borough of West Mifflin as required by § 40-2 will result in the termination of employment of said nonprofessional employee with the Borough of West Mifflin.
