For the purpose of this chapter, the following terms shall have
the meanings hereinafter set forth:
PORTABLE POOL
An artificial pool that has a possible depth of 24 inches
or more. Such a pool must either comply with the above regulations
or be emptied after each period of usage, or at least once ever twenty-four-hour
period. Pools having a depth of less than 24 inches are not subject
to this chapter.
PRIVATE
The swimming pool is not open to the public generally but
is for the use solely by the owner or lessee thereof and his family
and by friends invited to use it without payment of any fee.
SWIMMING POOL
Any artificially constructed body of water intended for the
immersing of the human body, whether for swimming, wading, or both.

From and after the effective date of this chapter, it shall
be unlawful to construct, maintain, install or enlarge any swimming
pool in the Township of Hampton, except in compliance with all the
provisions of this chapter.
Swimming pools shall comply with all front yard and side yard requirements of Chapter
310, Zoning, and, in any event, shall not be located closer to the rear property line than 10 feet.

A. From and after the effective date of this chapter, it shall be unlawful
to proceed with the construction, installation, enlargement or alteration
of any private swimming pool and appurtenances within the Township
of Hampton without first making application to the Building Inspector
and obtaining a permit therefor.
B. The application for such permit will show the name and address of
the owner; the size, depth, and capacity of the swimming pool; and
the said application shall be accompanied by two copies of detailed
plans. There shall also be filed with the application a plot plan
of the property, which will show the location of the swimming pool
thereon, and a plan containing full information as to type, height
and location of the fence surrounding such swimming pool and the number
and position of gates therein.
C. Upon the filing of such application and plans showing compliance
with this and other applicable ordinances or regulations of the Township
of Hampton, and upon payment of the permit fee required, the Township
Manager shall issue a permit for such construction. Construction shall
be completed within six months after the issuing of the permit, and
if not so completed, the permit will be cancelled, and notice of such
cancellation shall be given the owner of the property and the person
to whom the permit was issued, either by personal service or certified
mail. The Township Manager may direct the Building Inspector to inspect
any new private swimming pool and verify the contents of any application.

A. All private swimming pools permanently constructed shall be completely
enclosed by a substantial wall or fence not less than four feet in
height. Any wall or fence shall be so constructed as to have no openings,
holes or gaps larger than four inches in any dimension excepting for
doors or gates. If a picket fence is erected, the horizontal dimension
between each picket shall not exceed four inches. All other openings
in such wall or fence will be equipped with a door or gate, with a
self-closing device with the latch on the inside of the door or gate
not readily accessible for children to operate, and such door or gate
shall be securely locked when the swimming pool is unattended or uncovered.
Provided, however, that the fence requirements of this subsection
shall not be applicable to swimming pools constructed above ground
level, the side walls of which are at least four feet high as measured
from ground level, and which have self-storing retractable ladders
as the sole means of access to the swimming area.
B. No electrical conductors or other overhead wires shall be located
above any pool.
C. Any electrical outlets or appliances or devices inside the wall or
fence surrounding the swimming pool shall be waterproofed and grounded.
D. There shall be no connection of the Hampton Township Municipal Authority's
public water supply or any private source of water supply with any
swimming pool where the outlet of said supply is immersed in the water
within the swimming pool.
E. A drain line for a private swimming pool may be connected to a public
storm sewer if one is available. Where a storm sewer is not available,
a drainage system shall be so constructed to permit the water to drain
evenly over the property of the owner of the private swimming pool
and in such a way that it does not create a hazard or nuisance or
danger to adjacent or abutting property owners. Under no circumstances
shall any drain line for a private swimming pool be connected to any
sanitary sewer line.
The fee for a permit shall be as established by the Council
of the Township of Hampton from time to time by resolution. Until
any such resolution shall be promulgated and adopted, the fee for
such permit is hereby established at the same amounts as are presently
charged for building permits.

In the construction and operation of any private swimming pool,
all of the laws, rules, regulations and the requirements of the Pennsylvania
Department of Environmental Protection and County Department of Health
shall be observed. In the event of any conflict between the provisions
of this chapter and the provisions of the State Department of Environmental
Protection or the County Health Department, the provision providing
the highest standard or the more stringent requirement shall be the
controlling factor.

Any person who shall violate any provision of this chapter shall,
upon conviction thereof, be sentenced to pay a fine of not more than
$1,000 and costs and, in default of payment thereof, shall be subject
to imprisonment for a term not to exceed 30 days. Each day that a
violation of this chapter continues shall constitute a separate offense.
