Unless the context specifically indicates otherwise, the meaning of terms used in this Part 1 shall be as follows:
ASTM
American Society for Testing and Materials.
ASA
American Standards Association.
BOD (denoting BIOCHEMICAL OXYGEN DEMAND)
The quantity of oxygen utilized in the biochemical oxidation of organic matter under standard laboratory procedure in five days at 20° C., expressed in milligrams per liter.
BUILDER
Any person, persons or corporation who undertakes to construct, either under contract or for resale, any habitable building.
BUILDING DRAIN
That part of the lowest horizontal piping of a drainage system which receives the discharge from soil, waste and other drainage pipes inside the walls of the building and conveys it to the building sewer, beginning five feet outside the inner face of the building wall.
BUILDING SEWER
The extension from the building drain to the public sewer or other place of disposal, and shall be the responsibility of the building owner.
COMBINED SEWER
A sewer intended to receive both surface runoff and sewage.
CONTRACTOR
Any person, firm or corporation approved by the Town Board to do work on the sewerage system in the Town.
COOLING WATER
The water discharged from any system of condensation, air conditioning, cooling, refrigeration or other, but which shall be free from odor and oil. It shall contain no polluting substances which would produce BOD or suspended solids each in excess of 10 milligrams per liter.
DEVELOPER
Any person, persons or corporation who undertakes to construct simultaneously more than one housing unit on a given tract or land subdivision.
ENGINEER
The professional engineer retained as Town Engineer for the Town of Lenox.
GARBAGE
Solid wastes from the preparation, cooking and dispensing of food and from the handling, storage and sale of produce.
INDUSTRIAL WASTES
The liquid wastes from industrial processes as distinct from sewage.
INSPECTOR
The authorized representative of the Town of Lenox or his authorized deputy, agent or representative.
MAINLINE SEWER
The sanitary sewer of minimum inside diameter eight inches which in general is located within streets, easements or rights-of-way and is laid parallel to the longitudinal axis of the street, easement or right-of-way. A mainline sewer shall terminate at a manhole.
NATURAL OUTLET
Any outlet into a watercourse, pond, ditch, lake or other body of surface water or groundwater.
NYSDEC
New York State Department of Environmental Conservation.
NYSDOT
New York State Department of Transportation.
OWNER
Any individual, firm, company, association, corporation, society, person or group having legal title to real property.
PERSON
Any individual, firm, company, association, society, corporation or group.
pH
The logarithm of the reciprocal of the concentration of hydrogen ions in grams per liter of solution.
PROPERTY LINE
The edge of a street right-of-way or sewer easement or right-of-way in those instances where the building sewer connects to the public sewer in an easement or right-of-way.
PROPERLY SHREDDED GARBAGE
The wastes from the preparation, cooking and dispensing of food that has been shredded to such degree that all particles will be carried freely under the flow conditions normally prevailing in public sewers, with no particle greater than 1/2 inch in any dimension.
PUBLIC SEWER
A sewer in which all owners of abutting properties have equal rights and is controlled by public authority.
SANITARY SEWER
A sewer which carries sewage and to which stormwater, surface waters and groundwaters are not intentionally admitted.
SERVICE LATERAL
The sanitary sewer of minimum inside diameter six inches which extends from the mainline sewer toward the property being provided with sewer service. The "service lateral" shall begin a wye or manhole in the mainline sewer and shall ultimately terminate within five feet of the street, sewer easement or sewer right-of-way.
SEWAGE
A combination of the water-carried wastes from residences, business buildings, institutions and industrial establishments.
SEWAGE TREATMENT PLANT
Any arrangement of devices and structures used for treating sewage.
SEWAGE WORKS
All facilities for collecting, pumping, treating and disposing of sewage.
SEWER
A pipe or conduit for carrying sewage.
SEWER DISTRICT
Any sewer district of the Town of Lenox or any extensions thereof.
STORM SEWER OR STORM DRAIN
A pipe or conduit which carries stormwaters and surface waters and drainage, but excludes sewage and industrial wastes.
SUSPENDED SOLIDS
Solids that either float on the surface of or are in suspension in water, sewage or other liquids, and which are removable by laboratory filtering.
TOWN
The Town of Lenox.
TOWN BOARD
The duly elected Board of the Town of Lenox or its authorized deputy or representative.
UNPOLLUTED WATER OR WASTE
Any water or waste containing none of the following: free or emulsified grease or oil; acid or alkali; phenols or other substances imparting taste or odor in receiving waters; toxic or poisonous substances in suspension, colloidal state or solution; and noxious or odorous gases. It shall contain not more than 10,000 milligrams per liter of dissolved solids, of which not more than 2,500 milligrams per liter shall be as chloride with permissible volumes subject to review by the Town and not more than 10 milligrams per liter each of suspended solids and BOD. The color shall not exceed 50 milligrams per liter.
UNSANITARY
The disposal of sewage in a manner not in conformance with this Part 1.

United States Environmental Protection Agency.
WATERCOURSE
A channel, either natural or man-made, in which a flow of water occurs, either continuously or intermittently.
WATER SERVICE PIPE
Any portion of a private or public water supply system, including potable water wells.
