(a) 
Definitions. The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
PRIVATE
Means not public or semipublic, as provided in current swimming pool regulations established by the state department of health.
SWIMMING POOL
Means any permanently constructed area capable of containing water and being used for swimming, wading or bathing, and having a depth of two feet or more at any point.
(b) 
Exclusions. Pools constructed for conservation purposes only, and not swimming, and farm drain ponds used for drainage purposes only, are not considered swimming pools.

The provisions of this article shall apply to all pools, except state and county regulations shall apply where such regulations are more restrictive.

(a) 
No person shall construct, operate, maintain or use a swimming pool without first having obtained a permit from the enforcement officer of the Village, in accordance with the provisions of this section. The application for such permit shall be accompanied by a complete and detailed set of plans and specifications for the swimming pool, including the following:
(1) 
Plot plan;
(2) 
Pool dimensions;
(3) 
Location and type of waste disposal system;
(4) 
Structural calculations and details;
(5) 
Fence and gate details.
(b) 
Before any permit shall be issued, such plans and specifications shall be approved by the Building Inspector.
(c) 
Before any swimming pool shall be used, a final inspection shall be made and approval obtained from the building department.
(d) 
A building permit fee shall be paid for the permit.

(a) 
Swimming pools shall conform to setbacks as required for accessory structures in Chapter 34 of this Code. No pool edge shall be located closer than 10 feet to any side or rear lot line.
(b) 
Pool construction shall be such that all scum, splash and deck water shall not return to the pool, except through a filter system.
(c) 
For the protection of the general public, outdoor swimming pools shall be enclosed by a wall, fence or other type of enclosure which may consist in part of the residence to which the swimming pool is appurtenant; the wall or fence to be not less than five feet above the abutting ground level. All gates and doors leading to such swimming pool shall be kept closed when the pool is not in actual use and such gates and doors shall be fitted with a positive latching device which shall automatically latch them when the gate door is in the closed position.
