It shall be unlawful for any person to park a vehicle or to allow the same to remain parked for longer than the ordained time limit prescribed from time to time by the Borough Council, and as indicated on the legend of parking meters or as posted by appropriate signage, provided that the requirements of this Part 4, as to parking time limits and as to payment, shall not apply on the legal holidays set forth in § 15-406, Subsection 4, of this Part 4.

Parking meters shall be installed in the parking meter zones established as provided in § 15-401, and where installed shall be placed upon the sidewalk, immediately adjacent to the individual parking spaces as described in § 15-404. Each meter shall be placed or set in such manner as to show that the parking space adjacent to such meter is or is not legally occupied. Each meter installed shall indicate by a proper legend the legal parking time established by the Borough and, when occupied, shall indicate by its dial and pointer, or by other digital electronic means, the duration of the period of legal parking and, on expiration of such period, shall indicate that such legal parking period has expired.

Application-only parking shall be designated by appropriate signage.

Lines and/or markings shall be painted or placed upon the curb, sidewalk and/or street adjacent to each parking space for the purpose of designating the parking space for which such space is to be used. The marking and designating of parking spaces shall be done by the Borough or its designated agents or employees. Each vehicle parked adjacent to any parking space shall be parked wholly within the lines or markings so placed and applicable to such space. It shall be unlawful to park any vehicle in such a position that such vehicle shall not be wholly within the area so designated by such lines or markings, and the Police Department and Parking Department are hereby authorized and directed to enforce this requirement.

Any person or persons causing a vehicle to be parked in a parking space shall deposit, in the parking meter immediately adjacent and assigned to such space, coins of the United States or, where permitted, other indicated payment options according to the time limits and rates indicated on the legend of such meter or by appropriate signage.

Whenever a vehicle shall be parked in an individual parking space where a parking meter shall have been installed, the person parking such vehicle shall deposit coins of the United States or, where permitted, other indicated payment options causing the meter to operate the display signal showing that the deposit has been made or by confirming payment by electronic or digital means.
2. 
Parking shall be permissible in an individual parking space, where payment parking is authorized, at the following designated locations for the following designated periods of time for the specified rate and method of payment. Rates for on-street payment parking shall be established by resolution as adopted from time to time by the Borough Council.

In no event shall continuous parking in any individual space be permitted for more than the maximum period of time except as otherwise provided herein. Any vehicle which remains in an individual parking space after the period of time herein fixed for parking in such space has elapsed shall be illegally parked, and in any event, shall be deemed to be illegally parked if the meter display signal in the meter or, where permitted, other electronic/digital display, in the immediate vicinity thereof shall fail to show that a proper payment or deposit has been made for such parking.

4. 
The provisions of this section shall not apply to vehicles parking or standing in an individual parking space on the streets where payment parking is authorized in this section, at any time between the hours of 8:00 p.m. and 8:00 a.m., Monday through Sunday, or prior to 1:00 p.m. on Sunday, prevailing time. Furthermore, the provisions of this section shall not apply to vehicles parked or standing in an individual parking space on the streets in any payment parking area on any of the following legal holidays:

The provisions of this section shall not be deemed to be in conflict with any other ordinance otherwise limiting parking or providing for special privileges for special occasions.

Any person or persons who cause a vehicle to remain in a parking space after the prescribed time, for which coins have been deposited or, where permitted, other indicated payment has been made, has elapsed is hereby determined to be illegally parked; and each additional hour that such person or persons permit such vehicle to remain in an individual parking space after the prescribed time for parking has elapsed is hereby declared to be an additional violation. A vehicle which is parked in an individual parking space when the time signal for payment regulating said parking space shows that the time has expired shall be deemed as prima facie evidence of the unlawful parking of said vehicle by its operator and/or owner. The elapse of one hour from the time reported on the notice to the owner or operator of a motor vehicle shall be deemed prima facie evidence of additional violations of the parking of said motor vehicle by the operator or owner.

It shall be unlawful and a violation of this Part 4 for any person to deface, tamper with, open or willfully break, destroy or impair the usefulness of any parking meter, or parking meter stand or coin depository installed under the provisions of this Part; provided that nothing herein shall apply to the servicing or opening of parking meters by officers, employees and/or police officers of the Borough under the direction of the Borough Manager, Parking Manager, Mayor or the Borough Council.

1. 
It shall be the duty of the police officers and/or meter enforcement officers of the Borough, in accordance with the instructions of the Mayor, Borough Manager or Parking Manager, to report all violations of any provision of this Part 4, indicating, in each case:
A. 
The section thereof violated;
B. 
The location where such violation took place; including the parking meter or space at which the vehicle was illegally parked;

C. 
The state and license number of such vehicle;
D. 
The date and time of violation;
E. 
The date and time of the issuance of the notice of the violation;
F. 
Other facts deemed necessary for a clear understanding of the circumstances attending the violation.
2. 
Every such police officer and/or meter enforcement officer shall place upon such vehicle a notice to the owner or driver thereof that such vehicle was parked in violation of a provision of this Part, and shall indicate on the notice the information above set forth.

The Gettysburg Borough Council may suspend in whole or in part the parking regulations set forth in this Part during such days and hours as may be designated by it.

Any owner or driver of any vehicle parked in violation of any provision of this Part 4, or aiding, abetting or assisting in the violation thereof, shall be assessed a fine in accordance with the following schedule:
A. 
Forty dollars for each separate parking violation. The owner or operator may pay the fine within seven calendar days of the date of the violation by placing a check or money order with a copy of the parking ticket in an envelope and depositing the envelope in either the red fine box outside of the Borough building or in the gray box located at the window inside of the lobby of the Borough building. The fine may also be paid by mailing a check or money order and a copy of the parking ticket to the Borough. In addition, the fine may be paid electronically through the Parking Department link on the Borough's website at www.gettysburgpa.gov. No cash payments will be accepted in payment of a fine. If the fine is paid within seven calendar days of the date of violation, a $15 discount shall be applied for a discounted fine payment amount of $25.

B. 
If the applicable fine is not paid within seven calendar days from the time the notice of violation was issued, prosecution will be initiated for said violation, and upon conviction thereof, the owner or operator shall be sentenced to pay a fine of not less than $40, together with costs of prosecution.

The Borough Manager, Parking Manager, or Mayor shall designate some member or members of the Parking Department, or other person, to collect the coins deposited in parking meters, and promptly deposit all of the coins to the credit of the Borough of Gettysburg.

It shall be a violation of this Part to deposit anything other than a United States coin in a parking meter in the Borough of Gettysburg.

Violations of § 15-413 of this Part shall, upon conviction thereof, be subject to a fine of not less than $25 nor more than $300, plus costs of prosecution.
