In interpreting and applying the provisions of this Chapter,
they shall be held to be the minimum requirements for the promotion
of the public safety, health, convenience, comforts, morals, prosperity
and general welfare. It is not intended by this Chapter to interfere
with or abrogate or annul any ordinance, rules, regulations or permits
previously adopted or issued, and not in conflict with any of the
provisions of this Chapter, or which shall be adopted or issued pursuant
to law relating to the use of buildings or premises and likewise not
in conflict with this Chapter, nor is it intended by this Chapter
to interfere with or abrogate or annual any easements, covenants or
other agreements between parties, except that if this Chapter imposes
a greater restriction, this Chapter shall control.

This Chapter shall be known and may be cited as the "City of
Greendale Zoning Ordinance".

For the purpose of this Chapter, certain terms and words are
hereby defined. Words used in the present tense shall include the
future; the singular number shall include the plural and the plural
the singular; the word "building" shall include the
word "structure", and the word "shall" is mandatory and not directory.
ALLEY
A public thoroughfare which affords only a secondary means
of access to abutting property.
AUTOMATED TELLER MACHINE (ATM)
An automated device that performs banking or financial functions
at either a location remote from the controlling bank or directly
outside the bank or in an access-controlled facility within the bank.
BAKERY RETAIL
An establishment primarily engaged in the retail sale of
baked products for consumption off-site. The products may be prepared
either on- or off-site. Such use may include incidental food service.
BANK, DRIVE-THROUGH
A bank that includes provisions for the conduct of banking
services directly to the occupants of motor vehicles.
BANKING SERVICES
Commercial banks as defined in Chapter 362.010, RSMo., savings
and loan as defined in Chapter 369, RSMo., and credit unions as defined
in Chapter 370, RSMo., excluding financial activities as defined in
Chapter 367, RSMo.
BUILDING
Any structure having a roof supported by columns or walls
for the housing or enclosure of persons, animals or chattels.
CEMETERY, GRAVEYARD
An area or parcel of land used exclusively and only for the
burial or interment of dead human remains.
CONTRACTORS, SPECIAL TRADE
Contractors who undertake trades of a type that are specialized
to assist in building construction and remodeling. This definition
is limited to contractors primarily engaged in glass and glazing installation,
installation of heating and air-conditioning systems, painting, plumbing
and roofing and siding installation, electrical work, flooring and/or
tile installation, finished carpentry and interior decoration.
DISTRICT
A section or sections of the City of Greendale, St. Louis
County, Missouri, for which the zoning regulations are uniform.
DRY CLEANING ESTABLISHMENT
An establishment or business maintained for the pickup and
delivery of dry cleaning and/or laundry without the maintenance or
operation of any laundry or dry cleaning equipment or machinery on
the premises.
DWELLING
Any building or portion thereof which is designed or used
exclusively for residential purposes.
DWELLING, MULTIPLE
A building or portion thereof designed for or occupied by
more than one (1) family.
GROUP HOME
Any home in which eight (8) or fewer unrelated mentally or
physically handicapped persons reside and may include two (2) additional
persons acting as house parents or guardians.
HEIGHT, BUILDING OR STRUCTURE
The vertical distance from finished grade to the highest
point of the roof of a building or highest point of any permanent
part of a structure other than a building. Height measurements shall
be taken from the average elevation of the finished grade at the front
of a building or structure, except that where no front is specified
or evident, such measurement shall be taken from the average elevations
of the surrounding finished grade.
LOT
A parcel of land occupied or intended for occupancy by one
(1) main building together with its accessory buildings, including
the open spaces and parking spaces required by this Chapter, and having
its principal frontage upon a street or upon an officially approved
place.
LOT COVERAGE
The percentage of the horizontal area of a lot within the
outside of the exterior walls of the ground floor of all principal
and accessory buildings on the lot. Open porches, decks, patios, canopies,
fire escapes, driveways, parking lots, sheds and swimming pools shall
not be included.
NON-CONFORMING USE
Any building or land lawfully occupied by a use at the time
of passage of this Chapter or amendment thereto which does not conform
after the passage of this Chapter or amendments thereto with the use
regulations of the district in which it is situated.
OFFICE, BUSINESS
A room or group of rooms used for administrative, executive,
professional, research or similar organizations, having only limited
contact with public, provided that no merchandise or merchandising
services are sold on the premises, except such as are incidental or
accessory to the principal permissible use.
PARKING SPACE
A durable, dustproof, surfaced area of not less than two
hundred (200) square feet suitable in dimensions to park one (1) standard
size automobile.
PERSONAL SERVICE ESTABLISHMENT
An establishment or place of business primarily engaged in
the provision of frequent or recurrent needed services of a personal
nature. These establishments are limited to the following: dry cleaning
establishment, photography retail store, beauty and barber shop, pet
grooming, travel agency, florist, shoe repair shop and tailor shop.
PHOTOGRAPHY RETAIL STORE
A facility primarily engaged in the retail sale, lease and
service of photography equipment and supplies, including limited on-site
processing or development.
RELIGIOUS INSTITUTION
A building wherein persons regularly assemble for religious
worship and which is maintained and controlled by a religious body
organized to sustain public worship, excluding buildings used exclusively
for residential, educational, recreational or other uses not normally
associated with worship. Includes churches, chapels, cathedrals, temples,
mosque or other such place for worship and religious activities.
RESTAURANT
A commercial establishment where food and beverages are prepared,
served and consumed primarily within the principal building.
RESTAURANT, FAST-FOOD
An establishment engaged primarily in the business of preparing
food and purveying it on a self-serve or semi self-serve basis. Customer
orders and/or service may be by means of a walk-up counter or window
designed to accommodate automobile traffic. Consumption may be either
on or off the premises.
RESTAURANT, FULL-SERVICE, SIT-DOWN
An establishment maintained, operated and/or advertised or
held out to the public as a place where food and beverage are served
to the public on demand from a menu during stated business hours,
served in and on reusable containers and dinnerware, to be consumed
on the premises primarily inside the building at tables, booths or
counters with chairs, benches or stools.
RESTAURANT, TAKE-OUT
Establishments where food is usually ordered by telephone
and prepared on the premises for consumption off the premises, with
no seating or other area provided on the premises for consumption.
The establishment may deliver food to the customer or the customer
may pick food up.
SCHOOL, BUSINESS OR COMMERCIAL
An institution for the teaching of children or adults including
professional schools, dance schools, business schools, trade schools,
art schools and similar facilities.
STRUCTURAL ALTERATION
Any change in the supporting members of a building, such
as bearing walls, columns, beams or girders, or any substantial change
in the roof or in the exterior walls.
STRUCTURE
Anything constructed or erected, the use of which requires
permanent location on the ground or attached to something having a
permanent location on the ground.
