A Board of Appeals is established.

A. The
Board shall consist of seven (7) members appointed by the City Council.
The Board shall consist of members with the following expertise:
3. Five (5) members from any of the following occupations:
a. Licensed general contractor,
b. Licensed heating and cooling contractor,
h. Licensed real estate broker.
B. Should
a particular expertise not be available for appointment, Council,
at its discretion, may provide for duplication or substitution of
the required expertise.
C. Board
members shall serve for a term of three (3) years commencing on the
first (1st) Monday in October of each year. Any vacancy in a membership
shall be filled for the unexpired term by appointment of the City
Council. The Council may remove any member for cause, in writing,
after a public hearing.

The Board shall elect a Chairman from among its members. The
term of Chairman shall be for one (1) year with eligibility for re-election.
The Board shall hold meeting on an as-needed basis and shall adopt
rules for the transaction of business and keep a record of its proceedings;
these records shall be public records. The Board shall be assisted
by City staff necessary for its work.

The Board of Appeals shall be responsible for the review of
a claim that the true intent of the building codes or the rules legally
adopted as part of those codes has been incorrectly interpreted, the
provisions of the code do not apply or an equally good or better form
of construction can be used. The proceedings of the Board shall be
as established in the currently adopted City Building Code.
