There shall be and there is hereby created a Park and Recreation
Board in the City.

There is hereby established a Park and Recreation Board of the
City which shall consist of twelve (12) members to be appointed by
the Mayor subject to the approval of a majority of the Board of Aldermen.
One (1) member of the Board of Aldermen shall be appointed by the
Mayor with the approval of the majority of the Board of Aldermen to
serve a term of one (1) year as ex officio member, but he/she shall
not be permitted to vote on any matter coming before the Park and
Recreation Board. Members of the Park and Recreation Board other than
the ex officio member shall hold office as follows: one-third (1/3)
for one (1) year, one-third (1/3) for two (2) years, and one-third
(1/3) for three (3) years, from June first (1st) following their appointment,
and annually thereafter the Mayor shall, before June first (1st) of
each year, appoint as before four (4) Park and Recreation Board members
who shall hold office for three (3) years and until their successors
are appointed. The Mayor may, by and with the consent of the Board
of Aldermen, remove any Park and Recreation Board member for misconduct
or neglect of duty. Present Park and Recreation Board members shall
serve their currently appointed terms.

The Park and Recreation Board shall, within fifteen (15) days
after the appointment of its members, meet and elect one (1) of its
members as President, and shall elect such other officers as the members
of the Board may deem necessary. The Board shall adopt and promulgate
such rules and regulations for the conduct, operation and maintenance
of the recreational system within the City, which shall consist of
parks, park areas, historical sites, playgrounds, swimming pools,
gardens and other recreational areas owned or used by the City, as
the Board may deem necessary. Such rules and regulations shall be
subject, however, to the approval of a majority of the Board of Aldermen.

The Park and Recreation Board shall be a recommending body only,
and shall make its recommendations to the Board of Aldermen for the
operation and maintenance of the recreational system within the City,
which shall consist of parks, park areas, historical sites, playgrounds,
swimming pools, gardens and other recreational areas owned or used
by the City, for its determination as to what action should be taken.
The Board of Aldermen may from time to time delegate certain authority
and responsibilities to the Park and Recreation Board for the proprietary
functions to be performed in connection with the duties of the Park
and Recreation Board.

The Director of Parks and Recreation shall report directly to
the City Administrator and shall make monthly reports on the first
(1st) of each month as needed to the City Administrator as any other
department supervisor.

The Board of Aldermen shall be held as special trustees for
all donations of money, personal property or real estate for the benefit
of the City Parks, whenever such donations are accepted, according
to terms of the deed, gift, devise or bequest of such property.

A. The
Park and Recreation Board shall have the power and authority to make
and adopt rules and regulations concerning the hours, use and operation
of the City Parks. The rules and regulations shall be submitted in
writing to the Board of Aldermen for its approval.
B. The
approved rules and regulations shall be posted by the Park and Recreation
Board in at least one (1) accessible location at each park site.
C. The
Park and Recreation Board shall have the power and authority to amend
any rule or regulation created by them, subject to the approval of
the Board of Aldermen.
D. Any
violation of the rules and regulations established pursuant to this
Section shall be deemed an ordinance violation.

All funds collected by the Parks Department shall be turned
over to the City Collector.
