For the purposes of this Chapter, certain words and phrases
are defined as follows:
BENCH MARK
A definite point of known elevation and location and of more
or less permanent character.
BLOCK
An area of land surrounded by public highway, streets, streams,
parks or other similar areas or facilities.
BOARD
When capitalized, the Board of Aldermen of the City of Town
and Country, Missouri.
BUILDABLE LOT
1.
A lot of record which satisfies the minimum width and size requirements
of the current zoning and subdivision standards; or
2.
A lot of record which, at the time it became a lot of record,
satisfied the minimum width and size requirements of the zoning and
subdivision standards then in effect.

Any buildable lot which otherwise fails to satisfy current zoning
or subdivision standards must apply for and receive any necessary
variances prior to development.

BUILDING LINE
A line on a lot, generally parallel to the lot line between
which line and the lot line no structure or any part thereof may be
situated except as provided in the Zoning Code.
CITY
When capitalized, the City of Town and Country, Missouri.
CITY ATTORNEY
An attorney, registered in the State of Missouri, appointed
to serve as legal advisor to the Board of Aldermen of the City of
Town and Country, Missouri.
CITY CLERK
The City Clerk of Town and Country, Missouri, or his/her
deputy.
CITY ENGINEER
For the purpose of this Chapter only, the City Engineer shall
be the Director of Public Works of the City of Town and Country, Missouri,
or his/her designated representative.
COMMISSION
When capitalized, the Planning and Zoning Commission of the
City of Town and Country, Missouri.
COMMON LAND
Land set aside for open space or recreational use for owners
of the lots in a subdivision for the sole benefit, use and enjoyment
of the lot owners, present and future.
DEPARTMENT
The appointed Town and Country City Officials responsible
for the enforcement of City ordinances regulating the development
of land within the City boundaries.
DIRECTOR
The Planning Director of the City of Town and Country, Missouri,
or his/her designated representative.
DIRECTOR OF PUBLIC WORKS
The Director of Public Works of the City of Town and Country,
Missouri, or his/her designated representative.
DISTRICT
A section of the City of Town and Country within which the
zoning regulations are uniform.
DRAINAGEWAY
A terrain feature, natural or manmade, between the top of
banks that define the normal high-water level serving to collect and
drain rainwater by open flow, and serving a drainage basin of at least
four (4) acres.
DWELLING
Any building or portion thereof which is designated or used
for residential purposes.
EASEMENT
An interest in land owned by another person entitling the
easement holder to use the land for a specific purpose.
EASEMENT, UTILITY
A grant by a property owner to a public or private utility
company for the purpose of installation, improvement, and maintenance
of public or private utilities.
ENGINEER
A professional engineer registered in the State of Missouri.
ESCROW AGENT
A title company, bank, savings and loan association, trust company, or a person or agency approved by the City to act as escrow agent under the provisions of Section
410.160 of the Chapter.
FIRE MARSHAL
A City Official appointed to the position by the Board of
Aldermen.
FLOODPLAIN
Any area subject to a one percent (1%) chance of flooding in any given year (100-year flood), as established by the provisions of Section
405.335(C).
FRONTAGE
That portion of a lot, parcel or tract of land adjacent to
or abutting a street.
GRADE
A reference plane representing the average of finished grade
level adjoining the structure at all exterior walls.
GROVE
Any grouping of eight (8) or more trees each having eighteen
(18) inches or greater caliper with no tree trunk farther than thirty
(30) feet from any other tree trunk in the group.
IMPROVEMENTS
Street pavement, sidewalk pavement, pedestrianway easement,
water mains, storm sewers, sanitary sewers, signs, monuments, landscaping,
street lights and other similar items.
IMPROVEMENT PERMIT
A permit issued by the City authorizing the subdivider to
proceed with installing subdivision improvements.
IMPROVEMENT PLANS
The engineering drawings showing types of materials and construction
details for the physical structures and facilities excluding main
buildings to be installed in conjunction with the development of the
subdivision.
LOCAL STREET
A street for local traffic only, located completely within
a subdivision, and generally taking subdivision traffic only.
LOT
A parcel of land undivided by any street or private road
and accessible by means of a street and fronting on a street and occupied
by, or designated to be developed for one (1) building or principal
use and the accessory buildings or uses customarily incidental to
such building, use, or development, including such open spaces and
yards as are designed and arranged or required by this Chapter for
such building, use or development.
LOT AREA
The area contained within the boundary lines of a lot exclusive
of any area designated for street or common land purposes and any
detention area, whether wet or dry.
LOT, CORNER
A lot abutting two (2) or more streets at their intersection.
LOT, DOUBLE FRONTAGE
A lot having a frontage on two (2) non-intersecting streets
(as distinguished from a corner lot).
LOT OF RECORD
Any validly recorded lot which at the time of its recordation
complied with all applicable laws, ordinances and regulations.
LOT WIDTH
The mean horizontal distance between the side lot lines measured
at a point generally parallel to the street at the building line.
Where there is only one (1) side lot line, lot width shall be measured
between such lot line and the opposite lot line or future right-of-way
line. On cul-de-sac lots, lot width shall be measured along the arc.
MINOR STREET
A street not located within a single subdivision, connecting
local residential areas with major streets or with commercial areas,
excluding major streets and local streets.
MSD
The Metropolitan St. Louis Sewer District.
MUNICIPAL CODE
The Municipal Code of the City of Town and Country, Missouri.
NATURAL RESOURCES
Includes ravines, floodplains, mature woodlands, young woodlands
and drainageways as defined by this Chapter.
PLAT, PRELIMINARY
The preliminary drawing conforming to the regulations of
this Chapter indicating the proposed manner and layout of the subdivision.
PLAT, RECORD
The final drawing on which the subdivision plan for land
subdivision is approved by the Board of Aldermen and is recorded in
the St. Louis County Recorder of Deeds office.
PRIVATE DRIVEWAY
Surfaces used for limited access by vehicles to one (1) residence,
and not for daily access by the public, which surfaces are part of
residential lot area and not a right-of-way easement.
RAVINE
A natural and wooded area of a minimum of fifteen (15) feet
deep, defined by an abrupt change of at least twenty degrees (20°)
on side slope or slopes with side walls with slopes greater than two
(2) feet horizontal to one (1) foot vertical (twenty-six and one-half
degrees (26.5°) or a fifty percent (50%) slope) and extending
ten (10) feet back from said area of abrupt change.
SIGN
A device, a structure or part of a structure including structural
trim, or monument which displays or upon which is displayed any colors,
message, name or symbol of any kind for the purpose of advertising,
announcing, directing or attracting attention from the outside of
a building. A cross or other religious symbol on a religious building
shall not be considered a sign, nor shall a work of art which in no
way identifies a business product be considered a sign. Sign supports
or a monument base are not part of a sign.
SPECIFICATION, ST. LOUIS COUNTY
A regulation contained in the document entitled St. Louis
County Standard Specifications For Highway Construction dated June
1, 1980.
STREET
All surfaces used for vehicular traffic, including public
or private right-of-ways which afford the principal means of access
by vehicles to abutting properties, and excluding parking lot entrance
drives and circulating drives in non-residential developments and
private driveways in residential developments. The word "street" shall be construed to include major streets, minor streets, local
streets, roads, avenues, boulevards, alleys, lanes, viaducts and all
other public ways in the City.
STREET COMMISSIONER
The Street Commissioner shall be the Director of Public Works
of the City of Town and Country, Missouri, or his/her designated representative.
STREET, CUL-DE-SAC
A street designed with a single common ingress and egress
and a turnaround at the end which provides vehicular access to abutting
properties.
STREET, LOOP
A street which has its only ingress and egress at two (2)
points on the same collector, service or minor arterial street, and
which provides vehicular access to abutting properties.
STREET, RESIDENTIAL
A private street within a residential subdivision which conforms
to the applicable street specifications as defined in this Chapter.
SUBDIVIDER
Person, firm or corporation by whom a parcel of land will
be subdivided and/or improved pursuant to the requirements of this
Chapter.
SUBDIVISION
Any subdivision or redivision of a subdivision, tract, parcel,
or lot of land into two (2) or more parts. All subdivisions are also
developments.
SUBDIVISION, LARGE LOT RESIDENTIAL
A division or resubdivision of a tract or tracts of land
into not more than three (3) lots for single-family purposes wherein
each lot is four (4) acres or more in area and at least two (2) sides
of each lot are greater than three hundred (300) feet in length.
SURETY COMPANY
An insurance company qualified and acting under the provisions of applicable Revised Statutes of Missouri and which has been approved by the City to act as surety under the provisions of Section
410.160(G) of this Chapter.
TRACT
An area or parcel of land which the subdivider intends to
subdivide and improve in accordance with the provisions of this Chapter.
WOODLANDS, MATURE
An area over five thousand (5,000) square feet of woody planted
material consisting of thirty percent (30%) or more canopy trees having
a ten (10) inch or greater caliper, or any "grove" as defined herein.
WOODLANDS, YOUNG
An area over five thousand (5,000) square feet of woody planted
material consisting of seventy percent (70%) or more canopy trees
having a two and one-half (2½) inch or greater caliper.
ZONING CODE
Chapter
405 of this Title, as adopted on January 27, 1987 by Ordinance No. 1076, and as amended from time to time, with the purpose of said Chapter being to control and regulate zoning for Town and Country, Missouri.
