A. Definition. For the purpose of this Section, the "Major Case Squad" shall mean any formation, operation,
organization or cooperative action between any County, Governing Body,
any municipal government and the City of Festus, the purpose of which
is intensive professional investigation of certain individual crimes
that may occur in their general geographical area and which is operated
and activated on request of a County Sheriff, County Police Superintendent
or the Police Chief of a political subdivision wherein a crime has
occurred.
B. Authorization. The officers of the City of Festus Police
Department are authorized to participate in and cooperate with any
Law Enforcement Officers of jurisdictions in any Major Case Squad
operation or formation. The officers designated to act as the Major
Case Squad operation will be so designated by the Chiefs of Police
and when acting outside of the City as a member of the Major Case
Squad operation shall be considered to be on active duty the same
as if acting within the boundaries of the City of Festus.

A. Any Police Officer of the City of Festus, Missouri, who has completed the basic training program as established by Chapter 590, RSMo., shall have the authority to respond to an emergency situation outside the boundaries of the City of Festus; provided however, that such authorization to respond shall exist only within the jurisdictions described in Subsection
(C) below. As used in this Section,
"emergency situation" means any situation in which the Law Enforcement Officer has a reasonable
belief that a crime is about to be committed, is being committed,
or has been committed involving injury or threat of injury to any
person, property, or governmental interest and such officer's response
is reasonably necessary to prevent or end such emergency situation
or mitigate the likelihood of injury involved in such emergency situation.
The determination of the existence of any emergency situation shall
be in the discretion of the officer making the response or in the
discretion of an officer or governmental officer of the political
subdivision in which the emergency situation is alleged to be occurring.
B. The term "response", as used in this Section, shall mean to take
any and all action which the officer may lawfully take as if exercising
his/her powers within his/her own jurisdiction.
C. The authority
contained herein shall permit the response by one (1) or more City
of Festus Police Officers in any of the following jurisdictions within
the State of Missouri until the emergency situation has been adequately
taken into control, in the discretion of the officer, by another appropriate
jurisdiction: City of Crystal City, Jefferson County and only on Lots
1 and 2 of the Twin Cities Addition to the City of Festus, Missouri,
as recorded in Plat Book No. 122, Pages 20, 21, 22 and 23 of the Jefferson
County Land Records.
D. Every
response to an emergency situation outside the City limits of Festus,
Missouri, shall be reported by the Chief of Police to the Mayor with
an explanation of the reason for the response.
E. Notwithstanding
anything to the contrary within this Section, if the City of Crystal
City, Jefferson County, Missouri, has not passed appropriate legislation
authorizing Police Officers of the City of Crystal City to respond
within that jurisdiction within sixty (60) days of the date hereof,
then this Section shall be void and of no effect whatsoever as to
the authority of the officers of the City of Festus to respond within
that jurisdiction.

A. The City
hereby adopts and will enforce this policy prohibiting the use of
excessive force by law enforcement agencies within its jurisdiction
against any individual engaged in non-violent civil rights demonstrations.
The City also prohibits the physical barring of any entrance or exit
to such a facility and will enforce all applicable State law regarding
same.
B. Any person
found to be violating any provision of this Section shall be served
by the City with written notice stating the nature of the violation.
C. Any person
guilty of this violation shall be guilty of an ordinance violation
and on conviction thereof shall be fined in the amount not exceeding
one hundred dollars ($100.00) for each violation. Each day in which
any such violation shall continue shall be deemed a separate offense.
