A.
Whenever
in this Code the doing of any act or the failure to do any act constitutes
a breach of any section or provision of this Code or any Village ordinance
and there shall be no specific fine or penalty declared for such breach
or ordinance violation, any person who shall be convicted of any breach
or ordinance violation shall be fined not less than $75 nor more than
$750 for each offense. Each day any breach of any provision of this
Code or any ordinance shall constitute a separate offense.
B.
The penalty
provisions contained in this section shall not apply when any other
section of this chapter contains a specific penalty provision applicable
to that section.
In all cases where the same offense is made punishable or is
created by a different clause or section of this Code, the prosecuting
officer may elect under which to proceed; but not more than one recovery
shall be had against the same person for the same offense, provided
that the revocation of a license or permit shall not be considered
a recovery or penalty so as to bar any other penalty from being enforced.
Nothing in this chapter shall preclude the assessment of fees
or other charges pursuant to any other Village ordinance, resolution,
rule, policy or practice.
