For the purposes of this Article, the following terms shall be deemed to have the meanings indicated below:
ANIMAL AND AGRICULTURAL WASTE
Manure, crop residue and large dead animals.
BULKY WASTE
Large auto parts, tires, stoves, refrigerators or other large appliances, furniture, large crates or any item too large to fit into the containers specified herein.
CITY
The City of Dexter, Missouri.
CONSTRUCTION AND DEMOLITION WASTE
Lumber, roofing, rubble, broken concrete, plaster, conduit, pipe, wire and all related materials associated with construction and demolition.
CONTRACTOR
Any person, firm or corporation which contracts with the City to collect and dispose of solid waste.
CUSTOMER
Anyone who receives solid waste collection and disposal services as specified in this Article.
GARBAGE
Waste from the preparation, cooking and serving of food or from the handling, storage and sale of produce and meats.
RESIDENTIAL CUSTOMER
Any person who is billed directly for his/her water use at his/her place of residence.
SOLID WASTE
Garbage, refuse and other discarded materials including, but not limited to, solid and semi-solid waste materials resulting from industrial, commercial, agricultural, governmental and domestic activities, but does not include hazardous waste as defined in Sections 260.360 to 260.432, RSMo., recovered materials, overburden, rock, tailings, matte, slag or other waste material resulting from mining, milling or smelting. Solid waste does not include "Yard Waste" as defined in Section 260.200, RSMo.
SPECIAL CUSTOMER
Any customer other than a residential customer including, but not limited to, the following: industrial establishments, commercial establishments, institutional establishments, apartment houses, condominiums and schools. Residents of apartment houses, condominiums or other living establishments who are billed directly for their water use shall be classified as residential customers.
SPECIAL WASTE
Hazardous waste such as pathological wastes, pesticides, herbicides, explosives, and radioactive materials.

A. 
The occupant of every dwelling unit and of every institutional, commercial or business, industrial or agricultural establishment producing solid waste within the corporate limits of the City shall provide sufficient and adequate containers for the storage of all solid waste, except bulky waste and demolition and construction waste, to serve each such dwelling unit or establishment and shall maintain such solid waste containers at all times in good repair. The weight of any individual container and contents shall not exceed fifty (50) pounds.
B. 
The occupant of every dwelling unit and of every institutional, commercial or business, industrial or agricultural establishment shall place all solid waste to be collected in proper solid waste containers, except as otherwise provided herein, and shall maintain such solid waste containers and the area surrounding them in a clean, neat and sanitary condition at all times .
C. 
Residential solid waste shall be stored in lightweight containers of sturdy construction, made of plastic, galvanized iron or other non-rusting material, of not more than thirty-two (32) gallons nor less than ten (10) gallons in capacity. Containers shall be leakproof, waterproof and fitted with a fly-tight lid and shall be properly covered at all times except when depositing waste therein or removing the contents thereof. The containers shall have handles, bails or other suitable lifting devices or features.
D. 
Commercial solid waste shall be stored in solid waste containers as approved by the Director. The containers shall be waterproof, leakproof and shall be covered at all times except when depositing waste therein or removing the contents thereof.
E. 
Tree limbs less than four (4) inches in diameter and brush shall be securely tied in bundles not larger than forty-eight (48) inches long and eighteen (18) inches in diameter. The weight of any individual bundle shall not exceed fifty (50) pounds.
F. 
Yard waste shall be stored in containers or strong plastic bags so constructed and maintained as to prevent the dispersal of wastes placed therein. All garbage and food containers shall be drained and wrapped in paper or plastic. Ashes shall be cool and dry and shall not be placed in the container in a loose state.
G. 
Animal waste or manure shall be stored in heavy duty plastic trash bags which shall be securely fastened, labeled as "animal waste" and set apart from other solid waste. No more than twenty-five (25) pounds of animal waste shall be put in any one (1) heavy duty plastic trash bag.

A. 
The City shall provide for the collection of all solid waste in the City; and each dwelling unit and every institutional, commercial or business, industrial or agricultural establishment, unless otherwise exempted herein, shall subscribe to such collection service.
B. 
Any special customer who is of the opinion that the services provided by the contractor is not satisfactory for the particular circumstances of such special customer may apply to the Director for exemption from the services contemplated herein and from the payment of the service charges required to be paid by this Article. If the Director finds that the particular circumstances of the applicant are such that an exemption should be granted, he/she may grant such exemption upon being satisfied that the applicant will adequately dispose of the solid waste of such special customer in accordance with all applicable City, State and Federal laws, rules, regulations and ordinances. Any exemption granted may be revoked upon reasonable notice and good cause shown. Any aggrieved party may appeal from an adverse decision of the Director to the Board of Aldermen.
C. 
All solid waste from premises to which collection services are provided shall be collected from the alley if there is a usable alley and from the curb if there is no usable alley.
D. 
Solid waste shall be placed within ten (10) feet of the alley if there is a usable alley or, if there is no usable alley, within ten (10) feet of the curb for collection. Any solid waste containers, tree limbs, yard wastes or other solid waste required by this Article to be placed at or near the alley or curb for collection shall not be so placed until the regularly scheduled collection day. Residential solid waste containers shall be stored in a location not visible from the street, except on days when collections are made. Commercial solid waste containers shall be stored upon private property, unless the owner shall have been granted written permission from the City to use public property for such purposes.
E. 
Solid waste collectors operating under contract with the City are hereby authorized to enter upon private property for the purpose of collecting solid waste therefrom as required by this Article but shall not enter dwelling units or other residential buildings for the purpose of collecting residential solid waste.
F. 
Collections of solid waste shall be made as follows:
1. 
All residential solid waste, other than bulky waste, shall be collected at least once weekly.
2. 
All commercial solid waste shall be collected at least once weekly and shall be collected at more frequent intervals as may be fixed by the Director upon a determination that such more frequent intervals are necessary for the preservation of the health or safety of the public.
3. 
Bulky waste shall be collected the first (1st) and third (3rd) Fridays of each month, except in such weeks when a holiday occurs and then no collection will be made.
4. 
The collection of bulky waste shall be restricted to two (2) items of bulky waste per customer per month.
5. 
Yard waste shall be collected the second (2nd) and fourth (4th) Fridays of each month, except in such weeks when a holiday occurs and then no collection will be made.
G. 
All collection vehicles shall be uniformly painted, distinctively marked and shall be maintained in a safe, clean and sanitary condition and shall be so constructed, maintained and operated as to prevent spillage of solid waste therefrom. All vehicles to be used for collection of solid waste shall be constructed with enclosed, watertight bodies, except for vehicles used for the collection of bulky waste.
H. 
Collection vehicles shall not weigh more than twenty-four (24) tons when fully loaded. Such vehicles shall be operated in such a manner as to not unduly interfere with traffic and shall not be left in streets or alleys unattended.

Solid waste shall be disposed of at a refuse disposal site approved by the City and complying with all requirements of the Missouri Division of Health and having a valid license from the State of Missouri to operate as such.

The City will collect and dispose of all street sweepings, dirt, leaves, catch basin dirt, contents of litter receptacles, abandoned automobiles and trucks, and large dead animals which come from streets, sidewalks and alleys. The customers will be responsible for disposing of all construction and demolition waste, animal and agricultural waste, special waste, dirt, or any waste generated in such amount that a nuisance would develop when employing the highest degree of service provided for herein.

The Mayor, with the consent and approval of the Board of Aldermen, shall appoint a suitable person as director of solid waste activities who shall have the duties of supervising the collection and disposal of solid waste.

A. 
It shall be unlawful for any person to:
1. 
Deposit solid waste in any solid waste container other than his/her own without the consent of the owner of such container.
2. 
Interfere in any manner with solid waste collection equipment or with solid waste collectors in the lawful performance of their duties as such, whether such equipment or collectors shall be those of the City or those of a solid waste collection agency operating under contract with the City.
3. 
Dispose of solid waste at any location within the City which is not approved by the City and the Missouri Division of Health.
4. 
Place more than two (2) containers or four (4) heavy duty plastic trash bags for collection without the colored tag for such excess containers or bags as provided in Section 235.090.
5. 
Deposit any solid waste container or trash bag at a collection site other than the day on which the collection service is provided at said site or to fail to remove any solid waste containers or trash bags from the collection site by 12:00 Midnight on the day of collection.
6. 
It shall be unlawful for any person to manufacture, possess or use counterfeit trash pickup tags for the City of Dexter.

A. 
It shall be unlawful to dump or place any garbage, trash, refuse or ashes on any premises in the City without the consent of the owner of such premises.
B. 
It shall be unlawful for any person, corporation or entity to bring into the City limits of Dexter any garbage, trash, refuse or ashes for the purpose of dumping or placing said garbage, trash, refuse or ashes on any premises within the City limits of Dexter, whether owner of such premises gives consent or not.

A. 
Residential customers shall pay seventeen dollars ($17.00) per calendar month for a once-per-week collection of two (2) thirty (30) gallon containers or four (4) thirty (30) gallon heavy-duty plastic trash bags, and residential customers shall pay one dollar ($1.00) to the City in advance of trash collection for a colored tag for each additional container or heavy-duty plastic trash bag, said colored tag to be attached to each additional container or trash bag prior to removal.
B. 
Special customers shall pay twenty one dollars and seventy-five cents ($21.75) per calendar month for a once-per-week collection of three (3) thirty (30) gallon containers or six (6) thirty (30) gallon heavy-duty plastic trash bags, and special customers shall pay one dollar ($1.00) to the City in advance of trash collection for a colored tag for each additional container or heavy-duty plastic trash bag, said colored tag to be attached to each additional container or trash bag prior to removal.
C. 
Customers using a dumpster shall pay to the City per calendar month for once-per-week collection of same according to the following schedule:

D. 
Customers setting out bulky items must call the Water Department (573-624-5527) by noon on Thursday to have items picked up on Friday. A maximum of two (2) bulky items per customer will be picked up at any one (1) collection.
1. 
Customers setting out bulky "white goods" items, such as refrigerators, stoves, washers, dryers, hot-water heaters, and all major appliances, must purchase a blue tag from City Hall at a cost of ten dollars ($10.00) for each "white goods" item to be collected.
2. 
Customers setting out all other bulky items, such as couches, chairs, mattresses, etc., must purchase a red tag from City Hall at a cost of one dollar ($1.00) for each bulky item to be collected.
3. 
Landlords shall be responsible for trash removal from tenants, including bulk items, and these items are to be placed at the normal trash pickup.
4. 
Customers wanting tree limbs, bushes and other large yard waste removed must be placed on the side of the road and/or edge of their yard, and purchase a green tag from City Hall at the cost of twenty-five dollars ($25.00) per dump truck load.
E. 
All of the aforementioned service fees for trash tags in this Section shall be non-refundable.
F. 
A surcharge of seventy-five cents ($0.75) per month shall be added to each customer's bill during any month that the City's trash is being hauled to the Butler County landfill. This surcharge shall cease when the City's trash is no longer being hauled to the Butler County landfill.

A. 
The City of Dexter shall provide trailers within the City limits of Dexter to act as drop-off points for recyclable materials, including newsprint, glass, cardboard, plastic bottles and jugs, and aluminum cans, and the trailers shall be clearly marked as to the recyclable material accepted by each bin of said trailers:
1. 
Newsprint includes newspapers only and must be tied securely in bundles weighing not more than forty (40) pounds. Sale bills, slick paper, colored paper, magazines and like materials are not acceptable and may not be included in newsprint bundles. Plastic bags or saran wrap are not acceptable except as packaging as noted below.
2. 
Cardboard must be completely flattened and tied in bundles of not more than forty (40) pounds.
3. 
Plastic bottles and jugs numbered 1 and 2 only must be rinsed in hot water at least twice, drained and flattened as much as possible and secured in plastic bags.
4. 
Aluminum cans must be emptied completely, crushed or flattened as much as is possible and secured in plastic bags.
