The following words, when used in this Article, shall have the
meanings set out herein:
PRIVATE SWIMMING POOL
A swimming pool designed, constructed, installed and maintained
for use by the owner and/or tenant and their guests.
PUBLIC SWIMMING POOL
A swimming pool designed, constructed, installed and maintained
for use by the general public, except those owned by the City.

A. Swimming
pools either public or private shall be considered as accessory structures
to the main building when they are added to an existing development
and shall comply with all provisions, rules and/or regulations heretofore
and/or herein set forth.
B. Swimming
pools either public or private that are a part of the original development's
plans and specifications shall comply with all provisions, rules and/or
regulations heretofore and/or herein set forth.
C. A container
(wading pool) that is twenty-four (24) inches or less in depth and
having a surface area of two hundred fifty (250) square feet or less
shall not be subject to the rules and regulations of this Article.
D. Zoning.
1. Public swimming pools shall be allowed in "C-1" and "C-2" classifications
only.
2. Private swimming pools shall be allowed in all zoning classifications.

A. Private
swimming pools shall be located in rear and/or side yards only.
B. No
wall, pump, tank or other equipment, except walkways, that is an integral
part of the pool shall be located nearer than six (6) feet to the
nearest property line of the property on which the pool is located.
C. Walks
and walkways around the swimming pool's perimeter shall not be more
than four (4) feet in width.
