A certain document, one (1) copy of which is on file in the office of the City Clerk of the City of Platte City, being marked and designated as the International Building Code, 2018 Edition, including Appendix C, I and K, as published by the International Code Council, be and is hereby adopted as the Building Code of the City of Platte City in the State of Missouri; for regulating and governing the conditions and maintenance of all property, buildings and structures; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use and the demolition of such structures as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Building Code on file in the office of the City Clerk of the City of Platte City is hereby referred to, adopted and made a part hereof, as if fully set out in this Article, with the additions, insertions, deletions and changes, if any, prescribed in Section
500.020 of this Article.

A. The following Sections of the International Building Code adopted
in this Article are hereby revised:
1.
[A] 101.1 Title. Insert:
These regulations shall be known as the Building Code of the
[City of Platte City], hereinafter referred to as "this code."
2.
[A] 105.1.1. Annual permit. Delete

[A] 105.1.2. Annual permit records. Delete
4.
[A] 105.2 Work exempt from permit. Amend:
Exemptions from permit requirements of this code shall not be
deemed to grant authorization for any work to be done in any manner
in violation of the provisions of this code or any other laws or ordinances
of this jurisdiction. Permits shall not be required for the following:
Building:
|
1.
|
Retaining walls that are not over four (4) feet in height measured
from the bottom of the footing to the top of the wall, unless supporting
a surcharge or impounding Class I, II or IIIA liquids.
|
2.
|
Sidewalks and driveways not more than thirty (30) inches above
adjacent grade, and not over any basement or story below and are not
part of an accessible route and are not located within the City or
State rights-of-way. (Work performed in the City's right-of-way requires
a ROW permit).
|
3.
|
Painting, papering, tiling, carpeting, cabinets, counter tops
and similar finish work.
|
4.
|
Temporary motion picture, television and theater stage sets
and scenery.
|
5.
|
Prefabricated swimming pools accessory to a Group R-3 occupancy
that are less than [36 inches] deep, are not greater than five thousand
(5,000) gallons and are installed entirely above ground.
|
6.
|
Shade cloth structures constructed for nursery or agricultural
purposes, not including service systems.
|
7.
|
Swings and other playground equipment accessory to detached
one- and two-family dwellings.
|
8.
|
Window awnings in Group R-3 and U occupancies, supported by
an exterior wall that do not project more than 54 inches from the
exterior wall and do not require additional support.
|
9.
|
Non-fixed and movable fixtures, cases, racks, counters and partitions
not over five (5) feet nine (9) inches in height.
|
Electrical:
|
1.
|
Repairs and maintenance: Minor repair work, including
the replacement of lamps or the connection of approved portable electrical
equipment to approved permanently installed receptacles.
|
2.
|
Radio and television transmitting stations: The
provisions of this code shall not apply to electrical equipment used
for radio and television transmissions, but do apply to equipment
and wiring for a power supply and the installations of towers and
antennas.
|
3.
|
Temporary testing systems: A permit shall not be
required for the installation of any temporary system required for
the testing or servicing of electrical equipment or apparatus.
|
Gas:
|
1.
|
Portable heating appliance.
|
2.
|
Replacement of any minor part that does not alter approval of
equipment or make such equipment unsafe.
|
Mechanical:
|
1.
|
Portable heating appliance.
|
2.
|
Portable ventilation equipment.
|
3.
|
Portable cooling unit.
|
4.
|
Steam, hot or chilled water piping within any heating or cooling
equipment regulated by this code.
|
5.
|
Replacement of any part that does not alter its approval or
make it unsafe.
|
6.
|
Portable evaporative cooler.
|
7.
|
Self-contained refrigeration system containing 10 pounds (4.54
kg) or less of refrigerant and actuated by motors of 1 horsepower
(0.75 kW) or less.
|
Plumbing:
|
1.
|
The stopping of leaks in drains, water, soil, waste or vent
pipe; provided, however, that if any concealed trap, drain pipe, water,
soil, waste or vent pipe becomes defective and it becomes necessary
to remove and replace the same with new material, such work shall
be considered as new work and a permit shall be obtained and inspection
made as provided in this code.

|
The clearing of stoppages or the repairing of leaks in pipes,
valves or fixtures and the removal and reinstallation of water closets,
provided such repairs do not involve or require the replacement or
rearrangement of valves, pipes or fixtures.
|
5.
[A] 107.3.1 Approval of construction documents. Amend:
When the Building Official issues a permit, the construction
documents shall be approved, in writing or by stamp, as "Reviewed
for Code Compliance and Subject to Field Inspections." One (1) set
of construction documents so reviewed shall be retained by the Building
Official. The other set shall be returned to the applicant, shall
be kept at the site of work and shall be open to inspection by the
Building Official or a duly authorized representative. Electronic
plan submission is at the discretion of the Building Official.
6.
[A] 109.2 Schedule of permit fees. Amend:
On buildings, structures, electrical, gas, mechanical and plumbing systems or alterations requiring a permit, a fee for each permit shall be paid as required, in accordance with the [permit fee schedule] as established in Section
500.510 of the Platte City Municipal Code.
7.
[A] 109.4 Work commencing before permit issuance. Amend:
Any person who commences any work on a building, structure, electrical, gas, mechanical or plumbing system before obtaining the necessary permits shall be subject to a fee [double] the required permit fee as established in Section
500.510 of the Platte City Municipal Code.
8.
406.3.2.1 Dwelling unit separation. Amend:
The private garage shall be separated from the dwelling unit
and its attic area by means of gypsum board, not less than [5/8 inch]
in thickness, applied to the garage side. Garages beneath habitable
rooms shall be separated from all habitable rooms above by not less
than a 5/8-inch Type X gypsum board or equivalent and [5/8 inch] Type
X gypsum board applied to structures supporting the separation from
habitable rooms above the garage. Door openings between a private
garage and the dwelling unit shall be equipped with either solid wood
doors or solid or honeycomb core steel doors not less than 1-3/8 inches
in thickness, or doors in compliance with Section 716.2.2.1 with a
fire protection rating of not less than twenty (20) minutes. Doors
shall be self-closing and self latching.
9.
1008.3.3 Rooms and spaces. Amend:
In the event of power supply failure, an emergency electrical
system shall automatically illuminate all of the following areas:

1612.3 Establishment of flood hazard areas. Insert
date:
To establish flood hazard areas, the applicable governing authority
shall adopt a flood hazard map and supporting data. The flood hazard
map shall include, at a minimum, areas of special flood hazard as
identified by the Federal Emergency Management Agency in an engineering
report entitled "The Flood Insurance Study for [City of Platte City],"
dated [April 2, 2015], as amended or revised with the accompanying
Flood Insurance Rate Map (FIRM) and Flood Boundary and Floodway Map
(FBFM) and related supporting data along with any revisions thereto.
The adopted flood hazard map and supporting data are hereby adopted
by reference and declared to be part of this Section.
11.
[P] 2901.1 Scope. Delete the following from the
code Section:
Private sewage disposal systems shall conform to the International
Private Sewage Disposal Code.

Nothing in this Article or in the International Building Code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited in Section
500.040 of this Article; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this Article.

All other ordinances or parts of ordinances in conflict herewith
are hereby repealed.

Any person who shall violate a provision of the code adopted
in this Article or shall fail to comply with any of the requirements
thereof or who shall erect, construct, alter or repair a building
or structure in violation of an approved plan of or directive of the
Code Official, or of a permit or certificate issued under the provision
of this code, shall be guilty of a misdemeanor, punishable by a fine
as follows: for municipal ordinance violations committed within a
twelve-month period beginning with the first violation: two hundred
dollars ($200.00) for the first municipal ordinance violation, two
hundred seventy-five dollars ($275.00) for the second municipal ordinance
violation, three hundred fifty dollars ($350.00) for the third municipal
ordinance violation, and four hundred fifty dollars ($450.00) for
the fourth and any subsequent municipal ordinance violations; Each
day that a violation continues after due notice has been served shall
be deemed a separate offense.
