A. There is hereby established by the City of Platte City a sidewalk
replacement incentive program. The purpose of this program is to encourage
property owners to replace or install commercial and/or residential
sidewalks within the City of Platte City, and for the purpose of setting
up an agreement regarding cost sharing and cooperation between the
City and residents and businesses for the purpose of establishing
new sidewalks or replacing existing sidewalks.
B. Residential participants have the option of selecting either the
reimbursable program or the prepaid program. Commercial participants
are eligible only for the prepaid program.
C. In order to be eligible for City cost-share funding, the property
owner must receive prior written approval from the Public Works Director
before commencing work.
D. The program is subject to annual appropriations with funds available
on a first-come, first-served basis each year.
E. The Board of Aldermen must review and are the sole approval authority
for all commercial sidewalk replacement incentive agreements and any
residential sidewalk replacement when the City share is estimated
at greater than one thousand dollars ($1,000.00). The City Administrator
may approve those residential sidewalk projects when the City share
is estimated at one thousand dollars ($1,000.00) or less. The Public
Works Director may approve residential sidewalk projects when the
City share is estimated at five hundred dollars ($500.00) or less.
F. The program is not available to property owners where sidewalks are
required as a part of the City's current site development standards,
i.e., existing or new undeveloped lots.

A. Under the reimbursable program option, the property owner is responsible
for all aspects of the sidewalk demolition and construction. Upon
City inspection and approval of the work, the City shall reimburse
the property owner a portion of the project cost as calculated in
Subsection (c) below. The prepaid program is available to both residential
and commercial property owners.
B. To participate in the program, the property owner must file for a
sidewalk construction permit from the City. The City will provide
this permit to eligible projects at no cost to the applicant. The
applicant must also apply for the sidewalk replacement incentive program.
Applicants who initiate work prior to receiving City approval shall
not be eligible for reimbursement.
C. Reimbursement amount shall be calculated on a per-square-foot basis.
Reimbursement amount per square foot shall be recalculated, established
and published by the City at least one (1) time each calendar year.
The per-square-foot reimbursement rate shall equal the calculated
cost to purchase and deliver one (1) square foot of concrete from
the nearest concrete plant to Platte City based on standard short
load rate. Property owners who disagree with the City's reimbursement
rate may appeal the calculation to the Board of Aldermen. Work which
commences or occurs on a property while that property owner is appealing
the rate calculation shall not be eligible for reimbursement.
D. The reimbursement program is to reimburse the property owner an amount
that is generally equal to the cost of concrete delivered to the site.
However, the amount reimbursed shall be based solely on the City's
published reimbursement rate.
E. The owner may choose to hire a contractor with a valid Platte City
business license or may choose to conduct the work himself or herself.
F. All work shall be performed to standards established by the City
for sidewalks; current standards are five-foot-wide sidewalks constructed
in accordance with APWA, KCMO chapter sidewalk construction standards.
Sidewalk width is to be the same width as to which it abuts.
G. The property owner must notify the City and ensure the City inspection
occurs when forms are complete but prior to pouring concrete and upon
project completion.

A. Under the prepaid program, the sidewalk demolition and reconstruction
work is performed by the City Public Works Department. Upon application
the City shall provide the property owner with an estimated cost for
the project. The owner's share of the project cost will be sixty
percent (60%) of the estimated project cost and shall be paid to the
City prior to commencement of any work. The prepaid program is available
to residential property owners only. Commercial property is not eligible
for this option.
B. The prepaid program is to provide a cost share for sidewalk replacement
in which City crews plan and implement the work equal to forty percent
(40%) of the project cost while the property owner contributes an
upfront payment equal to sixty percent (60%) of the estimated cost
of the project.
C. City participation will be provided on a first-come, first-served
basis, and will be subject to availability of Platte City Public Works
manpower.
D. Work completed by the Platte City Public Works Department shall carry
a two-year warranty.

A. Generally. Residential sidewalks are to be approved
prior to construction by the City. The specific approval authority
shall be determined by the estimated cost of the City share. The estimated
cost shall be calculated by the City prior to construction. It must
be inspected by a representative of the City, immediately prior to
and immediately after the pouring of the concrete for the sidewalk.
B. Standard For Determining Replacement. Sidewalks
to be replaced shall be inspected by authorized City personnel to
determine if the walk is in need of replacement. The structural integrity
and safety of the sidewalk's condition shall be the determining
factors when considering approval for the program.
C. Specifications shall be as follows: All sidewalks
shall be constructed of concrete, in accordance with the most recently
adopted Kansas City Chapter American Public Works Association Standard
Specifications and Criteria. Sidewalk width to be the same as the
sidewalk that it abuts (wider walks may be required in multifamily
areas).

A. The Board of Aldermen shall be the sole approval authority for commercial
sidewalk replacement incentive requests. Commercial sidewalk replacement
shall be eligible for the reimbursement program only. Upon completion
of all project requirements and work, the City shall reimburse the
property owner the City's calculated cost of concrete or 50%
of the project cost, whichever is lower.
B. All the requirements regarding the agreements, replacement, and specifications
as stated above, relative to residential sidewalks shall also apply
to commercial sidewalks and shall be required of the parties in the
same manner as residential. All sidewalks shall be constructed of
concrete, in accordance with the most recently adopted Kansas City
Chapter American Public Works Association Standard Specifications
and Criteria. Sidewalk width shall be the same as the sidewalk that
it abuts (wider walks may be required based upon existing walk widths,
design variables or as pedestrian traffic may dictate).

This program shall continue for so long as the City makes funds
and man hours available in its budget. The program may lapse prior
to the end of the fiscal year if all funds and man-hours in the budget
have been exhausted. Applications pending may be deferred to a subsequent
fiscal year when funding and man-hours are available.

As stated in Section
525.040, prior approval by the City for participation in the program must be obtained by the residential property owner or commercial property owner prior to construction of the sidewalk in order to be eligible for this program.

Failure to comply with the above-stated specifications, and/or
to receive prior approval for the installation or replacement of sidewalks
within the City, will automatically disqualify the resident or business
seeking assistance from the City of any funding or participation from
the City.
