As used in this Chapter, the following terms shall have these prescribed meanings:
ADULT
Any person eighteen (18) years of age or over.
DAY CARE
The care of a child away from his/her own home for any part of the twenty-four (24) hour day for compensation or otherwise. Day care supplements parents' responsibility for the child's protection, development and supervision. Day care may be given in a family home or a day care center.
DAY CARE CENTER[1]
A group program providing care for more than ten (10) children in a home occupied by the day care provider or more than four (4) children in a facility other than a family home for any part of the twenty-four (24) hour day.
DAY CARE FACILITY
A house or other place conducted or maintained by any person who advertises or holds himself/herself out as providing care for more than four (4) children during the daytime, for compensation or otherwise, except those operated by a school system or in connection with a business establishment which provides child care as a convenience for its customers or its employees for no more than four (4) hours per day, but a child-care facility shall not include any private or religious organization elementary or secondary school, a religious organization academic preschool or kindergarten for four (4) and five (5) year old children, a home school, as defined in Section 167.031, RSMo., a weekly Sunday or Sabbath school, a vacation Bible school or child care made available while the parents or guardians are attending worship services or other meetings and activities conducted or sponsored by a religious organization. If a facility or program is exempt from licensure based on the school exception established in this definition, such facility or program shall submit documentation annually to the department to verify its licensure-exempt status; except that, under no circumstances shall any public or religious organization elementary or secondary school, a religious organization academic preschool or kindergarten for four (4) and five (5) year old children, a home school, as defined in Section 167.031, RSMo., a weekly Sunday or Sabbath school, a vacation Bible school or child care made available while the parents or guardians are attending worship services or other meetings and activities conducted or sponsored by a religious organization be required to submit documentation annually to the department to verify its licensure-exempt status.
DAY CARE HOME[2]
A family home, occupied by the day care provider, in which care is given to not less than five (5) nor more than ten (10) children not related to the day care provider for any part of the twenty-four (24) hour day.
EVENING
Part of the twenty-four (24) hour day between 6:00 P.M. and 1:00 A.M.
FENCE
A chain link fence or a fence that is of strong, durable construction and free of potential hazards such as sharp points, wood splinters, etc. Fences which are painted shall be painted with lead-free paint.
INFANT
Any child under the age of twelve (12) months.
PRESCHOOL CHILD
Any child between two (2) years and six (6) years not in school.
RELATED
Any of the following relationships by marriage, blood or adoption between the provider and the children in care: parent, grandparent, great-grandparent, brother, sister, stepparent, stepbrother, stepsister, uncle, aunt, niece, nephew or cousin of the first degree.
SCHOOL-AGE CHILD
Any child five (5) years or older in school.
TODDLER
Any child age twelve (12) months to twenty-four (24) months.
