It shall be unlawful for any person to operate a motor vehicle upon any street within the corporate limits of the City of Poplar Bluff, Missouri, that is maintained and repaired by the City of Poplar Bluff, Missouri, after said person has been advised by the City Manager or his/her agent that said person's motor vehicle use of said street or streets is resulting in extraordinary and unwarranted damage to said street.

The City Manager shall give reasonable notice to any person violating the provisions of Section 510.750. Prior to such reasonable notice, the City Manager shall consult with the City Engineer or other designated official and the Superintendent of the City Street Department. The street or streets in question shall be examined in person by the City Manager or his/her agent. The City Manager shall consider the composition of the street, the age of the street and the extent and nature of the projected extraordinary and unwarranted damage. The City Manager shall not issue the notice provided for in Section 510.750 if either the City Engineer or other designated official or the Superintendent of the City Street Department is of the opinion that the street in question is not being extraordinarily and unwarrantedly damaged or will not be so damaged by the predicted use.

In the event that the City Manager gives notice as provided for in Section 510.750, the City Manager, the City Engineer or other designated official and the Superintendent of the City Street Department shall reasonably endeavor to establish for the person seeking to operate the motor vehicle on said street or streets an alternative route to his/her destination. In the event that no alternative route can be established, the City Manager shall immediately designate said City street or streets as a street or streets for passenger vehicles only and said designation shall remain in force and effect until such time as the street or streets in question is repaired and will not be extraordinarily and unwarrantedly damaged by the predicted use.

Any person or persons violating the provisions of Section 510.760 shall be deemed guilty of an ordinance violation and punishable according to this Code of Ordinances.
