A. The
City of Pagedale, Missouri hereby approves, accepts, and adopts all
terms and provisions of the City of Pagedale Personnel Practices Manual
("Manual") on file in the City offices.
B. The
terms set forth in the manual apply to all City employees, including
employees and/or officers of the City of Pagedale Police Department.
C. The
terms of the manual shall be read in conjunction with the terms of
any existing and applicable Pagedale Police Department employee manual
and/or the Pagedale City Code.
D. Should
there exist a conflict between any terms/policies set forth in the
manual, a pre-existing Pagedale Police Department employee manual
and/or the Pagedale City Code, upon a written request from a complaining
party, the Board members of the City of Pagedale, Missouri, shall
decide, with approval from the Mayor, which terms/policy/manual shall
apply.
E. The
City of Pagedale reserves the right to amend the manual as is necessary.

A. It
is hereby declared to be the policy and purpose of the City to extend
to all eligible employees and officials of said City who are not excluded
by law or by this Chapter and whether employed in connection with
a governmental or proprietary function of said City, the benefits
of the system of Federal Old-Age and Survivors Insurance as authorized
by the Social Security Act Amendments of 1950 and by Senate Committee
substitute for Senate Bill No. 3 of the 66th General Assembly of the
State of Missouri and amendments thereof, as the same may be now and
hereafter in effect.
B. The Mayor and City Clerk of the City are hereby authorized and directed on behalf of this City to prepare, execute and submit to the Division of Budget and Comptroller of the State of Missouri, as State agency of the State of Missouri, a plan and agreement for extending said benefits to said eligible employees and officials of the City of Pagedale, Missouri, in the form prepared by the State agency and hereby approved and adopted by the Board of Alderpersons of this City, which plan and agreement are to become effective upon approval thereof by the State agency and are further authorized and directed to execute agreements and modifications and amendments thereof with said State agency, providing for the extensions of said benefits to said employees and officials as set forth in said plan and agreement as provided for in Subsection
(A) hereof, said plan and agreement to provide that said extension of benefits is to be effective on April 1, 1953.
C. Commencing
on the first (1st) day of the month following the date of the approval
of the plan and agreement of this City by the State agency, there
shall be deducted from the wages of all employees and officials of
the City of Pagedale, Missouri, to whom the benefits of said system
of Federal Old-Age and Survivors Insurance are extended by virtue
of the plan and agreement herein above provided for, the amount of
each of said employees' and officials' contributions, as determined
by the applicable State and Federal laws and by said plan and agreement,
the aggregate amount of said deductions to be paid into the Contributions
Fund created by Senate Committee substitute for Senate Bill No. 3
of the 66th General Assembly of the State of Missouri; provided however,
that from the first (1st) payment of wages made to each of said employees
and officials after the benefits of said system have been extended
to such employees and officials, there shall be deducted a sum equal
to the amount which would have been due and payable from each of said
employees and officials had said extension of benefits been provided
and effective on April 1, 1953.
D. Commencing
on the first (1st) day of the month following the date of the approval
of the plan and agreement of the plan and agreement of this City by
the State agency, there is hereby authorized to be appropriated from
the General Fund of the City of Pagedale, Missouri, and there is and
shall be appropriated the sum or sums of money necessary to pay the
contributions of the City of Pagedale, Missouri, which shall be due
and payable by virtue of the extensions of the benefits of the Federal
Old-Age and Survivors Insurance System to the eligible employees and
officials of said City, said sum or sums of money to be paid into
the Contributions Fund created by Senate Committee substitute for
Senate Bill No. 3 of the 66th General Assembly of the State of Missouri;
provided however, that in making the first (1st) payment to said Contributions
Fund, after the benefits of said system have been extended to such
employees and officials, said first (1st) payment shall include a
sum equal to the amount which would have been due and payable had
said extension of benefits been provided and effective on April 1,
1953. The fund from which said appropriation is made will, at all
times, be sufficient to pay the contributions of the City by this
Section directed to be paid to said Contributions Fund.
E. The
City of Pagedale, Missouri, from and after the approval of the plan
and agreement of this City by the State agency, shall fully comply
with and shall keep such records, make such reports and provide such
methods of administration of said plan and agreement as may be required
by all applicable State and Federal laws, rules and regulations now
and hereafter in effect with respect to the extension of the benefits
of the Federal Old-Age and Survivors Insurance System to the employees
and officials of this City. For the purpose of administering said
plan and agreement, the City Clerk of this City shall be the official
who shall make all required reports, keep all records and be responsible
for the administration of said plan and agreement on behalf of this
City and any and all notices and communications from the State agency
to this City with respect to said plan and agreement shall be addressed
to "City Clerk".

The City accepts the various provisions of Chapter 287, RSMo.,
being known as the Workers' Compensation Act and desires to be regarded
in law as an employer within the meaning of the said Act and proper
notice is lodged with the Workers' Compensation Commission of the
State of Missouri as fully as it may do under the law.

A. The
City of Pagedale hereby elects Benefit Program one and one-fourth
percent (1.25%) in accordance with the provisions of Section 70.655,
RSMo., as amended. The Clerk shall certify this election to the Missouri
Local Government Employees' Retirement System within ten (10) days
hereof. Such election shall be effective on the first (1st) day of
November, 1976.
B. In
accordance with the provisions of Sections 70.705 and 70.730, RSMo.,
the City of Pagedale hereby eliminates the current requirement for
its employees to self-contribute four percent (4%) of their gross
wages, so that from this time forward, its employees shall make no
self-contributions.

A. In
addition to any and all other compensation provided for each officer
or full-time employee of the City, the City shall maintain and pay
for such officer or employee the premium cost of a group life insurance
program in which each officer or employee may be enrolled as a member
with a recognized insurance company duly licensed to underwrite such
insurance plan in the State of Missouri and duly selected by said
City. After at least seventy-five percent (75%) of the City's Officers
and employees who are qualified for such insurance have elected in
writing to enroll and participate in such plan, the City shall enter
into a contract for such group insurance for the benefit of such officer
or employee with the minimum and maximum amount of coverage to be
set by said City based on a sliding scale in relation to each officer's
or employee's annual compensation rate.
B. The
cost to the City for such insurance under this Chapter shall be deemed
partial compensation for such officer's or employee's employment and
services to said City.
C. The
City is a political subdivision as defined in Sections 70.600 through
70.755, RSMo., and hereby elects to have covered by the Missouri Local
Government Employees' Retirement System all its eligible employees
in the following classes:
1. Present and future general employees (neither "Policeman" nor "Fireman"
as defined in the Act).
2. Policemen (as defined in the Act), including present and future Policemen.
a. The City hereby elects that one hundred percent (100%) of prior employment
be considered for prior service credit in computing benefits and contributions
to the system.
b. The City Treasurer is hereby authorized and directed to deduct from
the wages and salaries of each employee member the member contributions
required by Section 70.705, RSMo., and to promptly remit the deductions
to the Retirement System, together with the employer contributions
required by Section 70.730, RSMo. Employee and employer contributions
are to be effective March 1, 1972.
D. The
City of Pagedale hereby elects Benefit Program L-3 (one and one-fourth
percent (1.25%)) in accordance with the provisions of Section 70.655,
RSMo., as amended. The Clerk shall certify this election to the Missouri
Local Government Employees' Retirement System within ten (10) days
hereof. Such election shall be effective on the first (1st) day of
January, 1976.

A. Effective
the beginning of the next Pagedale City employee payroll, any full-time
salaried employee who does not work at least eighty (80) hours in
a two (2) week pay period shall be paid at the hourly rate for his/her
position for the actual number of hours worked.
B. Hours
used in computing total number of hours worked shall include excused
absences from work such as sick leave, vacation leave, funeral leave,
military duty, special training assignments and holidays.

A. There
is hereby adopted an "Alcohol and Controlled Substance Use, Abuse
and Testing Policy", a copy of which is adopted by reference and is
on file in the office of the City Clerk.
B. The
appropriate City Officials are hereby directed and authorized to implement
said "Alcohol and Controlled Substance Use, Abuse and Testing Policy"
pursuant to its terms and intents.

A. For
all purposes of this policy, the term "controlled substance" shall mean any narcotic drug, marijuana or other drug or compound
as defined by 21 U.S.C-802 or as controlled, banned or the possession
or use of which constitutes an offense pursuant to State or local
law.
B. It
shall be the policy of the City to require pre-employment testing
for controlled substances by all potential City employees.
C. Any
employee involved during the course of his/her employment by the City:
1. As the driver of a motor vehicle involved in an accident causing
any property damage or physical injury;
2. Who is involved in any altercation during which physical contact
occurs between the party and any other individual (excepting Police
Officers using only reasonable and necessary force in the apprehension
and arrest of a criminal suspect) shall immediately report any such
incident set forth in above (1) or (2) to his/her supervisor and shall
immediately submit to controlled substance and/or alcohol testing
as shall be directed by said supervisor. It is the policy of the City
that all employment supervisors of the City shall direct any employee
involved in any such incident to submit to controlled substance and/or
alcohol testing at such facility, in such manner and at such time
as the employee's supervisor and/or testing facility selected by the
City shall direct.
D. If
at any time any City employee shall by act, deed, statement or omission
display to his/her supervisor behavior then constituting probable
cause to believe that such employee is under the influence of a controlled
substance and/or alcohol, said employee's supervisor shall direct
said employee to submit to controlled substance and/or alcohol testing
at such facility, in such manner and at such time as the employee's
supervisor and/or the testing facility selected by the City shall
direct.
E. Any
City employee who fails to submit to a test for the presence of a
controlled substance or alcohol as herein described and in the manner
directed by his/her supervisor shall be subject to disciplinary action,
including immediate termination.

A. The City of Pagedale may provide a group medical insurance plan for
all full-time permanent employees.
B. The City of Pagedale will not cover any additional health insurance
costs and/or premiums incurred relating to any full-time employee
and/or any dependent of said employee.
C. Each full-time employee of the City of Pagedale is responsible for
any and all additional cost and/or premium associated with the use
of tobacco by said employee and/or a dependent of said employee.
D. Effective when the insurance company bills the City a higher amount
for tobacco users, all additional cost(s) and/or premium(s) relating
to the use of tobacco by any full-time employee and/or a dependent
of said employee shall be automatically withdrawn from each employee's
paycheck and shall be subsequently automatically withdrawn each pay
period.
E. The City of Pagedale, Missouri, reserves the right to revise the
amount of withdrawal for each full-time employee in the future depending
upon the rise in health care costs and additional coverage and premium
costs for employees and their dependents that use tobacco and/or the
overall financial status of the City of Pagedale, Missouri.
