The purpose of this chapter is to authorize public servants
of the Town of Penfield to issue and serve appearance tickets in connection
with violations of state statutes, local laws, ordinances or rules
and regulations of the Town which the public servants are authorized
to enforce.
As defined in New York Criminal Procedure Law § 1.20(26),
"appearance ticket" means a written notice issued by a public servant,
more fully defined in Criminal Procedure Law § 150.10, requiring
a person to appear before a local criminal court in connection with
an accusatory instrument to be filed against him or her therein.
Appearance tickets issued hereunder shall conform in form and
content to the requirements of Criminal Procedure Law § 150.10
as it now exists or may hereafter be amended.
The following public servants of the Town of Penfield are hereby
authorized to issue and serve appearance tickets with respect to violations
of a state statute, a local law, ordinance, rule or regulation of
the Town of Penfield which such public servants are, respectively,
required or authorized to enforce:
A. Director
of Public Works.
B. Building
Inspector/Zoning Administrator.
C. Building/Code
Compliance Inspector.
D. Assistant
Building/Code Compliance Inspector.
F. Dog/Animal
Control Officer.
H. Any
other public servant of the Town of Penfield who, by virtue of office,
title or position is authorized or required to enforce any state statute,
local law, ordinance, rule or regulation of the Town of Penfield.
Any authorized public servant may issue and serve an appearance
ticket in the lawful enforcement of any state statute, local law,
ordinance, rule or regulation of the Town of Penfield.
