The driver of any vehicle other than one on official business
shall not follow any fire apparatus traveling in response to a fire
alarm closer than five hundred (500) feet or drive into or park such
vehicle within the block where fire apparatus has stopped in answer
to a fire alarm.
No vehicle shall be driven over any unprotected hose of a Fire
Department when laid down on any street or private driveway to be
used at any fire or alarm of fire, without the consent of the Fire
Department official in command.
Each driver in a funeral or other procession shall drive as
near to the right-hand edge of the roadway as practicable and shall
follow the vehicle ahead as close as is practicable and safe.
A funeral composed of a procession of vehicles shall be identified
as such by the display upon the outside of each vehicle of a pennant
or other identifying insignia or by such other method as may be determined
and designated by the Police Department.
No funeral, procession or parade containing two hundred (200)
or more persons or fifty (50) or more vehicles except the forces of
the United States Army or Navy, the military forces of this State
and the forces of the Police and Fire Departments shall occupy, march
or proceed along any street except in accordance with a permit issued
by the Chief of Police and such other regulations as are set forth
herein which may apply.
The driver of a vehicle shall not drive within any sidewalk
area except on a permanent or temporary driveway.
The driver of a vehicle shall not back the same unless such
movement can be made with reasonable safety and without interfering
with other traffic.
No person shall open the door of a motor vehicle on the side
available to moving traffic unless and until it is reasonably safe
to do so, nor shall any person leave a door open on the side of a
motor vehicle available to moving traffic for a period of time longer
than necessary to load or unload passengers.
No person riding upon any bicycle, motorized bicycle, coaster,
roller skates, sled or toy vehicle shall attach the same or himself/herself
to any vehicle upon a roadway.
No person shall drive a vehicle onto or from any controlled
access roadway except at such entrances and exits as are established
by public authority.
It shall be unlawful for the directing officer or the operator
of any railroad train to direct the operation of or to operate the
same in such a manner as to prevent the use of any street for purposes
of travel for a period of time longer than five (5) minutes; provided
that this Section shall not apply to a moving train or to one stopped
because of an emergency or for repairs necessary before it can proceed
safely.
No vehicle shall at any time be driven through or within a safety
zone.

A. Every
person operating or driving a motor vehicle upon the roadways or highways
within the City of Foristell shall observe and comply with the rules
of the road, pursuant to the provisions of Section 304.012, et seq.,
RSMo., as amended, and shall drive the vehicle in a careful and prudent
manner and at a rate of speed so as not to endanger the property of
another or the life or limb of any person and shall exercise the highest
degree of care, and keep a lookout ahead.
B. Missouri
Cities of the Fourth Class, Foristell being such, have the authority
to regulate traffic on their streets and highways and to prevent practices
or amusements therein likely to result in damage to any person or
property, and to punish violations pursuant to Section 79.410, RSMo.,
as amended.
C. Except
as otherwise provided in this Section, no person operating a moving
motor vehicle upon the streets and highways within the City of Foristell
shall, by means of a handheld electronic wireless communication device,
send, read, or write a text message or electronic message, or read
a book or newspaper. This preoccupation constitutes inattentive, careless
and imprudent driving.
D. The
provisions of this Section shall not apply to a person operating:
1. An authorized emergency vehicle; or
2. A moving motor vehicle while using a handheld electronic wireless
communications device to:
b. Summon medical or other emergency help;
c. Prevent injury to a person or property; or
d. Relay information between a transit or for-hire operator and that
operator's dispatcher, in which the device is permanently affixed
to the vehicle.
E. Nothing
in this Section shall be construed or interpreted as prohibiting a
person from making or taking part in a telephone call, by means of
a handheld electronic wireless communications device, while operating
a motor vehicle upon the roadways or highways of the City of Foristell.
F. As
used in this Section, "electronic message" means
a self-contained piece of digital communication that is designed or
intended to be transmitted between handheld electronic wireless communication
devices. "Electronic message" includes, but is not limited to, electronic
mail, a text message, an instant message, or a command or request
to access an Internet site.
G. As
used in this Section, "handheld electronic wireless communications
device" includes any handheld cellular phone, palm pilot, blackberry,
or other mobile electronic device used to communicate verbally or
by text or electronic messaging, but shall not apply to any device
that is permanently embedded into the architecture and design of the
motor vehicle.
H. As
used in this Section, "making or taking part in a telephone
call" means listening to or engaging in verbal communication
through a handheld electronic wireless communication device.
I. As
used in this Section, "send, read, or write a text message
or electronic message" means using a handheld electronic
wireless telecommunications device to manually communicate with any
person by using an electronic message. Sending, reading, or writing
a text message or electronic message does not include reading, selecting,
or entering a phone number or name into a handheld electronic wireless
communications device for the purpose of making a telephone call.
J. A violation
of this Section shall be deemed an infraction and shall constitute
a moving violation as careless and imprudent driving for purposes
of point assessment under Section 302.302, RSMo. That any person found
to be in violation of the provisions of this Section shall be subject
to a fine of up to five hundred dollars ($500.00) or confinement in
jail for up to ninety (90) days, or to both such fine and imprisonment.
K. The
provisions of this Section shall not apply to:
1. The operator of a vehicle that is lawfully parking or stopped;
2. Any of the following while in the performance of their official duties:
a Law Enforcement Officer; a member of a Fire Department; or the operator
of a public or private ambulance;
3. The use of factory-installed or aftermarket global positioning systems
(GPS) or wireless communications devices used to transmit or receive
data as part of a digital dispatch system;
4. The use of voice-operating technology;
5. The use of two-way radio transmitters or receivers by a licensee
of the Federal Communications Commission in the Amateur Radio Service.
The driver of a vehicle shall not follow another vehicle more
closely than is reasonably safe and prudent, having due regard for
the speed of such vehicle and the traffic upon and the condition of
the roadway. Vehicles being driven upon any roadway outside of a business
or residence district in a caravan or motorcade, whether or not towing
other vehicles, shall be so operated, except in a funeral procession
or in a duly authorized parade, so as to allow sufficient space between
each such vehicle or combination of vehicles as to enable any other
vehicle to overtake or pass such vehicles in safety. This Section
shall in no manner affect Section 304.044, RSMo., relating to distance
between trucks traveling on the highway.

A. The
Mayor and Board of Aldermen being first duly assembled at a regular
meeting of the Board of Aldermen on June 18, 2018, recognize the need
to protect streets for the public's safety, pursuant to Sections 79.410
and 304.310, RSMo.
B. The
Board is aware that due to the heavy truck and equipment traffic on
Cotton Road between Schultz Road and the North Service Road, the City
has had to close the road on numerous occasions to complete major
repairs to insure the safety of local residential and school traffic.
C. It
shall be unlawful to operate on, over or across Cotton Road any double
axel motor vehicle or truck with a vehicle weight license over thirteen
(13) tons prior to obtaining a special use permit from the City of
Foristell. The special use permit will require the posting of an appropriate
bond as determined necessary by the City as a guarantee that this
public road will be maintained and restored to the same condition
as at the time that the special use permit is approved. The prohibition
shall not apply to a vehicle or truck involved with farming or agriculture
industry that has property on Cotton Road. Further, the prohibition
shall not apply to delivery vehicles or trucks to residential properties
or commercial businesses that use Cotton Road as the only access to
the property. A copy of the special use permit must be within all
vehicles or trucks required to have a special use permit, and the
City, will be allowed a reasonable fee for administrative review and
inspection of permit applications.
D. Any
operator of a motor vehicle in violation of this Section shall be
subject, upon conviction, to the payment of a fine of up to five hundred
dollars ($500.00) and/or imprisonment in the County jail for up to
ninety (90) days, or both such fine and imprisonment.
