The division of a lot in a recorded platted area is prohibited
unless approved following an application to the City Council. The
application shall be filed with the City Clerk and shall state the
reasons for the proposed division.

After review and recommendation of the application for a lot
split, the Planning Commission shall refer the matter to the City
Council.

If the proposed lot division is for the purpose of construction
of a residence, then the applicant shall submit verification from
the county health department that the ground is suitable for building
purposes if there is no sanitary sewer available.

No building permit shall be issued and no construction shall
commence prior to the City Council's approval.

No lot in a recorded platted area shall be divided into more than four parts and the resulting lots shall not be less in area than permitted by Chapter
86 of this Code, pertaining to zoning.

Any of the violations enumerated in this article is a separate
offense, is a nuisance per se immediately enjoinable in the circuit
courts, and is punishable by a fine of not to exceed $100 or imprisonment
in the county jail for a period not exceeding 90 days, or both such
fine and imprisonment.
