No person under the age of 18 years of age shall remain in or upon the public streets, highways, roads, parks, playgrounds or other public grounds, public places and public buildings between the hours of 9:00 p.m. and 1/2 hour after sunrise, prevailing local time, on the 30th and 31st days of October in each year. Failure to leave after warning by a police officer of the Township of Washington shall constitute a violation of this chapter, subject to the penalties provided.
No person shall be considered in violation of this chapter:
A. 
When accompanied by a parent, guardian or adult having legal care and custody of such minor.
B. 
When the minor is upon an emergency errand directed by his or her parent or guardian or other adult having care and custody.
C. 
When the minor is en route to or returning directly home from school, a meeting, entertainment, recreational activity, dance, employment, religious ceremony or any other lawful activity.
In the event of an outbreak of, or threat of an imminent outbreak of, violence or acts of vandalism or injury, damage, danger to persons or property committed by persons under the age of 18 years of age, the Mayor may declare a state of emergency and impose a curfew for persons under the age of 18 years of age. Such curfew shall not exceed a consecutive period of 72 hours and shall be subject to the exceptions set forth under § 184-2. Such curfew shall be applicable to all places set forth in § 184-1. Failure to leave after warning by a police officer of the Township of Washington shall constitute a violation of this chapter, subject to the penalties provided.

Any person who shall violate any provision of this chapter shall be subject to treatment as a juvenile delinquent or a juvenile in need of supervision pursuant to N.J.S.A. 2A:4A-45 and the rules of court pertaining thereto. Any juvenile who reaches the age of 18 years while an offense under this chapter is pending shall be subject to prosecution hereunder in the Municipal Court and, upon conviction, be punished as provided in § 1-1 of Chapter 1, General Provisions.
