Whenever the following words are used in this Part and in the
Fire Prevention Code, or any part thereof, they shall have the respective
meanings as follows:
APPROVED RATING BUREAU
A fire insurance rating and inspection bureau, department
or organization including, American Insurance Association, Factory
Insurance Association, Associated Factory Mutual Fire Insurance Companies,
Insurance Service Office and any other such organization duly approved
by resolution of the Borough Council of the Borough.
APPROVED SPRINKLER SYSTEM
An approved sprinkler system for fire protection purposes,
is an integrated system of underground and overhead piping designed
in accordance with fire protection engineering standards including
water supply, systematic pattern of piping valves and actuating devices
as prescribed by the National Fire Protection Association or any other
recognized Engineering Association that is accepted by an approved
Fire Insurance Rating Bureau, Department or Organization.
BASEMENT
A story, partly underground, the greater part of which is
above grade. A basement shall be counted as a story unless otherwise
specifically stated but shall exclude crawl space.
BUILDING OFFICIAL
Building Inspector of the Borough of Bristol, Bucks County,
Pennsylvania.
CELLAR
A story of which half or more is below grade.
CONVERTED
A change of use in a building from a use not requiring an
approved sprinkler system to a use requiring the installation of an
approved sprinkler system.
FIRE RESISTIVE BUILDING
A structure in which the walls are of approved masonry or
reinforced concrete and the structural members of which have fire
resistive ratings sufficient to withstand the hazard involved on the
occupancy, but not less than three-hour rating for fire walls, party
walls, isolated piers, columns, wall supporting girders, other wall
and girders, beams, floors, and roofs and a two-hour rating for fire
partitions in which all floor openings are protected by effective
fire resistance enclosures with approved fire doors.
HIGH HAZARD OCCUPANCY BUILDING
A building or structure used for the storage, manufacture,
processing, or sales of high combustible or explosive products or
materials which are likely to burn with extreme rapidity or which
may produce poisonous fumes or explosions; storage, manufacture, processing
or sales of highly corrosive, toxic or noxious alkalines, acids or
other liquids or chemicals involving flame, fume explosive, poisonous,
irritant or corrosive gases, and the storage, processing, manufacture
or sales of any materials involving explosive mixtures of dust or
which results in the division of matter into fire particles subject
to a dust explosion or spontaneous ignition.
MUNICIPALITY
Borough of Bristol, Bucks County, Pennsylvania.
SUBSTANTIALLY ALTERED
Any substantial structural alteration in or addition to the
supporting or structural members of a building or structure, such
as bearing walls, bearing columns, bearing beams, or bearing graders,
provided that a substantial alteration shall not include, inter alia,
repairs to roof, walls, or interior or exterior painting or redecoration,
elimination relocating or construction of new partitions within an
existing building, air conditioning, repairs or replacement of heating
systems, modernization of kitchens or bathrooms, including relocation
or replacement of utility lines, gas, sewer, water and electricity,
and installation or replacement of kitchen or bathroom equipment.

Prior to the installation, revision, addition or alteration
of any approved sprinkler or other fire protection equipment in any
structure, detailed plans thereof shall be first submitted to and
approved in writing by the representative appointed by resolution
of Borough Council for plan review and inspections.

1. Any person,
firm or corporation who shall violate any provision of this Part,
upon conviction thereof in an action brought before a magisterial
district judge in the manner provided for the enforcement of summary
offenses under the Pennsylvania Rules of Criminal Procedure, shall
be sentenced to pay a fine of not more than $1,000 plus costs and,
in default of payment of said fine and costs, to a term of imprisonment
not to exceed 90 days. Each day that a violation of this Part continues
or each section of this Part which shall be found to have been violated
shall constitute a separate offense.
2. In the
alternative, the Borough may pursue any civil action at law or equity
against any person, partnership or corporation who or which has violated
or permitted the violation of any of the provisions of this Part.
Upon being found liable therefor in a civil enforcement proceeding,
the defendant shall pay a judgment of not more than $1,000 plus all
court costs, including reasonable attorney fees incurred by the Borough
as a result thereof. Each day that a violation of this Part continues
which shall be found to have been violated shall constitute a separate
offense. All judgments, costs and reasonable attorney fees collected
for the violation of this Part shall be paid over to the Borough whose
ordinance has been violated.
