This Part is enacted to provide the uniform and equitable distribution of the tax levies in the Borough of Ben Avon and upon the inhabitants thereof and to promote the public health, safety and welfare of the inhabitants of the Borough of Ben Avon by insuring that all residential rental properties conform to the Borough's Property Maintenance Code [Chapter
5].

As used in this Part, the following terms shall have the meaning
indicated, unless a different meaning clearly appears from the context:
BUSINESS UNIT
A parcel of real estate, with or without improvements located
thereon, occupied or used by any person or persons for any activity
carried on or experienced for gain or profit.
DWELLING UNIT
One or more rooms used for living and sleeping purposes arranged
for occupancy by one or more persons.
LANDLORD
Any person who allows other persons to occupy or use real
estate or portions of real estate owned by, or in the control of the
landlord.
PERSON
Any individual, partnership, association, firm or corporation.
TENANT
A person who has the use, either by himself or with others,
of a dwelling unit or a business unit owned by another.

1. Within 90 days from the effective date of this Part, each landlord
of any real property located in the Borough shall submit to the Borough
Secretary a report on the form supplied by the Borough Secretary which
shall include the following information:
A. A list of the dwelling units and business units owned by the landlord,
located within the Borough of Ben Avon limits, whether occupied or
not occupied.
B. The street address of each dwelling unit and business unit.
C. The Allegheny County lot and block number of each parcel of real
estate upon which is located a rental dwelling unit and business unit.
D. Whether or not said dwelling unit or business unit is inhabited,
occupied or used by tenants.
E. The name and mailing address of each tenant inhabiting, occupying
or using each aforementioned dwelling unit or business unit, if any.
F. The name and address of each such tenant's employment.
G. The Social Security number of each such tenant.

After the effective date of this Part, any person who becomes a landlord shall, within 30 days thereafter, report to the Borough Secretary Manager the information and data set forth in §
11-103 above, and on forms to be provided by the Borough Secretary Manager.

After the effective date of this Part, each and every landlord
of real property within the Borough of Ben Avon shall report to the
Borough Secretary on a report form to be supplied by the Borough Secretary,
any change in the occupancy of any dwelling unit or business unit
owned by such landlord. The reported change shall include the information
required herein, together with the date when such changes were effective,
and the forwarding address of the previous tenant or tenants, if known.
In the event that a dwelling unit or business unit was used or utilized
by a tenant and then becomes vacant, this change shall also be reported
to the Borough Secretary. All reports required by this section shall
be made within 30 days after a landlord has knowledge that such a
unit has had a change in use or occupancy or has become vacant.
