There shall be a Director of Weights and Measures who shall be appointed by the Highway Director. The Director shall be directly responsible to the Highway Director for the implementation of policies established by the Tompkins County Legislature. The Director shall meet qualifications as prescribed by the local Civil Service Office and approved by the Tompkins County Legislature.
The Director of Weights and Measures shall have the power to appoint such deputies, assistants, and employees of the Department as may be necessary to perform the duties of the office of Director and as shall be authorized by the Tompkins County Legislature. Except as otherwise provided in this Charter, the Director of Weights and Measures shall have all the powers and perform all the duties now or hereafter conferred or imposed by law upon a Director of Weights and Measures. The powers and duties of the Director shall be to:
(a) 
Inspect, test, and ascertain, as frequently as prescribed by the State Commissioner of Agriculture and Markets, if weights and measures, weighing and measuring devices and systems, and accessories related thereto that are used commercially by any person, firm, or corporation, are correct and being used correctly;
(b) 
Weigh, measure, and inspect packaged commodities kept, offered, or exposed for sale, sold, or in the process of delivery, to determine whether such packages contain the amounts represented and whether they are kept, offered, or exposed for sale in accordance with state and local laws;
(c) 
Exercise all the powers and duties as authorized by law of the office of Director of Weights and Measures; have access to all places of business, buildings, or premises; and stop any vendor or dealer whatsoever for the purpose of making proper inspections and tests.
The Director shall also perform such other and related duties as may be required by the Tompkins County Legislature, provided such duties deal primarily with services designed to aid and protect the consumer.
