As used in this article, the following terms shall have the meanings indicated:
VILLAGE PARK
East Rockaway Memorial Park, McNulty Park, Minore Park, Oxbow Park, White Cannon Point Park, John Street Complex.
A. 
Littering. The throwing of litter, rubbish, garbage, cans, bottles or other refuse in the park or the scattering of any kind of rubbish, garbage, refuse, cans, bottles, debris or waste material of any sort in any Village park shall be an unlawful act.
B. 
Damaging of property. The picking of flowers, breaking of limbs of trees, shrubs, plants or the defacing of any buildings, structures or parts thereof, or damaging or breaking of any glass, railing or parts of any structures or buildings, or damaging flagpoles, lighting posts, fixtures, fences, benches, backstop or backstops, swings, slides, playground equipment or any other improvements erected or constructed within any Village park shall be an unlawful act.
C. 
Loitering. A person is guilty of loitering in a Village park when he:
(1) 
Loiters, remains or wanders about in a Village park for the purpose of tumultuous, violent or threatening conduct or when, being present at an assembly which either has become or becomes tumultuous, violent or threatening to members of the assembly or the public, he remains there with intent to advance that purpose; or
(2) 
Loiters, remains or wanders about in a Village park for the purpose of any activity which is intended to intimidate the public; or interferes with the free passage of another; or
(3) 
Loiters, remains or wanders about in a Village park for the purpose of the consumption of alcohol in a public place in violation of any local, state or federal law; or
(4) 
Loiters or remains in a Village park while consuming any alcoholic beverage; or
(5) 
Loiters or remains in a Village park while having in his possession an open or unsealed container of an alcoholic beverage for the purpose of consuming such alcohol by himself or by another in any public place; or
(6) 
Loiters, remains or wanders about in a Village park for the purpose of begging; or
(7) 
Loiters or remains in a Village park with one or more persons for the purpose of unlawfully using or possessing a controlled substance, as defined in Penal Law § 220.00.
A. 
The hours of operation for Village parks shall be limited to the following:
(1) 
East Rockaway Memorial Park: 7:00 a.m. to 9:00 p.m.
(2) 
McNulty Park: 5:00 a.m. to 9:00 p.m.
(3) 
Minore Park: 7:00 a.m. to 6:00 p.m.
(4) 
Oxbow Park: 7:00 a.m. to 6:00 p.m.
(5) 
White Cannon Point Park: 5:00 a.m. to 11:00 p.m.
(6) 
John Street Complex: 7:00 a.m. to 10:00 p.m.
B. 
No person, group, organization or any other entity shall be permitted to enter upon, use or in any way be within the boundaries of any Village park other than during the permitted hours of operation.
C. 
Upon application to the Board of Trustees, any person, group, organization or any other entity may apply for a permit waiving the requirements of this article. Such use shall be permitted only upon permission having been granted by the Board of Trustees, with whatever restrictions the Board shall deem advisable.

No picnic, field day, outing, carnival, concert, address, rally, dramatic presentation or the like shall be held or conducted in any park.

Any person committing an offense against any provision of this article shall, upon conviction thereof, be guilty of a violation pursuant to the Penal Law of the State of New York, punishable by a fine not exceeding $250 or by imprisonment for a term not exceeding 15 days, or by both such fine and imprisonment. The continuation of an offense against the provisions of this article shall constitute, for each day the offense is continued, a separate and distinct offense hereunder.
