The Borough publicly declares its intent to become an aggregator
of electric power on behalf of its residential users of electricity
pursuant to the Government Energy Act of 2003, N.J.S.A. 48:3-91.3
to 48:3-98, and implementing regulations.
The Borough will utilize approved vendors, Commercial Utility
Consultants, Inc., and Concord Energy Services, pursuant to the NJ
E-PROCUREMENT Pilot program (P.L. 2001, c. 30) under the New Jersey
Department of Community Affairs. The reverse energy auction will seek
bids from licensed and appropriate third-party suppliers. If such
winning bid is selected and agreement executed, individual residential
consumers would retain the option not to participate and to choose
any alternatives they desire.
The Mayor and Municipal Clerk/CFO are hereby authorized and
directed to execute any documents necessary to carry out the purpose
of this chapter.

The Council of the Borough of Brooklawn is authorized to become
a government aggregator of electric generation service and electric
service for residential and nonresidential customers' electric power
on behalf of its residential and nonresidential citizens.
The Borough of Brooklawn will follow the Government-Private
Aggregator Option Two of the BPU Government-Private Aggregator Program
pursuant to the rules and regulations of the New Jersey State Board
of Public Utilities.
The Mayor and Chief of Staff are hereby authorized to take any
and all steps to submit the necessary documentation to the New Jersey
Board of Public Utilities and to provide any and all notices to residential
customers to opt out of the program and to nonresidential customers
to opt in to the program.
The Borough of Brooklawn is a member of the Educational Services
Commission of New Jersey and they have followed the fair and open
process to select an energy service provider, Good Energy, L.P. ,to
perform the New Jersey BPU Aggregation Program adopted by N.J.A.C.
14:4-6 et seq.
The term of the agreement shall require the Borough of Brooklawn
Council to approve by resolution the extension of the service agreement
annually up to no more than five renewals.
