A. 
The Code Enforcement Officer of the Town of Mamakating shall have the authority to enforce the provisions of this chapter and to inspect premises within the Town as necessary for said enforcement.
B. 
The authority of the Code Enforcement Officer shall include authority to investigate complaints concerning alleged violations and issue notices to comply, orders of remedy, notices of violation and appearance tickets as deemed appropriate.
If the provisions of any article, section, subsection, paragraph, subdivision or clause of this chapter shall be judged invalid by a court of competent jurisdiction, such order of judgment shall not affect or invalidate the remainder of any article, section, subsection, paragraph, subdivision or clause of this chapter.
A. 
Any person, firm or corporation who violates the provisions of this chapter shall be guilty of an offense, punishable by a fine of not more than $250 or by imprisonment for not more than 15 days, or both such fine and imprisonment.
B. 
In addition to the above-provided penalty and punishment for violations of this chapter, the Town Board may also maintain an action or proceeding in the name of the Town in a court of competent jurisdiction to compel compliance with and/or to restrain by injunction any violation of this chapter.
C. 
In addition to and not in lieu of the above, in the event that any applicant, person, firm or corporation fails to comply with the terms of this local law or rules or regulations promulgated hereunder with respect to the location or construction of any street or driveway or fails to properly restore the Town highway right-of-way upon completion of work, the Town may, upon due notice, correct the work and/or restore the disturbed right-of-way at the cost and expense of the applicant and/or property owner. The total costs of the work performed by the Town, its employees, agents or contractors, including reasonable engineering and attorneys' fees, shall be billed to the applicant and/or property owner and, if not paid within 30 days, said cost shall be a lien on the property and shall be levied, assessed and collected in the same manner as real property taxes.
