The purpose of this article is to reduce the proximate exposure of the public, especially children, to the hazards and annoyance of tobacco and/or cannabis. Furthermore, this article is intended to reduce litter and possible contamination from discarded tobacco and/or cannabis material in public places and reduce the likelihood that young people will initiate their use.
Pursuant to the New York State Constitution, the Village Board of Trustees of Pulaski, New York, may adopt and amend laws pertaining to the protection, conduct, safety, health and well-being of the person and property in the Village. Similarly, the Village may enact and enforce any local law for the purpose pertaining to the preservation of order, peace and health and the safety and welfare of the Village and the inhabitants thereof.
Smoking, vaping, and/or chewing of tobacco and/or cannabis products is prohibited throughout the Village of Pulaski's facilities. This is to include all parks (North, South, Haldane, on the River Trail, Dunbar Field), in all buildings (wastewater treatment plant, Snow Memorial Building, DPW garage), by the gazebo (next to the River near the Maple Avenue parking lot) and the cemetery.
Any person who violates any provision of this article shall be subject to a fine of not more than $250 for each offense.
