Each hotel or motel owner must ensure that all employees and staff of the hotel or motel comply with the provisions of this Article 6.
(A) 
No hotel or motel may provide lodging at an hourly rate.
(B) 
No room in any hotel or motel may be rented more than once between the hours of 9:00 p.m. and 6:00 a.m. the next calendar day.
No hotel or motel operator or owner may rent a guest room to a person under the age of 21 unless the person is part of a group, convention, corporate meeting, pageant or other major booking subject to a group or event contract on file at the hotel or motel and available for immediate inspection by Village officials.
All hotels and motels which are not extended-stay hotels must provide housekeeping services, including, but not limited to, room cleaning, linen change and towel service, at least once every seven days, and before any new guest checks into a guest room.
(A) 
No hotel or motel operator or owner may allow a person to occupy a guest room for more than 30 consecutive days unless otherwise permitted in this Article 6. A person may not continue to occupy a guest room at a hotel or motel after occupying the guest room for 30 consecutive days without at least a two-day vacancy between stays.
(B) 
No hotel or motel operator or owner may allow any person to occupy any portion of a hotel or motel as their permanent residence or to utilize the hotel or motel address as their mailing address.
(C) 
Notwithstanding Sections 9-6-5(A) and 9-6-5(B) of this Code, a guest of a hotel or motel may occupy a guest room for more than 30 days or use the hotel or motel as a mailing address if:
(1) 
The hotel or motel is an extended-stay hotel, and either: i) also satisfies one or more of the exceptions set forth in Section 9-6-2(C)(2) through 9-6-5(C)(5) of this Code; or ii) the Chief of Police or their designee approves an extension of the guest's stay beyond 30 days;
(2) 
A written contract or documented agreement exists between a hotel or motel and a corporate or governmental organization to house persons associated with the organization;
(3) 
A guest is staying at a hotel or motel in order to visit an inpatient at a healthcare facility located within 10 miles of the hotel or motel;
(4) 
A guest has been displaced from their permanent residence by a natural disaster or fire, for which either the guest's insurance provider or a federal, state, or local agency has provided documentation showing that the guest's permanent residence is uninhabitable; or
(5) 
A guest is receiving emergency or transitional housing or shelter, pursuant to a contract between the hotel or motel and a governmental organization.
(D) 
All hotels and motels to which the Village issues a certificate of occupancy after September 1, 2022, must provide at least 1,000 square feet of common areas for recreational use by guests, which common areas may include, without limitation, swimming pools, fitness centers, patios, terraces, or other recreational facilities.
(A) 
Each hotel or motel operator or owner must immediately report to the Village Police Department all suspected or alleged violations of law occurring at the hotel or motel that were either witnessed or made known to them by an employee, guest or visitor of the hotel or motel.
(B) 
Every hotel and motel must provide a manager on duty or on-call at all times to assist, communicate with, and cooperate with law enforcement officials.
(C) 
Every hotel and motel must maintain an electronic guest registration system with records of all rental agreements and guest stays commenced within the prior 365-day period, and must make these records available to Village officials upon request and within a reasonable time.
(D) 
The following information must be recorded each time a guest checks into a hotel or motel:
(1) 
The full name, phone number, and home address of each overnight guest;
(2) 
The make, type, and license number of any vehicle parked by a guest within the hotel or motel or at any off-street parking lot under the control of the hotel or motel;
(3) 
The date and time of guest arrival, check-in, and anticipated check-out date;
(4) 
The number or other identifying symbol of the guest room or guest rooms rented;
(5) 
The rate charged and amount collected for rental of the guest room or rooms;
(6) 
The guest's method of payment; and
(7) 
Documentation used to verify a stay in excess of 30 consecutive days, if required pursuant to Section 9-6-5.
(E) 
Each hotel or motel operator or owner must require each guest to provide an identification document when checking in, and must maintain a record of every identification document related to a stay throughout the duration of the stay and for 180 days thereafter.
(F) 
No person may procure or provide lodging in any hotel or motel, or any services therefrom, through misrepresentation or production of false identification or identification which misrepresents the identity of the person procuring or providing lodging or services.
(A) 
No hotel or motel operator or owner may rent a guest room to be occupied by a number of persons greater than the number permitted to occupy the guest room pursuant to the Village Code and applicable permits.
(B) 
Not more than twice the number of persons for whom sleeping accommodations are provided in a particular guest room, other than a designated hospitality suite, may congregate within the guest room at any one time.
(A) 
All public-facing entry points to any hotel or motel must include the following security mechanisms: i) magnetic or electronic keycard/locking devices for access; ii) operating automatic closures and key entry systems which remain locked at all times between the hours of 9:00 p.m. and 6:00 a.m.; and iii) alarm or other devices that alert hotel or motel security, attendants, or other employees that a door has been opened or remains open. The security mechanisms required pursuant to this Section 9-6-8 are not required for entry points to: a) the lobby of a hotel or motel, if the lobby is monitored by an employee 24 hours a day; or b) a banquet hall, conference room, or other meeting facility during a special event or meeting hosted therein.
(B) 
All hotels and motels must have secure doors, alarms, and a video surveillance system, all to the satisfaction of the Village Police Chief. Each video surveillance system must: i) include, without limitation, cameras, cabling, monitors, and digital view recorders maintained in proper working order; ii) provide continuous digital surveillance, 24 hours per day, seven days per week, of all registers, check-out stands, exterior entrances and exits, interior hallways, lobbies, and parking areas of the hotel or motel; and iii) produce digital images sufficiently clear and bright to enable identification of persons and activities recorded, for no less than 21 days. Areas with video surveillance cameras must include artificial lighting as may be necessary to ensure that cameras capture images sufficient to identify recorded persons and activities.
(C) 
The Village Police Department must conduct an initial inspection of every hotel or motel to determine the appropriateness of each hotel's or motel's video surveillance system. Pursuant to such assessment, the Village Police Chief may require changes to the number and/or placement of cameras within the hotel or motel. Upon approval of a video surveillance system, the Village Police Chief will issue an approval notice which must be placed in plain view inside the common area of the hotel or motel.
(D) 
The video surveillance system of every hotel or motel is subject to regular inspections by the Village Police Department, during business hours and upon reasonable notice, to determine whether it complies with the requirements of this Section 9-6-8. Upon receipt of a written notice from the Village that the video surveillance system of a hotel or motel does not conform to this Section 9-6-8, the hotel or motel operator or owner must take immediate steps to bring the system into compliance.
(E) 
The Village Police Department will develop, maintain, and publish video surveillance system standards that provide the minimum requirements for video surveillance system equipment, installation, and maintenance.
(F) 
Each hotel or motel operator or owner must provide for sufficient clerical or security personnel to ensure the safety of all guests, and to ensure compliance with the requirements of this Section 9-6-8.
(A) 
No person may loiter within or upon any hotel or motel lawn, parking lot, or parking structure, or in or around any hotel or motel building or common area without the permission of the hotel or motel operator or owner.
(B) 
Each hotel or motel operator or owner must advise guests, through posted signage within the hotel or motel lobby, that loitering at the hotel or motel is prohibited.
(C) 
Each hotel or motel operator or owner must enforce the curfew for minors imposed pursuant to Section 17-3-20(B) of this Code by prohibiting minors from lingering with the common areas of the hotel or motel during the hours of curfew; provided, however, that this Section 9-6-9(C) does not apply to minors whose parent, guardian, or chaperone is a registered guest of the hotel or motel.
Any hotel or motel operated, conducted, or maintained contrary to the provisions of this Article 6 is hereby declared a public nuisance. In addition to all other remedies, the Village may commence an action or proceeding for abatement, removal or enjoinment of any such nuisance.
Every hotel or motel operated or maintained in the Village must be inspected by a designee of the Village Manager at least once every year. Such inspections must cover all matters pertaining to the sanitary conditions of the rooms, beds and bedding, including the ventilation of all rooms or occupied rooms, and also all rooms occupied by servants or other employees, to ascertain the condition of such rooms with respect to light, heat, ventilation and general sanitation, and with respect to the compliance of the hotel or motel with applicable state, county, and Village regulations.
(A) 
The Village Police Department must develop a hotel safety program to teach hotel and motel owners and managers how to comply with this Article 6 and institute best practices for maintaining a safe hotel or motel.
(B) 
Each hotel or motel operator or owner must designate at least one manager to be certified through the hotel safety program to serve as a liaison to the Village Police Department, ensure that the designee becomes certified, provide a phone number and email address for the certified manager to the Village Police Department, and must provide the Village Police Department with an updated phone number or email address for the certified manager whenever either changes.
Any person violating a provision of this Article 6 will be fined in an amount set forth in the Annual Fee Resolution.[1] Each day that such violation continues will constitute a distinct and separate offense.
